[This is the second part of a Think Progress series breaking down the significance of the Libby indictment.]
In at least three instances, it appears from the facts outlined in the indictments that Libby was aware that Valerie Plame was an undercover CIA agent.
1. Libby spoke to his Principal Deputy [John Hannah] about an article in The New Republic and discussed whether they could share information about the role of Wilson’s wife in sending him to Niger. “Libby responded that there would be complications at the CIA in disclosing that information publicly, and that he could not discuss the matter on a non-secure telephone line.†(see #14) [comment: Hannah appears to have flipped]
CORRECTION: TRN’s Ryan Lizza says the “Principal Deputy” is in fact Eric Edelman.
2. In a lunch with Ari Fleischer, Libby tells him that Wilson’s wife works at the CIA and “noted that such information was not widely known.â€
3. In a conversation with Judith Miller, Libby specifically asked that the information on Plame’s identity be attributed to a “former Hill staffer†rather than to a “‘senior administration official,’ as had been the understanding with respect to other information that Libby provided to Miller during this meeting.†(see #17)
UPDATE:
A reader points out a crucial piece of information from the indictment strongly indicates that Libby knew Plame worked undercover and then misrepresented that knowledge. The indictment says Cheney told Libby that Plame worked in the “Counterproliferation Division†(see #9), an agency in the CIA’s Directorate of Operations. But when Libby later talked to Miller, he told her, according to Miller’s notes, that “Wife works at WINPAC.†WINPAC is part of the CIA’s Directorate of Intelligence. Why is this significant?
The Directorate of Operations works undercover. As the CIA website states:
The Directorate of Operations is responsible for the clandestine collection of foreign intelligence. The current director is under cover and cannot be named at the present time.
So Libby learned from Cheney that Plame worked undercover but then told Judith Miller that Plame worked in the Directorate of Intelligence, which “is on the overt side of the CIA†and does not work undercover. It appears from this information that Libby intentionally misled Miller.

October 29th, 2005 at 8:08 pmIt is my gut feeling from watching Fitz’s news conference twice and reading the indictment in depth that the indictment of Libby was, as I posted earlier, just a sop for the Grand Jury. They now have a story to tell their Grandchildren. It would have been unkind to send them hame after two years with nothing in their stockings. There is absolutely no reason why Libby cannot be indicted again on other charges (e. g. Earle/Delay). I expect there will be a significant number of perjury, obstruction, and false statement indictments, probably as many as five or six indictments under one or both of the “outing” statutes, and one BIG conspiracy indictment with at least twenty names (WHIG et al), and at a minimum DUHbya named as an undicted co-conspirator. If Fitz cannot indict him directly he will provide sufficient evidence for the Wilson’s to file a civil suit against the whole damn bunch, including DUHbya. The only logical reason for including the detail of Plame in the indictment is to justify the obstruction charge. The release of Plame’s name is a criminal act as specified by Fitz several times in his press conference. There would be a lot fewer guests in our public motels if all they had to do was say no crime was commited.
For a brief digression, the Repugs have a lot of thinking and planning to do. It is almost a given that the Dems will win control of both Houses in 2006. When that happens the first item of business will be to impeach Bush and Cheney, if he is still around, or his replacement. The Presidency would then go to the top Democrat in the Senate or House. This would assure a Dem victory in 2008. As I see it the only way the Repugs will have any chance in 2006 and 2008 is to impeach Bush and Cheney, and get McCain or some other honest (or reasonably so) Repug Senator in Frist’s position to take over the Presidency. Either way Bushco is gone! Merry Fitzmas!

The reason Fitz didn’t charge *anyone* at this point on those counts is so he can still catch more fish. If he *had* charged Libby with this, everyone else could just shut up and say “well, guess you got your guy” and it would impede further investigation for the truth.
By charging Libby with matters of perjury, obstruction, etc., he’s sent a strong message to those remaining under investigation and who could be questioned. He played a card to put more pressure on the rest of the investigation as well as keep options open. If he’d charged anyone, particularly Libby, with disclosing classified information, it would hinder any further truth finding. He’d have become the fall guy and everyone else could remain innocent and get away with it. Fitz was clearly saying that was not an option here.
Further, he laid down the groundwork for future options and charges in this very indictment. Much of the “detail” in the timeline laid out wasn’t really overly relevent to the charges, but are part of the overall investigation and will allow Fitz to “build” on what’s he’s already laid out! Will be very interesting to see what else develops, because Fitz made it clear that he’s not done with this yet. The heat is on and the worms in the WH are squirming with this added pressure now!
October 29th, 2005 at 8:59 pmLibby was found guilty of: Count One was for Obstruction of Justice, counts Two & Three were for Making False Statements and Counts Four & Five were for Perjury. What makes them interesting is that they were so blatant (please read the Libby indictment). He is clearly sacrificing himself for something far greater in scope than just the counts that he was indicted for as he was so unthinking and unrepentant in his lies and the Obstruction of Justice in particular, (14 of the 22 pages), that I would doubt that he will get any less than the maximum number of 30 years in a federal penitentiary not of his choice.
Rove talked to the Grand Jury four times at great length and had to provide additional information in an effort to appear as working with the Grand Jury. If this information does not pan out, I would imagine that he will be indicted as well.
The more sinister angle of what is going on that no one has looked at, and I am sure Fitzgerald would like to understand is, why would anyone effectively destroy of a CIA front company as important as the Boston based Brewster Jennings and Associates, which was engaged in tracking rogue nukes and other WMD throughout the world. Libby’s betrayal forced them to close up shop as well as any organizations and people associated down the line with that shop, in effect blinding the US to track rogue nukes and WMD et. al., in the world! This is a catastrophic blow to what is arguably one of the most important intelligence operations that the CIA had.
The media continues to be complicit in some for of coverup that is far greater than just the outing of a CIA agent. Now, information regarding “rogue” purchases of nuclear fuel, chemical and biological weapons as well as rocket technology is hearsay, meaning Bush & company can say “trust us, we know” and can say the information came from a legitimate source from almost any country. Our democratic form of government, which is already shaky at best, will be gone if this case cannot expose this as a threat, not only to the US but the world. The combination of the abuse of the National Security Act of 1947 in creating the NSA, CIA and close connections with the military, would allow their power to be held solely by the President and his administration, leaving no viable checks and balances in our government.

Another issue that may be overlooked here is that Libby could very well be pardoned by Bush therefore making the party over before it really begins.
Fitzgerald had good advice when he said we all need ‘to take a deep breath…this is just the beginning’. Hopefully the perpetrators will all be brought to justice.
In the mean time, it might be a good idea to start calling our Congressmen/women and begin demanding impeachment proceedings.

In his January 2003 State Of The Union, President Bush made his case for war in Iraq. He included this now-infamous 16-word deception about Iraq’s nuclear capability: “The British government has learned that Saddam Hussein recently sought significant quantities of uranium from Africa.”2
But the White House had known for nearly a year that this claim was false. In February 2002, the CIA sent former Ambassador Joseph Wilson to Niger to investigate the unsubstantiated claim that Saddam Hussein tried to buy uranium from Niger for use in nuclear weapons.3
Wilson had discovered that the claims were bogus and documents used to support the claims had been forgeries. He reported this to the CIA, and the CIA told the White House.3
Why Did The President Ignore Wilson’s Findings And Lie? It’s About Iraq
Why did President Bush use the discredited nuclear claims in his January 2003 State of the Union Address to make the case that Iraq was a nuclear threat? They wanted to invade Iraq.
A CBS News polling report in late 2002 made clear, “there is no consensus on adopting a pre-emptive strike policy in general—except where a nuclear attack against the United States is contemplated…”4
Only well after the war had begun would the Washington Post report on “a pattern in which President Bush, Vice President Cheney and their subordinates…made allegations depicting Iraq’s nuclear weapons program as more active, more certain and more imminent in its threat than the data they had would support. On occasion administration advocates withheld evidence that did not conform to their views.”5
Wilson Strikes Back—Exposes Bush’s Lie In Lead-Up To War
Six months after the President’s 2003 State of the Union Address, as Bush’s WMD and nuclear claims began to unravel, Wilson went public and exposed the Bush Administration’s false nuclear claims in a New York Times op-ed.6

The White House saw Wilson as a major threat. According to the Los Angeles Times, “Vice President Dick Cheney’s chief of staff was so angry about the public statements of former Ambassador Joseph C. Wilson IV, a Bush administration critic married to an undercover CIA officer, that he monitored all of Wilson’s television appearances and urged the White House to mount an aggressive public campaign against him, former aides say.”7
White House Retaliates—Outs Valerie Plame Wilson As CIA Agent
The week after Wilson’s op-ed in the New York Times, “two senior administration officials” were cited by conservative columnist Robert Novak in his column outing CIA agent Valerie Plame Wilson.8
The White House Iraq Group (WHIG), originally formed to sell the war to the public, “morphed into a virtual hit squad that took aim at critics who questioned its claims.”9 WHIG was run out of Vice President Cheney’s office, and included Cheney’s Chief of Staff “Scooter” Libby, top Bush strategist Karl Rove, and other top Bush administration officials.
Not only did this leak end Valerie Plame Wilson’s 20-year career as a CIA covert agent, but it also exposed a longstanding CIA front company, Brewster Jennings & Associates, where Plame worked and put at risk many of the undercover agents who had worked with Wilson in the past.10
Today’s Indictment—White House Official Obstructed Investigation Into The Lie
Today’s indictment says Libby illegally obstructed the investigation into the White House outing of an undercover CIA agent, Valerie Plame Wilson. He also was charged with perjury and making false statements to FBI agents. The ongoing investigation of Karl Rove revolves around the same issues, among possible others.

The British stand by that assessment today. In any case, being the recipient of incorrect intel does not make one a liar. Given that all intel is imperfect, the prudent course was not to give your friend Saddam Hussein the benefit of the doubt.

Wilson went to Niger in February 2002. The forged documents were received in October 2002. The documents had nothing to do with Wilson or his trip to Niger. Wilson never saw the documents. Thank you for providing this proof that Wilson lied.
In February 2002 the former prime minister of Niger, Ibrahim Mayaki, told Wilson, “An Iraqi delegation had visited Niger in 1999 to explore “expanding commercial relations” between Iraq and Niger. Mayaki had met with the Iraqis and later concluded that their request for enhanced trade meant they wanted to discuss purchasing uranium.”

32 Bush Lies And Policy Failures

President Bush’s campaign mantra in the 2000 election was that he and the Republican Party would “restore honor and integrity to the White House.” Five and one half years later, it’s utterly mind-boggling the amount of lies, controversies and scandals that have been perpetrated by Bush and his closest aides. It’s even more unsettling when we realize the dire straits America is in today at the hands of this incompetent, dangerous administration.
Let’s review Bush’s impact since 2000 at home and abroad, in no particular order:
1. Lied about WMD.
2. Unilaterally invaded a sovereign nation without provocation and justification.
3. Lied during State of the Union speech re: Niger Uranium.
4. Responsible for pre-9/11 intelligence failures in White House, CIA, FBI.
5. Allowed 9-11 murderers to remain free while diverting precious military and financial resources to his vanity war in Iraq.
6. Lied about Saddam/bin Laden connection.
7. Turned Iraq into a terrorist breeding ground.
8. Lied about nation-building.
9. Opposed creation of 9-11 Commission and Homeland Security Department.
10. Disrespected and alienated the U.S. from French, German and other key allies.
11. Lied to Americans about the real cost of war.
12. Fostered an environment of torture at Abu Ghraib and Guantanamo.
13. Lined Halliburton’s pockets in Afghanistan and Iraq with fat no-bid contracts.
14. Under-manned and under-equipped our armed forces in Iraq, resulting in unnecessary death and injuries.
15. Ignored the nuclear build-up in both Iran and N.Korea; marginalized Kim Jong Il.
16. Shunned Kyoto Treaty.
17. Lied about effects of man-made pollutants on the environment to support corporate pals.
18. Lied about the insolvency of Social Security.
19. Gave huge cuts to the wealthiest taxpayers.
20. Lied about true cost of health care bill.
21. Lied about Free Trade stand.
22. Bitterly divided the nation along religious, party and sexual preference lines.
23. Guilty of numerous cronyism appointments (Homeland Security, Supreme Court, etc)
24. Rewarded failures of Condi Rice and other cronies with key promotions.
25. Dreadful energy policies lead to record gas and oil prices.
26. Responsible for the largest debt in U.S. history.
27. Colossal failure of preparedness, rescue and relief during Hurricane Katrina.
28. Fostered a culture of corruption among GOP and top leadership (Tom Delay, etc).
29. Allowed Donald Rumsfeld to keep job despite utter failure in Iraq.
30. Presided over the U.S.’s lowest popularity throughout the world.
31. Saw No Child Left Behind fail.
32. Lied last week about Iraqi troop strength during Saturday radio address. Directly contradicted by testimony given earlier in the week by Gen. Abizaid.
This is just a partial list, mind you. One can only imagine what our country will look like by the time he’s done. Somebody please wake me up in 3 years. –posted September 8, 2005

He said, “Valerie had nothing to do with the matter” of his trip to Niger, but the SIC concluded that Plame did suggest his name for the trip after all. He also said the “names and dates were wrong” on the Niger reports, then later admitted he never even saw the reports until after he got back from Niger. On this, said he was confused and must have misspoken to reporters.
Wilson concluded on his trip that Iraq did not purchase any uranium from Niger. But he also concluded that Iraq had approached Nigerian officials about “expanding commercial relations.” Since 3/4 of Niger’s exports are uranium, this was viewed by the CIA as an attempt to buy uranium, and supports British intelligence at the time, referred to in Bush’s infamous 2003 State of the Union Address.
“The British government has learned that Iraq recently sought significant quantities of uranium from Africa.”
This is exactly what Wilson discovered too, although he apparently didn’t realize it at the time. He assumed the whole thing was a closed deal, but it wasn’t. The fact that Iraq did not get any uranium isn’t the issue. I think it’s reasonable to assume that they tried.
What’s interesting for me is that the White House later retracted those “16 words,” but to my knowledge they have not retracted the assertions on centrifuge tubes that weren’t fit for uranium enrichment, unmanned arial vehicles that had 0.0005% of the capability that we were told they had, mobile weapons laboratories that weren’t really weapons laboratories, and the biggest freaking lie of all: “we do not torture.”
