Out of Excuses for Alito, Hume Makes Some Up

humeLast night, Fox News anchor Brit Hume argued Supreme Court nominee Samuel Alito wasn’t expressing his “personal views” when he wrote in a 1985 letter that “the Constitution does not protect a right to an abortion.” Here’s an excerpt:

HUME: But these were not personal views he was discussing, in all fairness, though were they?

KONDRACKE: (crosstalk)…politically his own.

HUME: No, he has said these were the legal arguments that he made as a lawyer in the Reagan Justice Department. He was in the solicitor general’s office and had played a role in making these judicial arguments to the Supreme Court. And he was arguing against Roe versus Wade. [Fox News Network, 11/14/05]

Alito himself wrote in the aforementioned letter, “I personally believe very strongly” in this legal position on privacy rights.

Hume must have Alito confused with Chief Justice Roberts, who argued during his confirmation hearings that “his early writings simply mirrored the policies of two Republican presidents for whom he worked.” As the New York Times reported, “Unlike memorandums from Chief Justice John G. Roberts Jr.’s work for the Reagan administration released during his confirmation, Judge Alito’s application describes only his personal views, not those of his employer.”

Hume should at least have the decency to update his own spin.

The arrogance that emits off this pile of crap doesn't even attract flies...Brit always talks like he is the final authority, regardless if he is making racial slurs or putting words into the mouth of his favorite neocon

  2. abissus Says:

I think what is more telling here is that Fox and Hume are trying to hide this view of Alito instead of shout it out. Isn't this what they wanted? A judge who would overturn Roe v. Wade. And why hide this fact unless, gasp, the majority of American people don't Roe v. Wade overturned.

So lets hide the truth to improve his chances of getting through because we at Fox don't care what the average, common American wants. We want what's good for our base that represents a small and extreme part of the population.

That's what they do on the right. They know their agenda, if discussed openly and honestly has no chance. So they must spin and hide.

  3. Matt Singer Says:

This really is mind-boggling. Somehow legal opinions have become personal beliefs.

From this perspective, it's probably inappropriate for us to ask anything of any political leader since everything is private.

    "You can do it, Waterboy!"

  5. Ryan Neat Says:

Republicans always fabricate lies to support their suppositions. It doesn't matter if it's a religious, abortion, anti-minority, anti-women, anti-gay, or just anti-poor - they fabricate more whole cloth than the Gap! They're such propagandist immoral liars!

  6. kindness Says:

    "fair and balanced"....

Could you imagine what the blindfolded justice statue would look like if she were holding Faux's "fair and balanced"? It would look about as balanced as the Supreme Court if Scalioto is allowed a seat at the table.

    Vote no on Alioto.

You ever heard the saying "Keep your friends close, but your enemies closer."

  13. kindness Says:

yea, all we have to do is go over to MediaMatters to see what faux news is up to, they being on faux's enemies list and all.

I mean, we dont't get EVERYTHING from this site. That'd be real dull.

  14. Ryan Neat Says:

Half of the people who watch faux news do so for the express purposes of debunking it to rabid partisans.

Speaking of partisan hacks, for anyone with a strong stomach, NED's website link is here, Robert found it on the blogger site.

  20. Marie Says:

Holy Cow! We now have a face to put on the NED comments. I think I liked him better anonymously. He is an unemployed "cavorter" who reads Danielle Steele novels!! OMG! No wonder he is so twisted.

  21. Brit Hume Says:

Her ass or harass? What's the difference?!!

  22. Marie Says:

Back on topic, Fox News has been so discredited lately, with their defense of the indefensible, that these shows should be aired with a disclaimer crawl on the screen at all times:
"All characters are fictional. Nothing stated here is based on fact."

  23. The Fly-man Says:

Brit Hume is just like Phill Graham, they found out there is more attention on the other side of the fence. It still remains a mystery to me that no one from the the think tanks and the media, including AM radio has the cajones to run for political office. So just like Rich Lowry over at the National Refute and the other limp wristed whiney cheerleaders for the political right, Fox news just says what they want the ELECTED officials to do what they themselves can not. People have to be chosen not annointed. Fair and Balanced have nothing to do with a point of view which is PRACTICALY impossible, remember Steve, oh yeah the economy can grow at 7%, Forbes? Here is a question you can ask any conservative, Name one democracy in the history of this planet that is or has been the perfect example of what their utopian govt. is to them? Guess what it would have to be ours, why? because to achive anything along the lines of their ideal Conservative utopian system DEMOCRACY would have to occured anfd for the attainment of their lofty ambitions, from economic purity to socially conservative moral behavior these ideals have only been obtainable in dictatorships, like Singapore and Kuwait. Sure why not just sit back and say if only it could be like this and then just critisize everythign for lack of purity, it just doesn't work that way when you have a gifted electorate in a Republic and they know this is true. So please ask what ever it is that is on your mind of your ELECTED offficial but try just to ignore the talking heads who only have their own ratings and perpetuating their own exisitence as much as possible.

  24. Wayne A. Schneider Says:

It's fun sometimes to watch what Fox will put up on their "Fox News Alert" messages. There was the time the president was introducing Judge Roberts and described as, among other things, "a gentleman." So FNC put up a "Fox News Alert President: Roberts is a Gentleman". This warranted an ALERT!?!?

The best Fox News Channel crawl I saw was on an episode of The Simpsons. The crawl was saying some really stupid, outlandsih things like, "Democrats cause cancer" and stuff like that. Fox got so pissed at "The Simpsons" producers that they threatened to sue them over it. And since they owned the show, they were threatening to sue themselves. Fox was concerned that viewers might have thought it was real. Shows you how little they think of their audience.

Bush raps China over freedom, vows to promote democracy in Asia

    By Ron Hutcheson

    Knight Ridder Newspapers

KYOTO, Japan - President Bush brought his freedom agenda to Asia on Wednesday, taking a swipe at China while extolling Japan as an example of freedom's power.

Setting the tone for a four-nation swing through the region, Bush told Asian leaders that freedom is on the march and cannot be stopped in their part of the world. He bluntly told Chinese leaders that economic freedom in China would inevitably break their hold on power.

At what point do we start calling lies "lies?" Why do we have to be nice by referring to lies as "spin?" If it was "Average Joe" journalist, I might give 'em the benefit of the doubt. But Hume is a consistent water boy for BushCo. Call his remark what it is: A LIE.

I can't believe NED would watch Fox, like Coulter, understand Rove AND be single! That's the Quadra-triumph of living in America! I've only got 3 out of 4, dammit!

  41. Giacomo (aka GeoMetro) Says:

For once, it seems I agree with you guys here. It's stupid to say that "he was echoing the administartions sentiments". If he is pro-life, then he should be pro-life. This dancing around the issue is stupid. Alito should say, "my opinions were applicable in my job then ... those opinions haven't changed ... I'm now in a job were my responsibility to the constitution supercedes my opinions" ... that's not a difficult concept (all judges, liberal or conservative must act in this manner)

The fact remains that he is qualified to serve in the supreme court, despite the fact that he may be pro-life. I thought the same thing about RBG when she was nominated as well. She was qualified and she was pro-choice. The fact that I don't like that she's pro-choice is irrelevant to her qualifications.

  47. Giacomo (aka GeoMetro) — Says:

    WAKE UP MISS AMERICA

1 ¶ And after these things I saw another angel come down from heaven, having great power; and the earth was lightened with his glory.
2 And he cried mightily with a strong voice, saying, Babylon the great is fallen, is fallen, and is become the habitation of devils, and the hold of every foul spirit, and a cage of every unclean and hateful bird.
3 For all nations have drunk of the wine of the wrath of her fornication, and the kings of the earth have committed fornication with her, and the merchants of the earth are waxed rich through the abundance of her delicacies.
4 And I heard another voice from heaven, saying, Come out of her, my people, that ye be not partakers of her sins, and that ye receive not of her plagues.
5 For her sins have reached unto heaven, and God hath remembered her iniquities.
6 Reward her even as she rewarded you, and double unto her double according to her works: in the cup which she hath filled fill to her double.
7 How much she hath glorified herself, and lived deliciously, so much torment and sorrow give her: for she saith in her heart, I sit a queen, and am no widow, and shall see no sorrow.
8 Therefore shall her plagues come in one day, death, and mourning, and famine; and she shall be utterly burned with fire: for strong is the Lord God who judgeth her.
9 ¶ And the kings of the earth, who have committed fornication and lived deliciously with her, shall bewail her, and lament for her, when they shall see the smoke of her burning,
10 Standing afar off for the fear of her torment, saying, Alas, alas, that great city Babylon, that mighty city! for in one hour is thy judgment come.
11 And the merchants of the earth shall weep and mourn over her; for no man buyeth their merchandise any more:
12 The merchandise of gold, and silver, and precious stones, and of pearls, and fine linen, and purple, and silk, and scarlet, and all thyine wood, and all manner vessels of ivory, and all manner vessels of most precious wood, and of brass, and iron, and marble,
13 And cinnamon, and odours, and ointments, and frankincense, and wine, and oil, and fine flour, and wheat, and beasts, and sheep, and horses, and chariots, and slaves, and souls of men.
14 And the fruits that thy soul lusted after are departed from thee, and all things which were dainty and goodly are departed from thee, and thou shalt find them no more at all.
15 The merchants of these things, which were made rich by her, shall stand afar off for the fear of her torment, weeping and wailing,
16 And saying, Alas, alas, that great city, that was clothed in fine linen, and purple, and scarlet, and decked with gold, and precious stones, and pearls!
17 For in one hour so great riches is come to nought. And every shipmaster, and all the company in ships, and sailors, and as many as trade by sea, stood afar off,
18 And cried when they saw the smoke of her burning, saying, What city is like unto this great city!
19 And they cast dust on their heads, and cried, weeping and wailing, saying, Alas, alas, that great city, wherein were made rich all that had ships in the sea by reason of her costliness! for in one hour is she made desolate.
20 Rejoice over her, thou heaven, and ye holy apostles and prophets; for God hath avenged you on her.
21 And a mighty angel took up a stone like a great millstone, and cast it into the sea, saying, Thus with violence shall that great city Babylon be thrown down, and shall be found no more at all.
    22 And the voice of harpers, and musicians, and of pipers, and trumpeters, shall be heard no more at all in thee; and no craftsman, of whatsoever craft he be, shall be found any more in thee; and the sound of a millstone shall be heard no more at all in thee;
23 And the light of a candle shall shine no more at all in thee; and the voice of the bridegroom and of the bride shall be heard no more at all in thee: for thy merchants were the great men of the earth; for by thy sorceries were all nations deceived.
24 And in her was found the blood of prophets, and of saints, and of all that were slain upon the earth.

At one time I would get quite angry with Fox News for their constant propagandizing. After reading Robert Middlekauffe's account of the American Revolution, I now understand how public opinion and policy is constantly being shaped, propagandized, stretched, and finally forged into actual events that often don't make sense or that create violence and bad decision making by officials. The thing to keep track of are the vast number of different groups all vieing for power and appreciate the strategies of the winners. Lying and cheating are the norm.
