Phase II Report Being Stonewalled, Senators Charge»

Yesterday was the deadline for the Senate Select Committee on Intelligence to report its progress on Phase II of the investigation into the administration’s use of pre-war intelligence. The prognosis is not good, according to Senators Rockefeller, Levin and Feinstein. They have released a letter, and here is its main finding:

At this time, we are unable to provide an estimated completion date of the Phase II investigation given the substantial amount of work that remains to be done.

This assessment differs greatly from the one offered by Sen. Pat Roberts on November 1st: “It isn’t like it’s been delayed. As a matter of fact, it’s been ongoing. As a matter of fact, we have been doing our work on Phase 2.” In reality, as the letter makes clear at various points, the work of the committee has been stonewalled by an unwillingness on the part of conservatives to investigate the administration. The Senators report that the investigation has been unable to proceed due to the following issues:

(1) Chairman Roberts is unwilling to investigate the “Cabal” inside the Pentagon’s Office of Special Plans because he is deferring to the administration to investigate itself.

(2) Roberts has been unwilling to allow for “additional interviews and documents” to conduct a thorough inquiry.

Also, it is important to note that while Bush continues to falsely claim that the Senate Intelligence Committee found the administration had not “manipulated the intelligence and misled the American people about why we went to war,” the Intel Committee Senators say just the opposite:

The Committee staff work on two other sections of the investigation is not finished: whether public statements were substantiated by intelligence information and the use of intelligence information provided by the Iraqi National Congress.

    Senator Reid needs to do an end-run around Senator Roberts’ attempt to stall the Phase II investigations. If left to Senate conventional rules, Roberts will quietely sink Phase II in a welter of confusing misdirections, until way past 2006.

    So, how do it?

    Step 1: Announce publicly the first Top 10 Questions that need answering.

    Step 2: Focus on each of the Top 10 Questions in a daily remarks session.

    Step 3: Run in a public place the clock (like the one on Senator Kennedy’s website) which shows the time elapsed since the promise to start Phase II. Refer each day to the time elapsed in each Senate speech.

    Step 3: Revise the Top10Q each day.

    Step 4: State possible answers to each of the Top 10 Questions: Either this or that. Which one is it? We do not know because Senator Roberts is blocking us from finding out. Given that, the American people are entitled to assume the worst answer, which is ….

    Step 4: Each day, introduce a Top 10 Question, then segue into a Rule 21 session. In the Rule 21 session, table some classified information known to Democrats which justify the calling of the secret session, and which deals with the Top 10 Question raised.

    Step 5: Start an independent investigation, and have Democratic senators attend it, so as to give it credibility.

    Step 6: Caution the majority party in the Senate that, if there is no discernible progress in Phase II (including bi-weekly announcements of ground covered, plus the Tope 10 Questions being reviewed, plus what is holding up answers to those questions, including naming those blocking progress, then Rule 21 sessions will begin each day, starting on December 7, 2005 ….

    Why will this work? Using the Top 10 Questions plus the background material currently available on each question, will put intense focus on the essence of Phase II, rather than just on the concept of an investigation. Get the details in front of the public, show what is being hidden, then show who is hiding it, then show how it is being hidden.

    Probability of success? Over 70%.

    Sen. Graham’s amendment negates Sen. McCain’s amendment. Look at the chronology.

    1) Sen. McCain’s anti-torture amendment is proposed and passes overwhelmingly.
    2) Bush claims “we do not torture.”
    3) Cheney before the McCain amendment passes tries to get the CIA an exemption from torture restrictions.
    4) Sen. Graham proposes denying habeas corpus to detainees in U.S. custody, essentially denying from any U.S. court of law any testimony revealing that detainees might have been tortured while in U.S. custody.

    Side-note: International Red Cross denied access to U.S. detainees, especially those held in secret CIA “black sites” overseas.

    My God, the Bush adminstration will do anything they can to defend their torture policy. And I just wonder if Sen. McCain was part of this bait-and-switch campaign? In other words, having an anti-torture amendment on the books is well and good, unless of course there is no oversight to assure that no torture is actually occurring…which is what the Graham amendment was all about regarding the denial of habeas corpus to detainees.

    So, I agree with the first poster above. I believe the holdovers from the Nixon administration who are currently in the Bush administration decided that they would try to resurrect the image of Nixon from the trash-heap of history…by making the current Bush administration into the most corrupt and evil Republican Party administration ever in American history.
