There is some buzz over at Free Republic that DeLay’s attorneys are asking for dismissal of the conspiracy charge, on the grounds that the conspiracy law didn’t come into force until AFTER the 2002 elections. The speculation is that the laundering charge was desperately rammed through a second GJ as a fall-back.

But wait — Atrios cites a Texas law school prof who believes the State’s existing penal codes for conspiracy pre-date and supersede the explicit changes to the election code…so the conspiracy charge may yet stick.

In 2003, the law was amended to say “any felony, including any election law felony”. Law experts in Texas say the original charge would have stuck, but Earle wanted to be extra careful.
The dismissal was denied. This new indictment was handed down by a brand new GJ, just empaneled. FReep and the Goopers and Delay’s lawyer, can sit on it and spin all they like. Tommy boy is going to be somebody’s punk ass bitch.

I was trying to think of the systematic racially-motivated indictments in the Old South, but again, DeLay insists every single criminal charge from that era had more basis than his indictment.
Money laundering can have a heavy sentence, if it is a large sum. Considering the Median household income is $60-80 thousand, I would consider $190,000 a lot.
Let’s hope there are some regualr everyday people on that jury.

Delay didn’t just ask people for money, he FORCED them to replace their senior management with republicans, otherwise he wouldn’t give them influence. He was working to remake ALL of corporate america into his Reichwing Corporatist/Fascist support network – not just those companies who originally drove the show.
He’s been very successful at it to. That’s why so many companies rally around the failed economic policies of the country and ‘pretend’ that they work. It’s a sad state of affairs, because in the end these unpatriotic dupes put us at risk internationally because of their ineptitude and cronyism. China, Europe and Japan will not sit still while these dopes – who’s claim to fame is an opposable thumb – fumble through the destruction of american business similar to the one that’s occurred in american politics…
The whole strategy of a bull rush legally makes sense. One or two charges a day, every day, and one will stick. One will hit too close to home. All it takes is one that Delay reacts off-key to and he is finished. The Abramoff comment is good, too: Delay is done for, and can’t threaten people with his power anymore. If it comes down to ratting on Bugman or spending another fistful of years in jail EVERYBODY RATS.
