Filibuster Deal: The DeWine Caveat

This is important. Sen. Mike DeWine (R-OH) during the press conference:

Some of you who are looking at the language may wonder what some of the clauses mean. The understanding is — and we don’t think this will happen — but if an individual senator believes in the future that a filibuster is taking place under something that’s not extraordinary circumstances, we of course reserve the right to do what we could have done tomorrow which is to cast a yes vote for the constitutional option.

    What double speak. What will be the definition of “extraordinary circumstances”? I sure there will be 101 interpretations of that phrase.

    AP has reported that the Senate 12 have brokered an 11th hour deal to avert a showdown over the nuclear option.

    The deal announced by Senator John McCain preserves the Democrats right to filibuster, but gives Priscilla Owen, Janice Rogers Brown and William Pryor a vote on the Senate floor.

    If the early blogosphere feedback is any indication, the Right and Left share a common sense of rage and betrayal at the outcome:

    - “Cowards. A Bunch of M-Fing Cowards!!!! “Trust”? This Is A Nightmare.” (Ankle-Biting Pundits)

    - “‘Bipartisan’Group Caves To Liberals” (Ace of Spades)

    - “Disappointing, I’m Afraid” (Powerline)

    - “I don’t know about you, but I don’t like it.” (Atrios)

    - “Beating Frist on the procedural vote may’ve been the best option. But the worst option was too horrible to contemplate.” (DailyKos)

    - “The Dewine Caveat” (Think Progress)

    For the right, Bill Frist missed a golden opportunity to enshrine a conservative judicial future and to castrate Democratic opposition in the Senate. For many Democrats, this tenuous deal depends on the good faith of a set of Republican counterparts like McCain and Lindsey Graham, certainly not the safest position to be in. As a matter of principle, the Democrats now face the prospect of accepting previously unacceptable judges.

    Our democratic senators, Barbara Boxer excepted, lack the guts to engage in politics. This is a massive defeat for us. We gained exactly nothing by this.

    I’m just not seeing the changes that have you upset Vaughn…An up and down vote is something the Dems didn’t believe these judges deserve but it’s hard to believe that the republicans who are hoping to keep their jobs would vote for these extremists..
    I guess I’m saying it aint over until the fat lady sings.
    Keep the faith, these judges haven’t been appointed yet.
    And remember Bushie has not taken action to protect judges in light of the Lefkow tragedy…Who knows maybe these judges will prefer to stay safe rather than be a target.

    Vaughn, you don’t understand just how badly the Religious Wrong wanted the Nuclear Option.

    They told Frist “No compromise, PERIOD”.

    Guess what? He compromised.

    Go visit any of the right-wing sites cited above. THEY know that they lost. And lost big.

    Yes, Phoenix the nuclear option was what Frist wanted and didn’t get…I’ve been signing petitions and writing letters for a month trying to stop Frist…I feel I did my job sucessfully.
    I’ve heard that this was a test for Frist on whether or not the Pug Party will run him as a candidate for Prez.
    I guess its safe to say that Frist is a Failure and will not be bothering the American people in 08.

    Screw it – I quit! Gutless leadership caves in on the worst 3 nominees. I refuse to die on my feet while the “leadership” has decided to live on their knees. If someone wants to pick it up, more power to you.
    Just leave me off the mail list.
    I’ve cleared the schedule for tomorrow, so I guess I’ll get a case of beer, go to the lake and decide if I’ll fish or jump off the damn dam.
    Thanks for your support and optimism. Screw it! Maybe the bastards will get raptured!

    It’s the perception that matters. If the spin comes down against the Christian Right, then they lose. Frist loses. Bush loses.

    Richard: No, it’s reality that matters. The Vichy Democrats threw in the towel, and all they got back was some vague promises from the Republicans which we all know are worthless. We need to get people like these seven Democratic Senators out of office. If they’re going to work for the Republicans, let them run as Republicans.

    Of COURSE the wingnuts are whining about it. That’s what they do. If they controlled ninety-nine seats in the Senate they’d still be pissing and moaning over the other one. Doesn’t mean anything.

    The nuclear genie isn’t going back into the bottle. From now on, until the end of the U.S. government itself, whenever a Vice-President and half the Senate want to dictate the outcome of any deliberation, they will have the diabolical Fristian bargain sitting there, tempting them.

    The bomb didn’t go off but it seems like both sides have their share of fallout. I disagree with phoenix woman and those of you who think this hurt Frist. Theres alot of pain coming down from disaffected grass roots supporters on both sides. Frist looks a hell of alot better to those of us in the GOP base then the Arizona Maverick. I think he just put the first of many nails in his presidention run coffin.

    On both sides of this debate there are some very angry people. Those of us who take notice of these issues feel sold out by our respective moderates and we will remember. Those of us who contribute the money needed to combat the other sides ads most of all feel betrayed. Next election cycle Snowe, Dewine and Chaffe better not hold there breath waiting for my check same for the RNC. My money will be going to those senators who are in my eyes worthy of it. This will probably be going on on both sides but will hurt the Gop turncoats more since our party usually gets more grass roots small donations.

    Santorums still in our good graces and might actually find himself flush with cash the others will lose out on. Chaffe and Snowe won’t be much of a loss to us since they vote with the dems alot anyway. Were going to pick up Nelsons seat that much easier since he will be facing the wrath of move on and naral. Dewine and Graham will probably face a primary chalange if I’m reading the anger in my party right.

    No the loser here is Bush whose lost powers we never demanded of Clinton when we found Ginsburg out of what we consider mainstream.
