Gonzales Raises Questions For Andy Card To Answer

Writing in the New York Times, Frank Rich highlights a troubling issue that arose from early on in the leak investigation:

As White House counsel, [Alberto Gonzales] was the one first notified that the Justice Department, at the request of the C.I.A., had opened an investigation into the outing of Joseph Wilson’s wife. That notification came at 8:30 p.m. on Sept. 29, 2003, but it took Mr. Gonzales 12 more hours to inform the White House staff that it must “preserve all materials” relevant to the investigation.

On CBS’s Face the Nation, host Bob Schieffer noted that this time gap would have “give[n] people time to shred documents and do any number of things.” Gonzales argued that he asked for and received permission from the Justice Department to wait until the next morning to order White House staff to preserve all documents regarding their contacts with journalists about Valerie Plame. But he did tell one person the night before

SCHIEFFER: Let me just ask you the obvious question, Mr. Attorney General. Did you tell anybody at the White House, get ready for this, here it comes?

GONZALES: I, I told one person, ah, in, in the White House of, of the notification, and, and —

SCHIEFFER: Who?

GONZALES: and immediately — ah, I told the chief of staff. And immediately the next morning, I told the President and, shortly thereafter, there was a notification sent out to all the members of the White House staff.

So the one person who knew that an investigation was underway was Chief of Staff Andrew Card, who also happened to be aboard Air Force One in July 2003 with Ari Fleischer, Colin Powell, and the top secret State Department document that contained the identity of Valerie Wilson. So, did Card tell Rove or Libby or anyone for that matter the night before Alberto Gonzales sent out the email to staff that they would soon be asked to preserve all documents?

On a separate note, Gonzales did an admirable thing on Fox News Sunday this morning. When asked whether he was involved in the leak, Gonzales did not duck the issue nor did he hide behind “an ongoing investigation.” He answered the question directly and has cleared his name for now. He also admitted that he has testified before the grand jury:

HUME: You were in the White House as counsel at the time that investigation was initiated. Have you been asked to testify in this case?

GONZALES: I was asked to testify. This was over a year ago. I did testify before the grand jury, yes.

HUME: And, can you tell us if you at any time were aware of Valerie Plame, either by name or by identification with Joseph Wilson? Were you aware that she was in the CIA? And did you have — and if you were — did you have any idea what kind of work she was doing?

GONZALES: … I had no information regarding Ms. Plame and her role at the CIA.

If the Attorney General of the United States can answer questions on the ongoing investigation, why can’t the White House?

UPDATE: The AP is reporting:

The White House did not immediately respond to questions Sunday about whether Card passed that information to top Bush aide Karl Rove or anyone else, giving them advance notice to prepare for the investigation.

    Given what we now know of Rove’s collaboration with Libby on the Tenet retraction of the ” 16 words,” Rove surely would have communicated with Libby soon, perhaps even before the Pres was notified in the morning (which I don’t contest).

    Gonzales said that it was late – after 8:00 pm when he called the White House, and that most of the staff had left for the day. By checking WH logs Fitzgerald would know who was there at the time of Gonzales’ call – AND if anyone returned that night after the calls were made. I think it would be very interesting to know who was in the WH at the time, and who returned shortly afterword.

    Now, the big question in this post is how much of the information lost in the twelve hours will be recoverable…but as for the story itself, it probably shouldn’t surprise anyone that Gonzales would handle this situation in a way favorable to the administration.

    colin powell’s testimony to fitzgerald’s grand jury more than one year ago must have covered the state dept memo that mentioned the name and status of wilson’s wife at the cia, the reference being marked with the letter “s” for top secret, do not reveal. powell showed this memo the next day to bush, rove, et al on the air force one flight they all took to africa. clearly each member of the junta must have read the memo. has powell spilled the beans? he has the motivation since his reputation was totally demolished at the united nations when he was given faulty information about iraq’s weapons of mass destruction. what is the role of colin powell in the investigation? his testimony certainly conflicts with that of the principal suspects.

    Fleisher’s press conference [ one of his last,I believe] reveals setting the stage for a denial and twisting of the meaning of Wilson’s findings in Niger. He goes to great lengths to repeat what Wilson REALLY said, etc. This was the beginning of the set up story the administration desperately needed, and ultimately morphed into discrediting Plame and Wilson all at once. Saying she was not a covert agent is really a pathetic dodge. Once a covert agent, always a covert agent despite one’s immediate assignment. It’s all about lots of contacts,trust, secrecy and cover.

    Great harm was done, and we will perhaps never know how much, but it wouldn’t take an investigative journalist rookie much to figure this one out.

    Lets hope Fitgerald has something before October,as he of course, will run out his time and never be extended. We are really looking at Card,Gonzalez,The Memo, Air Force One and who other than Powell,Rice,Rove,Libby,Cheney,Abrams,Feith,Judy Miller,Karen Hughes,Hadley, and a cast of thousands.

What the common links? What are the communications links on all of these PDAs? What is the Instant Messaging used? What are the recorded messages since this administration ran for election in 2000? How close are all the members to RNC and the election and their contacts during 2002, and 2003?

    And let’s not forget the 2 1/2 months before that they gave themselves to tidy up their stories.

I am not sure how it would affect women, so I am not as afraid for my 17 year old daughter, but my father got remarried and has two sons of 11 and 13 years of age. They are not in imenent danger of being drafted, but with the way things are dragging along….

    And now that Condi has told everybody that the “War on Terrorism” is a generational fight, they very well could be in danger. That scares me, as I have very fond feelings for my two new brothers.

    Also, what is the age cap on drafts? Would my brother who is 37 be at risk? Not at first, but as the body count goes up and more recruits are needed, I just don’t know. I wasn’t around during any of the Vietnam drafts, so I don’t have first hand knowledge.

    Guess I need to go do more research. It is always better to know than to not.

    Finally, I am curious to how some pundits can love their country and yet claim it is okay to attack a govt employee who has served her country for political gain. Any politician (DEM or REP) should lose their security clearances and be charged if they violate security precautions. I would love the actually leaker of her name to have the punishment similar to Die Hard 3. They should send this person to Iraq with a sign on their back and chest that says I outed a US CIA agent and walk to the hwy from Bagdad Airport to the Green Zone.

    I admonished the Washington Post’s Mr. Allen on 7/17 when his timeline article failed to mention the 12 hour gap:

    “Dear sir,
    please recall that the White House was told of the investigation (not Fitzgerald’s, but the one overseen by Ashcroft) the evening before it was officially commenced. The White House had about 12 hours to do…whatever the wanted with potentially damaging info. Please include this fact in future reports on this matter.

    Seem like I have a HR person that has for the pass two years the responsibility to edit resumes before posting it on the corporate site. I am an analyst and have done very difficult analysis 4 1/2 years, CM manager for 1 1/2.

    Since my job code is “Analyst III” I edit the resume to flex my greatest skills of doing analysis. I put the analysis highlights in the first sentence. After I submit it this HR person, she approves resume for posting to the site. Over the last two year you have had update my resume several time. Each time I have discovered that own edits putting in information about performing analysis activities and analyses reports I have found that the lead paragraph was altered and special attention gave to the CM Manager roles.
    In fact, the change mage it look a resume for a CM Manager and for the Analysis III that I am,

    The results are that when I put in analysis positions the reviewers saw a CM Manager with little to show for analysis work. So I did not get any interviews for analyst.

    Whie when she send out my resume to the jobs she want me to do it was always for CM Manager.

    I the moment there are any CM Manager positions available. And my resume get turns down for analysis positions because it shows only CM experience.

    Friday she tell me I have pigged for CM. There are no job for CM. You have 5 days to fine job or my last day is July 29th. Five day to transient out while trying to find a job.

Yes it is true that if things deteriorated to late Viet Nam type status then yelling and stomping would most likely get results.     Stephen Pizzo @ http://www.newsforreal.com/ had two very good solutions sometime last week on his site. Sorry I can’t link to the actual article just give you his site address and maybe you can find it from there if you are interested.
    Anyway the basis of his first idea was that we build bases every 20 miles or so along the Iraqi border between Syria, Iran, and Turkey (?) and send all of our troops to those bases and assign them the task of keeping more bad guys out of Iraq and let the Iraqi’s get down and dirty controlling their own cities. With just half of the troops we now have in Iraq that would give us quite a nice # (40?) of troops per mile to cut the flow of bad guys into Iraq. That means that half of the troops get to come home and that would leave the entire operation for the American military to be accomplished by the R.A. (career soldiers, marines, Air Force, etc. etc.) and bring home the Guard units.
    Pizzo’s part two of the solution progressed from the assumption that part one would not work because the Iraqi’s would not be able to control the people and basically Iraq would break into three countries which in his opinion (and many others I would presume) wouldn’t be all that bad. Look at the Balkans for an example. In any case we would be outta there and worse case scenario we would be border guarding and able to protect out troops and get away from the crazies with bombs. Nothing is perfect but I do like the sound of this idea. At least it’s an idea and it could come to pass without America cutting and running.

    Secondly, Ye, I am trying to understand the case you brought up with the war in Iraq. You say that you would not want your son to be drafted to fight this war. However, if he was drafted and killed in action, you blame the Democrats for this war. Am I hearing you right? Ye, would you blame the Republicans, and the Commander-In-Chief, Pres. Bush for this war, also? Or are they exempt from responsibility in your mind?

    I think it is sad that we can not see the impact that citizens of this country had on our going to war in Iraq. If I remember right, at the time of the congressional vote to ok a possibility for Bush to declare war on Iraq, around three-fourths of the US population was for this war in Iraq, presumably to protect the US from terrorism and WMD as the Bush Administration was claiming. On the surface, this seemed to validate and satisfy most of the population on this possible war. When we start to point fingers at our elected representatives in the US Congress, we need to remember that when elected, these politicians are there representing their constituents, regardless of political affiliation. If most of their constituents want something, the political knows that to get their votes at the next election, they will do what the constituents want. I believe that is part of the reason why most of congress gave the approval for the Iraq war, because the polls said the majority of US wanted it. Duh. It had nothing to do with political affiliation.

    Now, talking about getting a Democratic candidate for President with backbone. I recall voting for one during the Iowa caucus, but for some reason he wasn’t on the ballot during the November 2004 election. I can’t believe the Democratic Party can’t support someone with backbone enough to put him on a national ballot, but he’s okay to lead the Party. This all has to do with Democrats in general not being able to risk it and back someone who can make waves for the truth. And the lack of ability for the Democrats to make a valid counter-attack against the false claims of the pro-bully Republican Party and their croonies.

    Gramma, I don’t ever want to be in the position you are in with your child in danger as a soldier fighting a senseless war. In my life I have learned the hard way that human life is valuable. I love my children, and value human life too much to see such senseless death in this war based on lies and deceit. Each photo I see with an Iraqi mother holding her dead child in her arms, makes me cry in sadness and fills me with anger that we got to this point. If the Republican Party was truly Pro-Life, we would not be seeing these photos from an act orchestrated by the Republicans.

    Gramma, I pray that your child will be guarded by God’s angels, and that you will find peace in your heart to honor your child’s sacrifice to serve our country with time, talents and possibly life.     But everyone knows that isn’t going to happen (short of the Viet Nam type scenario that I spoke of earlier) and if one is really honest about the situation, no responsible person could in good faith really think that after the mighty US caused such a mess we should just up and leave. Yes we were wrong to invade, yes we are wrong to prolong our stay or stay permanently, and we would be wrong again if we just flew the coop. We made the mess and we should make an honest attempt to right the ship but do it in a way that will take the risk away from our troops and bring the full responsibility onto the shoulders of the Iraqi people.
    I was and I will always be against this war but I must face up to the fact that because I allowed our country to do what it did I also must allow our country to make things right to the best of our ability. I hate it just as much as the next guy but that is the facts of life at this juncture in the situation. If we take a few smart steps now then maybe we won’t be having this conversation in the ‘08 election. However, that said, I am not holding my breath.

    Don’t overlook the semantics of Gonzales’ answer. According to the transcript, he said “I, I told one person, ah, in, in the White House of, of the notification, and, and…”

    Notice the hesitation after “I told one person.” Notice the phrasing “in the White House.” Does that mean that he told one person who was an official member of the White House? That he told a person who was physically in the White House when told?

    Could he sort of truthfully give the answer he gave and still have told someone not “in the White House?” Would Karl Rove be considered someone “in the White House” before his official appointment after the elections? Would someone in their private residence in Maryland or Virginia be considered “in the White House?”

    Just wondering.

    The Plame Game makes me wonder again, why was Bill Clinton impeached? And, why is George W. Bush still in the White House?

    Oh, wait, when Bill Clinton was president, Ken Starr was sent by the Republicans to sniff out some way to get Pres. Clinton out of the White House. White Water failed, and numerous other “congressional investigations” turned up nothing, UNTIL they decided to cross the line and ask Pres. Clinton a question about a harmless private affair under oath.

    Someone mentioned to me the other day that there was some policy that the Republicans pushed through congress during the Clinton administration that allowed unlimited congressional investigations for just about anything that was conveniently allowed to expire right after Dubya became president. Thus, probably the reason why this investigation has to be over by October 1st, instead of having an unlimited amount of time and budget to devote to “congressional investigations” like they had with Clinton.

    Unfortunately, it looks like if Bush has this investigation around his little finger (remember how he wiggled out of testifying under oath to investigators on the 9/11 report?), he’ll likely get out of this one, too.

    If Democrats want justice, they need to create a policy so that they can have a Democratic version of Ken Starr vicious attack dog to hunt down Bush and his croonies, just like they did to Bill Clinton. However, this time instead of destroying a benign leader, the truth will be uncovered, the Constitution will re-established as the guiding force for our Country, and justice will truly be served.

    Lots of meaningful comment, even the “trolls” comments. I’ve always thought for so many trolls, to have so much time to post on so many left-of-center blogs, someone must be paying them to do so.

    Not that I’m suggesting yet another conspiracy. “Treason-gate” gives us plenty to work with. All the more so since it was done as an act of political revenge and disinformation.

    It is about treason, isn’t it? Revealing the identity of a CIA agent under cover is a crime, correct?

    Makes all other undercover agents feel uneasy? Intimidated? Distrustful of an entire Administrtion and White House?

    Gonzo can comment because it was things already said but Scotty pooh can’t comment even on things already said.
