Criminally indicted former House Majority Leader Tom DeLay yesterday laid out a strong case…against himself.
Each of the points below were spoken verbatim by DeLay during an interview last night on Fox News (we’ve compiled them all into a single video). If this is his “defense,” he’s in serious trouble.
Watch the DeLay compilation: Quicktime Streaming
– I have had ethics charges filed starting in 1993
– Again in 1995
– A racketeering suit right after that
– Some more ethics charges right after that
– This has been going on for two years, multiple grand juries, and then they come out with an indictment
– [The grand jury] asked me to come in. … Basically what I showed them was, yes, it was my idea to set up this political action committee
– It was my idea to set up TRMPAC
– I got it all organized
– I and four other elected officials were on an advisory board [of TRMPAC]
– I went to five fundraisers
– They did use my name to raise money
– They told me about it later, and then they would tell me things are going well
– Jim Ellis … also runs my ARMPAC
– Jim Ellis would let me know how things were going because was interested in how things are going and how much money they were raising
– The point here is is Texas deserved a Republican House of Representatives. The way you got change that was to take the majority in the Texas House, and that was my goal. It was successful
– Ronnie Earle let my lawyers know last week that I was going to be indicted
– I have hired Dick DeGuerin, who is my lawyer, who is the same lawyer that taught Ronnie Earle a lesson

You know, there is an amendment between 4 and 6 that you could have used.

September 29th, 2005 at 2:28 pmI like Ben Stein. He’s my kind of Jew. Not like the Jews on this site that wear red diapers, frequently misspell words and point out that Arabs are Semites. Fuck the Arabs and the Jews unless they vote Republican, that’s what I say. But Ben Stein is a good guy and you can’t fault his reasoning on this attmept by Ronnie Earl to screw a good guy.
This is another Newt Gingrich type harassment by a party that cannot accomplish anything through the democratic process, so turns to using guerrilla tactics. Like Gingrich, Tom DeLay will be exonerated — after spending a fortune on lawyers. I personally find it galling that the party of Bill & Hillary Clinton would have the balls to accuse anybody of misusing campaign or PAC funds, but you do, and will keep on doing it until we hang you. Soon, I hope. Free beers when we do.

The Truth About DeLay
By Ben Stein
Published 4/12/2005 1:05:27 AM
Herewith a few truths about Tom DeLay, the embattled GOP Majority Leader in The House of Representatives.
1.) Tom DeLay is morally probably the highest level public servant I have ever met. With virtually no political gain to be had from so doing, he has been the most enthusiastic supporter of Israel in the U.S. Congress. He has stood with Israel against terrorism and international anti-Semitism without reservation or fear. This is a man with more moral decency in his little finger than his detractors have in their whole bodies.
2.) The attack against him in the Texas courts are an outrageous — but sadly emblematic — Democrat attempt to use the judicial system to defeat the electoral process. The DA who is tormenting him is the same one who made up an indictment of Kay Bailey Hutchison out of whole cloth to try to reverse the results of a solid electoral victory by the Republican party in Texas.
If this kind of deviltry works, we can expect local Democrat district attorneys to routinely indict any Republican who is successfully turning out the electorate for the Republican Party. No elected official, no bureaucrat, is more unaccountable than an out of control, hatchet job prosecutor, and this is just what we are seeing at work against Tom DeLay.
3.) The very fact that the Mainstream Media are so desperately struggling to smear Tom DeLay is proof positive of what a good job he is doing at leveling the electoral playing field.
4.) If we throw him to the wolves, we are betraying a dear friend of the party, and a good man — and allowing a vicious dirty trick through the judicial system to subvert the Constitution.
5.) Tom DeLay’s comments about a judiciary that sanctioned the torture murder of Terri Schiavo and how it has to be brought to account was a brave and entirely sensible approach to an issue that dismays and frightens many Americans. His comments are yet another sign of what a fine patriot this man is.
6.) He has been there for us, and we need to be there for him
September 29th, 2005 at 2:29 pmWhy doesn’t he use the “I can’t comment on that because it is an on going investigation.” line. Hasn’t he spoken to Karl? What an idiot.
September 29th, 2005 at 2:32 pmI’m begining to love this man! The same way I love those creapy looking puppets on childrens TV shows that are just completely clueless which makes you laugh. DO I make sense here?

September 29th, 2005 at 2:39 pmAll of these thing sare connected, the Abramoff deal, and all of Delay’s issues. We Americans need a whistleblower. I hear that Bush has a guy involved in this Delay thing as well. These guys are so crooked!
September 29th, 2005 at 2:40 pmGive him a while, Elvis, he’s trying to think of something “clever.” This will take a while.
September 29th, 2005 at 2:41 pmMuch as I want DeLay to be convicted a video clip of him being his usual blowhard self falls short of self-incrimination.
September 29th, 2005 at 2:42 pmWhen offered enough rope to hang themselves, the greedy just simply cannot resist grabbing as much rope as they can get, perhaps to use it to tie up their detractors, they fail to read the Product Label: THIS ROPE IS ONLY USED FOR HANGING YOURSELF, have a nice day.
September 29th, 2005 at 2:45 pmSchadenfreude!!!
September 29th, 2005 at 2:46 pmJust like Our Arrogant Leader, he sees himself as righteous and above the law. Did he use the words “Bring it on”? He might as well have. How many “I’m not a crook” speeches are we gong to get this week?
September 29th, 2005 at 2:49 pmLesly — DeLay’s defense is that he had no idea what was going on at TRMPAC, and he claims there was no motive for committing a crime.
In the transcript above, he lays out the significant role he played in TRMPAC, and he explains his motive.
That’s incriminating.
September 29th, 2005 at 2:49 pmWhen offered enough rope to hang themselves, the greedy simply cannot resist.

September 29th, 2005 at 3:12 pmTerek – But is it sufficient to convict him of conspiracy along with the key players who face multiple charges? Conspiracy is a pretty nebulous charge. Easier to indict with than convict according to what I’m reading. Check out the Houston Chronicle’s take:
Either DeLay is way in over his head or he’s waving his chutzpah in front of the cameras because he knows something we don’t.
September 29th, 2005 at 3:13 pmThink as thieves…
DeLay hasn’t yet figured out that when the sh*t hits the fan, and you get read your rights, this isn’t show business - it’s the criminal justice system at work, and you aren’t above it.
Novak before him, couldn’t figure out, despite the having the best lawyers a money can buy, that talking about the Plame case was a f*cking stupid idea given he was the hitman.
And there was Rove’s dickhead lawyer who kept on blowing confidentiality arrangements with journalists which made Fitzgerald’s job a whole lot simpler.
O’Reilly, when Andrea Makris nailed him with the phone sex falafel stuff… he too, couldn’t help crapping on about it on talk radio.
Frist too - took him a few days to realize that when you open your pie-hole before the SEC has finished rooting around your financial dealings… very bad idea.
TV, even an appearance on Fox, won’t get you off the hook. In fact, it only makes a prosecutor’s job of destroying your credibility a whole lot easier.

You say that as if purging the Hill of corporate shilling whores on both sides of the isle is a bad thing.
What’s really pathetic is your weak threat implying that we ought to lay off the deep rot in your party so the GOP’ll “spare†Democrats. #1, as if the GOP would ever consider it. #2, self-serving attitudes like yours facilitate and will continue facilitating the erosion of personal integrity in American politics.
September 29th, 2005 at 4:23 pmNED,
We have no problems with investigations into ethical problems of either/both parties. What do you say we start up a TRULY independent investigator (say from the UN or Switzerland) to do an outside investigation of ethics issues in both parties? I’m all for it - are you?
See I know you won’t be, because you’re a hypocrit and morally bankrupt. I’m 100% for treating both sides fairly and rooting out corruption in the democrats. In my experience corrupt democrats are typically just republicans who are still made at the civil war anyway - and they deserve to move on to the party of the corrupt and imbeciles anyway…
September 29th, 2005 at 4:33 pmI will be the first to throw stones at any corrupt policy regardless of party. Its just more fun to sling stones at “godlike” republicans.
September 29th, 2005 at 4:36 pmI say if democrats pushing for an investigation backwashes into getting rid of democrats who are dirty - all the better. I’m for flushing all of the turds down the toilet who are dirty. Since republicans seem to all have dipped into the well of TRMPAC and Abramoff and his AlQueda dollars - the ride should be marvelous! Come on NED - great strategy - keep it up! If we get the public REALLY riled up, they’ll demand a special prosecutor since it’s clear that the congress is ‘dirty’ as you say! Be still my heart!!!
PUSH NED PUSH - lets birth this baby!!!

Whether you have anything that’s worth shit when you’ve won doesn’t seem to matter.
You guys love to spout about values but the values you embrace are as shallow as your ideas. You happily sell your country out just to be on the winning team. Pathetic.
September 29th, 2005 at 5:18 pmI agree, let’s get NED and the UN to clean up this whole crooked country where legalized corporate bribery IS the name of the game. Are you down NED? Yeah, didn’t think so. But, by all means, have your minions start cleaning up both sides of the aisle. Maybe then we can actually find some public servants instead of public looters.
September 29th, 2005 at 5:25 pm#28 - you’re pathetic. I will save this blog entry when liberals start crying after the GOP spanks them with their own ethics problems.
Comment by The Northeast Dilemma — September 29, 2005 @ 4:04 pm
Hah, I guess you’ll never use it then because the GOP has far many more ethical problems than the Dems or Independents ever had. Besides I don’t think trying to save the environment or saving basic civil rights is an ethical problem such as the Dems and independents are trying to do.
September 29th, 2005 at 5:34 pmBush & Co. has done nothing but gut all the environmental laws that were hard fought to protect the health of this nation’s people by selling them off to his Corporate Interest buddies and has taken away the basic civil rights of this land by allowing their own citizens to be arrested on no charge and be detained infinitely without trial. Such things are unethical and those responsible held accountable but it seems the Bush Administration has no idea what accountability is. Hell, anytime someone messes up Bush hands them a Medal of Honor when he should be handing them a pinkslip.
I’m surprised Brown and Chertoff didn’t get a medal this past month for their fabulous work in N.O.!
The fact is Delay has already been reprimanded many times resulting in just 3 slaps on the wrist for unethical behaviour already and in the Govt it seems it is 4 strikes and your out instead of three. Delay has already set himself up for the big fall by having previously announcing that he was in fact in charge of the TRMPAC and was involved in all aspects of its fundraising and agendas. Now he’s trying to deny that he was ever involved with it and that they were just using his name and he had no idea what was going on. Too little, too late my friend!
The sh*t has hit the fan and he is about to be covered in it!
Kiss your 2008 prez candidacy good bye! (Thank God!)
From the Houston Chronicle article cited above:
[“I can’t imagine indicting a majority leader of the U.S. House of Representatives without having a smoking gun, and that means someone who flipped on DeLay,†said Buck Wood, an Austin lawyer who filed a related civil lawsuit on behalf of Democratic congressional candidates. “He’s got to have corroborating evidence, too, bills and things proving where DeLay was at key times.â€
Several lawyers and law professors said Travis County District Attorney Ronnie Earle could (should the word NOT be inserted here?) have talked the grand jury into a questionable indictment if he hasn’t secured key witnesses who were “in the room†with DeLay. Otherwise, this conspiracy case could be too hard to prove with just circumstantial evidence, they said…]
The implication is still that DA Earle is responsible for the indictment. Heard a guest on PBS’s News Hour say that this was one time the Grand Jury was pushing the DA to hand down the indictment — not the other way around.
Maybe THEY know more than we do!
Rep. Roy Blunt (R-MO)who is “temporarily” taking over for DeLay may be getting the same mail at the same address. Besides being a big contributor to DeLay’s defense fund, he’s had close dealings with Delay’s co-defendant Ellis in ARMPAC (another Tom DeLay big idea). And he’s got a few chickens of his own that seem to be coming home to roost.
September 29th, 2005 at 5:41 pmSince Blunt was appointed over the logical next in line for the position (at the insistence of the GOP hard right folks), what message does that send to the voters back home? Crime Pays????
He had it coming to him.

September 29th, 2005 at 5:55 pmThis charming former pest control person is in need of a spanking. Trouble is the Repubs think they rule the USA. If Ronnie Earle has his case in order, pest control boy will be vacationing in a state prison.
September 29th, 2005 at 5:59 pmIf there is a “flipper” with a smoking gun, they had better remain clear of small aircraft for the forseeable future.
September 29th, 2005 at 6:06 pmNED,
I read your Freeper post and am trying to see how this reflects poorly on Reid, other than arranging a federal grant for a ministry that turned out to be crooked. Reid didn’t get any of the money. Also everyone seemed to be all hot about $500 he donated to the church that was a campaign contribution from Johnny Huang. In what way is this even remotely comparable to Delay?
September 29th, 2005 at 6:08 pmDeLay is hoping he gets the same judge that sat in on Hutchisons case. He was a wingnut who would not let the DA present his evidence.
Earle then decided to try the case later, but the judge, all on his own, had the jury sworn in and had them declare Hutchison innocent.
There were recordings of Hutchinson asking a third party to erase the tapes, but the judge would not let Earle present this evidence.
Rove was involved in this also. So watch out Earle, here come the big nasty lying shit eating dogs.
By the way, Hutchinson is another of the 30 repukes on my list that are alcoholics. She wakes up in the morning and has no idea where she is or in whose bed she spent the night. She is a Rove whore.

September 29th, 2005 at 6:57 pmGo check out Juanita’s World’s Most Dangerous Beauty Salon. It’s a website out of Sugar Land, Hot Tub Boy’s own stomping grounds.
– Juanita’s take is that what Ronnie has is “chicken feed”, the mere appetizer to the stuff that really will take down not just DeLay, but a whole bunch of other Republicans. And it’s all tied up with Jack Abramoff.
– Juanita says that if you want to make sure Tom DeLay gets replaced by a human being, your best bet is to give money to Nick Lampson, who even with limited funding did credibly well against DeLay last year, considering that DeLay had that district drawn to his own personal satisfaction.
This is especially important as Nick has to be ready to hit the ground running in the event of a special election, should Hot Tub be forced to take a bullet for the team in the next few weeks, before the January hearings — which is when the real DeLay trial fun begins.
September 29th, 2005 at 7:07 pm– I have hired Dick DeGuerin, who is my lawyer, who is the same lawyer that taught Ronnie Earle a lesson
It’s hard to believe this guy really thinks god gave him that right. He thinks it. Gone past believes.
September 29th, 2005 at 7:11 pmI want a copy of the mug-shot to use on my dart board.
September 29th, 2005 at 7:12 pmAs Delay himself said in his own defense, “people hate the messenger. That’s why they killed Christ.”
The similarities between Tom and Jesus are striking…
September 29th, 2005 at 7:39 pmI hate to say this, and I hope they nail his ass to the wall. But, he must have something up his sleeve to openly incriminate himself. Either that, or he is a complete moron, and if I were a neocon republican communist piece of shit, I would be ashamed of myself!
September 29th, 2005 at 7:58 pmNED? NED?
September 29th, 2005 at 8:05 pmWhere’d he go?
Typical.
I’m with NED. Let’s get an Independent Prosecuter (what’s Fitzgerald doing after he nails the treasonous bastards that outed a CIA NOC?) and do a proper investigation into all of the corruption into Washington.
Democrat, Republican, Independent….it matters not. Let’s investigate and prosecute all of the criminals.
Think the Republicans will go along? I’ll hold my breath while I wait for their leadership on this issue.
September 29th, 2005 at 9:01 pmChewbacca defense. I’m telling you why I’m guilty. Does that make any sense? Ladies and gentlemen, I’m not making any sense! etc.
September 29th, 2005 at 9:07 pmI have a friend in PA who works for an assisted care facility. About 18 mo ago, one of Delay’s staffers called her boss and said Delay wanted to give him a special award…that he would be given this award by the House…
The man was puzzled as to why the House would want to give him any award.
And was told that yes, absolutely the House wanted to honor this man for all the work he had done for the elderly.
Well, that seemed pretty amazing! And amazing it was….all he had to do to receive this “award” was to donate to Tom Delay’s PAC!!!
My friend who is a native Texan, living in PA, told the staffer to uh…well…take said “award” and stick it where the sun don’t shine.
This cr*p has been going on for a very long time under Mister Delay.
September 29th, 2005 at 9:16 pmNone of those things he stated actually explicitly indicate that he was a part of a conspiracy to commit a felony. He has to explicitly have known that a law would be broken. He could technically not have known that a law would be broken, and still have been organizing things. Now of course, that’s a load of ****, but it is technically possible he didn’t know exactly how his objectives would be accomplished. Sorry ppl, but his statements do not explicitly incriminate him on the charges brought against him by Earle.
September 29th, 2005 at 10:10 pm– Juanita says that if you want to make sure Tom DeLay gets replaced by a human being, your best bet is to give money to Nick Lampson, who even with limited funding did credibly well against DeLay last year, considering that DeLay had that district drawn to his own personal satisfaction.
Lampson didn’t run against Delay last year. Richard Morrison did. And after Morrison showed that Delay is vulnerable by making a respectable showing, despite not having any support from the Democratic Party, Lampson and the Party machine shoved Morrison aside and took over the campaign. Lampson’s not a bad guy (he represented Beaumont in Congress for a couple of terms), but Morrison deserves the credit for taking on Delay when the pussies in the national Party were too scared to.
September 29th, 2005 at 11:18 pmWhy does Delay say all this? Because it’s on Fox and the typical Fox viewer will see him say I did it, yep me Tom DeLay did everything I was charged with, but they will hear blah blah blah, liberal witchhunt, blah blah blah.
September 29th, 2005 at 11:25 pmTommy boy was one of the motivators that caused me to finally leave that other party in August of last year. I figured out that he was crooked then, and don’t have any reason to think he isn’t now.
Thank you Sir, your indictment made my year.
BTW, I won’t be shopping at Sears anytimne soon.
September 30th, 2005 at 12:00 amMe thinks there’s a long, long list of people who got a shoe in the face during Tom Delay’s scrabbling climb to the top of the festering human pyramid of GOP power.
How many do you suppose can’t wait to kick him in the nads on his way down?
September 30th, 2005 at 1:36 amNow tell me the truth Tom, is this kind of fun?
September 30th, 2005 at 5:15 amTrouble is the Repubs think they rule the USA.
Last time I checked, they do. If we don’t want corrupt creeps in office, starting wars and destroying the environment and nominating conservative judges for life, well, we ought to start winning some elections.
Think about that in 2006 and 2008. Give more. Work harder. Get one more person out to vote. Do someting. Quit being a victim and start being a victor.
September 30th, 2005 at 8:05 am“Sorry ppl, but his statements do not explicitly incriminate him on the charges brought against him by Earle.”
It’s called circumstantial evidence. If the prosecutor shows that Delay had such control over the organization that he must have known what was going on, the jury can convict. Delay’s statements in this interview can the prosecutor enough evidence, in my judgment (lawyer with 30 years’ experience) to take the case to a jury and avoid a directed verdict.
September 30th, 2005 at 8:15 am[…] Update on the Delay indictment from Think Progress: Delay gave an interview with Fox News which was supposed to bolster his defense. However, if you listen to what he says, it makes a much better prosecution than defense. Take a look. « The Long Delay-ed Indictment […]

September 30th, 2005 at 10:56 amI think DeLay has been so successful thus far, that he’s a cocky SOB who thinks he’s untouchable… that kind of arrogance leads many a powerful man to completely blow his ride by going too far… DeLay is guilty as hell, and may well have to end his political career, though jail time is doubtful… he’ll get some kind of fine that he can pay with his pocket change…
and, yes, there are plenty of companies who’ll line up to have him on as a lobbyist…

September 30th, 2005 at 10:57 amWhy does he keep saying that: just two weeks ago they told me they were not looking for an indictment on me; and then he says last week they called and said they were going to indict me. And that begs the point: he had a week to ready a response and the “It’s political and I’m innocent” is all he cold come up with. It sounds like he isn’t getting much help from Bush & Co. Delay can say and do anything because this just doesn’t matter. They will continue their corrupt agenda and we’ll be shocked for a couple of days but we’ll be busy looking a job or trying to feed our families or taking out loans to put gas in the car, fill the oil tank and pay medical bills.
