Bill Author: 1999 Law In Conflict With Bush Position

The White House continues to maintain that the law then-Gov. George Bush signed in 1999 is “consistent with his views.” We rebutted that contention on Think Progress yesterday. One of the people who wrote the law has weighed in, and he agrees with us:

The new law appears to conflict with a Texas law Bush signed as governor, according to lawyers familiar with the legislation. The 1999 Advance Directives Act in Texas allows a patient’s surrogate to make end-of-life decisions and spells out how to proceed if a health provider disagrees with a decision to maintain or halt life-sustaining treatment. Thomas Mayo, an associate law professor at Southern Methodist University who helped draft the Texas law, told the Associated Press that if the Schiavo case had happened in Texas, the husband would have been her surrogate decision maker. Because both he and her doctors were in agreement, life support would have been discontinued, he said.

    I feel the Repubs really thought this case would be their cause celibre a la Elian Gonzales. I can’t be more pleased that conservatives are fighting over this & the whole mess makes dumbya & co look bad to most americans.

    The hypocrisy is sickening at best. Who do people think is paying for Ms. Schiavo’s care? I have attempted to research this and have come to the conclusion that the nursing home treating Ms. S should probably be investigated for Medicaid fraud.

    Various sources have quoted the nursing home as stating that her care is being given at no cost, that it is paid for out of her malpractice award, or that it is paid by Medicaid. Legally, the trust fund should be being used, so the home should not be giving her charity care or billing Medicaid.

    Course, future Terry’s won’t be able to use Medicaid or get malpractice awards big enough to pay for 15 years of care, so they’ll have to get charity care, which increases costs for folks who have insurance (how do you think providers recoup their losses?) or maybe future Terry’s will just have the “choice” to die dictated by the lack of funds to care for them.

    I hope folks wake up before this country is totally destroyed by these slimeballs.

    The Republicans in Congress knew all along that the judge would not allow the re-insertion of Schiavo’s feeding tube. That is precisely why they forced the emergency Schiavo act to send the case back to the judge. They WANTED him to oppose the re-insertion of the feeding tube. This gives them more reasons to lambaste the “evil judicial branch that is corrupting Americaâ€?. Just think of all the political capital they are gaining with the religious right! Makes me wonder, is Karl Rove behind this?

    Agitprop – the federal judge was strongly nominated by a republican and democrat and had nobody in the senate vote against him.
    Republicans had no problem with him being appointed.

    They shouldn’t be able to make hay on this – unless we fail to point out how strongly they supported him.
