Roberts Knew He Was Acting Unethically»

In April, Judge John Roberts “heard arguments about the Bush administration’s [Guantanamo Bay] policy as he was discussing a Supreme Court appointment in private conversations with the White House.” On July 15, “when Judge Roberts met with President Bush for the job-clinching interview, he joined a ruling in favor of the defendants, who included Mr. Bush.” The White House claims Roberts didn’t do anything wrong. Bush spokesman Steve Schmitt said “there was no conflict whatsoever.”

John Roberts knows better and we have proof.

In 1986, when John Roberts was working in the White House Counsel’s Office for President Reagan, he was asked to review a mundane request by an attorney named Lester Hyman. Roberts replied:

I must recuse myself from this matter, in light of pending discussions with Mr. Hyman’s firm about future employment.

So Roberts understands it’s unethical to make professional decisions that impact a prospective employer. When it came to the prospect of a nomination to the Supreme Court, Roberts simply set ethics aside.

    Roberts took an oath and we have to take him at his word. It’s not really relevant and certainly not fair to say he schilling for the Admin to get a spot on the Court. Besides, Bob Shrum, Harry Reid and several other Democrats said a Gonza appointment would not have conflicts of interest. Nice try guys, but not really.

    Should Justice Stevens recuse himself from death penalty cases because of his comments in Chicago?

    Cheney and his Halliburton share-options? No problem. Scalia and his private duckhunting trip with the Veep? No problem. AG Gonzales making decisions on prisoner abuse prosecutions? No problem. Kenneth Blackman overseeing the election in Ohio? No problem.

    Roberts was not recusing himself here was probably the loyalty test Bushco needed him to pass.

    I wouldn’t care much if he were just anti-choice anti-separation of church and state. That’s a general conservative position.

    The problem is that he’s anti-voting rights, anti-women’s rights, anti-older Americans, anti-disabilities, anti-access to justice, anti-privacy, pro-unlimited executive power and the list goes on.

    I think any further conservation regarding Roberts here is pointless since he will be confirmed by 70-80 votes. How about coming up with those ideas that will help a democratic candidate take back the White House in ‘08 or more seats next year. I have been watching Think Progress for about three months now and I still have not seen anything but Bush bashing. I guess I don’t have anything to worry about.

    NED,
    Oath’s don’t mean a damn thing. In the system that we all live in, it is within the law of the land for the government (in this case Congress) to demand to see documents that help piece together who this person is.

    It is RIGHT for both sides to do these things, even if the roles were reversed. The “democrats/liberals” (of which I don’t categorize myself as) represent a large portion of the people in this land. The “republicans/conservatives” (I’m certainly not one of them either) represent another large portion. If someone is being appointed that is on the other side of the coin, those that represent the others MUST stand up and make sure that this person will do a fair job for both sides, and in some cases do everything within the law to stop it. That is part of the checks and balances that were put into place when this country was founded.

    Now, does that mean that “smearing,” as you put it is not wrong? Of course not, it is wrong. But what is lawful, yet negative from the point of view of one party, will be categorized as “smear” whether it is or not, just to try and take the wind out of the sails of those doing the investigating, as long as it is self-serving to do so.

    Time to grow up NED.

    Even if Roberts is not made ineligible because of this obvious conflict, the law states that the White House, through Gonzales, had to notify the plaintiff in Hamdan vs. Bush about the interviews with Roberts. The White House, specifically Gonzales, broke the law. This is indisputable.

    At least two issues are separable. Bush may be able to appoint Roberts and the court lean more toward the fascist state.

    The general behavior of the BushCo has been toward a fascist state. I will not enumerate but such discussions are plentiful. A battle should be fought nevertheless to prevent his appointment.

    Those who support BushCo are either misinformed, have a personality disorder, or are simply stupid. There is no intelligent support for fascism.

    Of course Roberts knew he was breaking an ethics rule by interviewing for a position without recusing himself from a case involving the party with whom he was seeking employment. All U.S. Government workers in potentially sensitive positions receive annual ethics training, and the topic about seeking employment is covered in the training each time it is presented. Even low-level civil servants are required to notify their supervisors when they are as much as approached about possible employment by parties their agency might do business with.

    It is judges like Scalia, Thomas, Rehnquist, Kennedy, and O’Connor who have sought to impose their RW agenda on Americans despite states and Congress passing laws to the contrary. (environmental protections, anti-trust laws, family and medical leave, Violence against women’s act, etc………… )

    FAct: The two judges who have the highest % of votes to overturn an act of Congress are Scalia and Thomas. Rehnquist is third.
