White House Continues to Exploit Miers’ Religion

At today’s White House briefing, Press Secretary Scott McClellan claimed someone’s religion has no impact on their performance as a judge:

[A] person’s religion or personal views have no role when it comes to making decisions as a judge.

But McClellan also said telling people about Miers’ religious views is critical for gaining support for her nomination. Here’s McClellan during the same press conference:

But she is a person of faith. She is someone who attends church on a regular basis…And that’s all part of reaching out to people to gain support for her nomination.

George Bush said the same thing earlier today:

People ask me why I picked Harriet Miers. They want to know Harriet Miers’ background; they want to know as much as they possibly can before they form opinions. And part of Harriet Miers’ life is her religion.

And right-wing religious leader James Dobson was briefed on Harriet Miers religion by Karl Rove:

What did Karl Rove say to me that I knew on Monday that I couldn’t reveal? Well, it’s what we all know now, that Harriet Miers is an Evangelical Christian, that she is from a very conservative church, which is almost universally pro-life.

The White House peddled Miers religious views as a way of responding to conservative criticism of her nomination. And it continues to do so.

    I believe that the GOP’s alignment with the Evangelical Taliban is purely cover for their theft of elections (and a convenient way to launder money). They tout their alliance with the largest religious contingent in the country and lean on that precarious base when they need to prove that “the mainstream” is behind them.     Judd finally has found a topic worth commenting on – though he adds a typically over-the-top spin to the issue.

    Harriet Miers’ personal background, including her religious faith, is as relevant as any other aspect of her personal profile for purposes of telling us who she is and what her personal values may be. And it is doubtless true that, as a Christian, I can identify with her faith background somewhat more easily than I can with that of, say, Ruth Bader Ginsburg.

    But these personal details are completely irrelevant for purposes of telling us what kind of qualifications Harriet Miers brings to the office of Supreme Court justice. For that we must look to her education and professional experience.

    Harriet Miers received a fine education at SMU. She has worked as a practicing lawyer, and has tried complex cases – something most of the current justices have never done. She worked her way to the top of the Texas legal community, at a time when women lawyers in Texas were not often encouraged in their ambitions, to say the least. She managed a 400 lawyer firm, and met a 1,000 person payroll, which is no mean feat if you have ever tried it. And she has been on the front lines in Washington for the last 5 years, working on legal policy with the President in matters as wide-ranging as enemy combatant detention, securities legislation, and – most notably – judicial appointments.

    Those judicial appointments have been, almost without fail, of conservative judges who firmly believe that courts should interpret the law, but should not make policy judgments. It simply cannot be that Harriet Miers has been a party to these appointments without sharing similar views on judging and the constitution.

    This point is one that may be bolstered, at least for some, by the knowledge of Ms. Miers’ religious faith. Her faith tradition is such that she could not have aided the appointment of so many consewrvative judges if to do so violated her own core principles. If she disagreed with the President’s appointments she would be obliged by her faith to remove herself from that process.

    I am inclined to trust the President on this nomination – especially with so many treacherous undercurrents swirling in the Senate, even among Senate Republicans. President Bush knows Harriet Miers personally and well. With her active assistance he has appointed some of the brightest conservative minds to the federal bench. And if she didn’t fully support those appointments, she wouldn’t have been so closely involved in making them. That’s good enough for me.

    The Judiciary Committee hearings should be amusing. I don’t think the Senate Democrats can afford to defeat her. That would only make it easier to get a more conservative nominee confirmed in her place. But you can bet the left wing intereest groups will be going nuts on this one.

    That’s a good question. I would never question the faith of the flock, it’s such a powerful force and it helps people get through tough times and gives them strength. However, blind faith in such easily exposed criminals leads me to question their intelligence. Can so many people be that stupid? Is this why Republicans want to allow public school to deteriorate? Why both D’s and R’s have allowed our media to become so grossly anti-demoracy? So, so sad.

    I have nothing against a person stating that they are religious before being confirmed to the bench. But once on the bench, there is no place for any reference to it.

    The law is the law. It has been influenced by social mores, not religion. Some mores have become planks of religion.

    However, absent religion, there still exists social responsibilty. Absent social responsibility, religion is nothing.

    I understand heritage and tradition. Yes, almost all early Americans were Christian (after Native Americans). Nice to remember. But, it has nothing to do with legal justice.

    When you couple the marketing campaign of “trust me”…she’s “an evangelical”, therefore anti-choice along with the real strangeness of that church she lives for and her irrational worship of George W Bush,

    The Methodist Church

    The Methodist Conference 1976 declared that abortion is always an evil. However single mothers should always be supported and encouraged to have their baby adopted if they choose not to keep it. The church recognises that there are cases where abortion is the lesser of two evils:
    in such cases as where the embryo (foetus) is severely handicapped
    the pregnancy is the result of rape
    or the health, either mental or physical, of the mother is at risk.

    While the church wishes no abortion were necessary, it stresses that necessary terminations must occur as early in the pregnancy as possible. They are opposed to making abortion illegal again, believing this would increase deaths in ‘botched back-street’ abortions. Never to allow an abortion could be to condemn some women and their babies to gross suffering or cruel death since nature itself makes the decision to abort damaged embryo in miscarriage.

    Counselling and Pastoral care should be extended to both the mother and father and the alternatives to termination be made clear.

However, in the same way that I now support President Bush, I supported Clinton in his role as commander in chief, and I supported his right to appoint Supreme Court justices of his choosing. Even though he never got as much as 50% of the popular vote, he won two elections, and that gave him the right to wield power, for better or worse.

    I may be something of a throwback to the Republicans of the 1940s, who opposed FDR’s social welfare legislation on ideological grounds, but who refused to take partisan shots that might impair the war effort (such as opposing the draft, or complaining about the cost). Try to identify any leading national Democrats today for whom love of country comes first in this way. You could count them on your toes. On this site you wouldn’t need any toes.

    As for ‘tolerance’. Tolerance means you accept the rights of others to have their beliefs, not for them to FORCE YOU into believing them.
