The Axis of Impunity
One of the positive steps in international law in recent years has been the establishment of the International Criminal Court, a permanant standing court to try cases of genocide, war crimes, and crimes against humanity. Unfortunately, since its inception, the court has been virulently opposed by the United States, which fears that its soldiers (and more importantly, its political leaders) might be held accountable for any atrocities they commit or order to be committed (such as, say, the razing of Fallujah, the use of indiscriminate weapons in civilian areas, or a policy of torture approved at the highest levels). The chief mechanism used by the US to undermine the court has been a series of “Article 98 agreements” – bilateral agreements exploiting a loophole in the ICC’s statute to exempt American citizens from the court’s jurisdiction. The US has used strong-arm tactics to extract these agreements from weaker nations, including the passage of the American Servicemembers’ Protection Act (AKA the “Invasion of the Hague Act”), which requires the US government to cut off military aid to countries which refuse to sign such an agreement. So far, payments have been withheld from 35 countries (mostly in Eastern Europe and South America) in an effort to get them to toe the American line.
So, who has signed these agreements? Below is a map of 96 of the reported hundred countries who have signed an impunity agreement with the US. The primary source is a list [DOC] compiled by Citizens for Global Solutions:
This is the axis of impunity. And its remarkable how well it tracks both poverty (meaning exposure to American economic threats) and shitty human rights records. What’s also remarkable is that the US has been signing reciprocal agreements with the shittiest of the shitty, in effect promising to protect their rulers from international justice. One of those agreements is with Rwanda; if it and the ICC had been in place when the Rwandan genocide occurred, the US would today be providing a safe haven for genocidaires.

Prof. Manfred Nowak was elected to the Commission in May 1995.

Since 1996, he has served as Judge at the Human Rights Chamber for Bosnia and Herzegovina in Sarajevo and, since 2000, as Chairperson of the European Master Programme on Human Rights and Democratization (EMA) in Venice. From 1987 to 1989, he was Director of the Netherlands Institute of Human Rights (SIM) at the University of Utrecht, and from 2002 to 2003 Olof Palme Visiting Professor at the Raoul Wallenberg Institute of Human Rights and Humanitarian Law (RWI) at the University of Lund.
Prof. Nowak was a member of the Austrian delegation to the UN Commission on Human Rights for many years, before he was appointed in 1993 as expert member of the UN Working Group on Enforced and Involuntary Disappearances. During this term he also served as UN expert on missing persons in the former Yugoslavia, and after his resignation in 2001 he was appointed UN expert on legal issues relating to the drafting of a binding instrument on enforced disappearances. He also advises the UN High Commissioner for Human Rights on poverty reduction strategies.
Prof. Nowak is a board member of various international and Austrian NGOs and was appointed in 2000 chairperson of a Human Rights Commission at the Austrian Ministry of Interior with the task of monitoring the police. In 1994, he was awarded a UNESCO prize for the teaching of human rights. He has published more than 350 books and articles in the fields of human rights, public law and politics.
Prof. Nowak holds an LLM from Columbia University in New York and a PhD from Vienna University.

China’s parliament passed a bill earlier this year mandating punishment for police who torture detainees during interrogation.
In April, it freed a man who spent 11 years in jail for allegedly murdering his wife after the woman turned up alive. The man, She Xianglin, said he had confessed the crime under torture.

There is something very twisted about this narrow, black and white view of the world; and with a friend in Bolton, they are gleeful in their expanded powers. Their focus on one issue when there are so many more pressing matters (hunger, war, disease, genocide) is a source of wonder to me. I believe they know that is a battle they cannot win, but they want the battle to continue because it keeps their followers fired up. That many of these religious leaders are sexual predators or perverts doesn’t seem to affect their standing among the religious lunatics.

We are writing on behalf of the Democratic National Committee to demand that Lamar honor a contract its Huntington, West Virginia office entered with the DNC for placement of two billboard advertisements in Portsmouth, Ohio. These advertisements accurately referred to a statement made by U.S. Rep. Jean Schmidt (R-Ohio) on the floor of the U.S. House of Representatives attacking a respected Member of Congress and decorated war veteran. The advertisements were aimed at informing her constituents about this statement, and called on Rep. Schmidt to cease such attacks.
The DNC was told by your Huntington regional manager that Lamar is refusing to honor the contract because the advertisements are “too negative.” In addition to refusing to honor the contract for the Portsmouth billboards, Lamar, through its Cincinnati office, refused to accept the same advertisement for placement on billboards in Cincinnati.
While Lamar’s form contract reserves to the company the right to refuse to run a billboard advertisement, Lamar’s conduct in this instance raises serious questions about whether the company is unlawfully or improperly using corporate resources to favor or benefit the Republican Party or Rep. Schmidt. Your regional manager was unable to cite any company policy providing any objective standards or criteria for rejecting political or advocacy advertising.
Rep. Schmidt’s constituents are entitled to know what she is saying on the floor of the U.S. House and the DNC has a right to tell them. Lamar should either offer a credible reason for its efforts to censor the Democratic Party or else should live up to its contractual obligation and let the DNC put up its billboard and let the people of Rep. Schmidt’s district hear the truth.
Please let us know immediately whether Lamar intends to honor its contract–and if not, why. Fairness and the public interest demand no less.

Dobson and his ilk are focused on one issue — anti-abortion. This as Bush denies aid to countries who offer birth control to their populations. @There is something very twisted about this narrow, black and white view of the world; and with a friend in Bolton, they are gleeful in their expanded powers. Their focus on one issue when there are so many more pressing matters (hunger, war, disease, genocide) is a source of wonder to me. 2)I believe they know that is a battle they cannot win, but they want the battle to continue because it keeps their followers fired up. That many of these religious leaders are sexual predators or perverts doesn’t seem to affect their standing among the religious lunatics.

The Axis of Impunity
One of the positive steps in international law in recent years has been the establishment of the International Criminal Court, a permanant standing court to try cases of genocide, war crimes, and crimes against humanity. Unfortunately, since its inception, the court has been virulently opposed by the United States, which fears that its soldiers (and more importantly, its political leaders) might be held accountable for any atrocities they commit or order to be committed (such as, say, the razing of Fallujah, the use of indiscriminate weapons in civilian areas, or a policy of torture approved at the highest levels). The chief mechanism used by the US to undermine the court has been a series of “Article 98 agreements” – bilateral agreements exploiting a loophole in the ICC’s statute to exempt American citizens from the court’s jurisdiction. The US has used strong-arm tactics to extract these agreements from weaker nations, including the passage of the American Servicemembers’ Protection Act (AKA the “Invasion of the Hague Act”), which requires the US government to cut off military aid to countries which refuse to sign such an agreement. So far, payments have been withheld from 35 countries (mostly in Eastern Europe and South America) in an effort to get them to toe the American line.
So, who has signed these agreements? Below is a map of 96 of the reported hundred countries who have signed an impunity agreement with the US. The primary source is a list [DOC] compiled by Citizens for Global Solutions:

This is the axis of impunity. And its remarkable how well it tracks both poverty (meaning exposure to American economic threats) and shitty human rights records. What’s also remarkable is that the US has been signing reciprocal agreements with the shittiest of the shitty, in effect promising to protect their rulers from international justice. One of those agreements is with Rwanda; if it and the ICC had been in place when the Rwandan genocide occurred, the US would today be providing a safe haven for genocidaires.

He is Professor of Constitutional Law and Human Rights at the University of Vienna and Director of the Ludwig Boltzmann Institute of Human Rights (BIM). Since 1996, he has served as Judge at the Human Rights Chamber for Bosnia and Herzegovina in Sarajevo and, since 2000, as Chairperson of the European Master Programme on Human Rights and Democratization (EMA) in Venice. We are writing on behalf of the Democratic National Committee to demand that Lamar honor a contract its Huntington, West Virginia office entered with the DNC for placement of two billboard advertisements in Portsmouth, Ohio. These advertisements accurately referred to a statement made by U.S. Rep. Jean Schmidt (R-Ohio) on the floor of the U.S. House of Representatives attacking a respected Member of Congress and decorated war veteran. The advertisements were aimed at informing her constituents about this statement, and called on Rep. Schmidt to cease such attacks.
The DNC was told by your Huntington regional manager that Lamar is refusing to honor the contract because the advertisements are “too negative.” In addition to refusing to honor the contract for the Portsmouth billboards, Lamar, through its Cincinnati office, refused to accept the same advertisement for placement on billboards in Cincinnati.
While Lamar’s form contract reserves to the company the right to refuse to run a billboard advertisement, Lamar’s conduct in this instance raises serious questions about whether the company is unlawfully or improperly using corporate resources to favor or benefit the Republican Party or Rep. Schmidt. Your regional manager was unable to cite any company policy providing any objective standards or criteria for rejecting political or advocacy advertising.
Rep. Schmidt’s constituents are entitled to know what she is saying on the floor of the U.S. House and the DNC has a right to tell them. Lamar should either offer a credible reason for its efforts to censor the Democratic Party or else should live up to its contractual obligation and let the DNC put up its billboard and let the people of Rep. Schmidt’s district hear the truth.
Please let us know immediately whether Lamar intends to honor its contract–and if not, why. Fairness and the public interest demand no less.
