Most of you people commenting on this issue have failed to read the Gorelick testimony. An excerpt: "Pre-FISA case law relating to electronic surveillance in the Fifth, Ninth, Third, and Fourth Circuits have confirmed this view. Additionally, when the Supreme Court determined that warrant requirements applied to electronic surveillance for domestic intelligence purposes in the Keith case, it specifically declined to apply this holding to foreign powers or their agents.

There are fewer cases dealing with physical, as distinguished from electronic, searches, but it is important to recognize that, for Fourth Amendment analysis purposes, courts have made no distinction between electronic surveillances and physical searches."

Bottom line, Gorelick, for Clinton, interpreted the "law" to be that warrantless electronic surveillances of foreign powers or their agents (like Al Queda, even in the US)is acceptable.

Read the whole testimony. Looks like Drudge did.

U.S. officials have indicated that the NSA program did target two men who later pleaded guilty to unrelated terrorist charges. One was Pakistan-born Iyman Faris, a truck driver who lived in Ohio and confessed soon after his arrest in 2003 to supporting terrorists. Authorities claim he was plotting to destroy the Brooklyn Bridge.

OK, HERE IS A LITTLE HINT.

the Constitution vests in the President inherent authority to conduct warrantless intelligence surveillance (electronic or otherwise) of foreign powers or their agents, and Congress cannot by statute extinguish that constitutional authority.

this was the forighn intel courts ruling on this issue. hmmm. appears clear.

i agree with you david p... its like all the left wants to do is give terrorists more and more rights. does anyone think we would have won the world wars if the military had to run to a judge to intercept forighn transmissions? everyone wants to end this war asap, but the more stumbling blocks put out there the longer and harder it will be. at the same time more soldiers will die. the term "domestic wire tapping" in itself is misleading. that term was made up by the liberal press. an accurate term would be "forighn intelligence gathering at a time of war". this isn't aimed at getting neighborhood drug dealers, its aimed at terrorists and their constituance. WHY would anyone let their hate for fellow Americans just because of political affiliation clowed these facts. not one documented fact of this foreighn intel being abused. not one! but if you were to investigate, youd find that terrorists and their plots have been stopped because of it. did you hear that? American lives were saved!!!! how much more clearer can that be? GOD BLESS AMERICA!!!!!

The last I heard, congress can pass no law to change the constitutional authority of the President. The constitution gives the President authority as Commander in Chief. The president has always had the ability to order warrantless searches of foreign intelligence. This is not even in dispute. If this program (as the President says it is) covers conversations that are partially overseas, then that can be seen as foreign intelligence. In addition, in times of war, the President has additional powers and responsibilities.

One of the most famous examples of warrant less searches in recent years was the investigation of CIA official Aldrich H. Ames, who ultimately pleaded guilty to spying for the former Soviet Union. That case was largely built upon secret searches of Ames’ home and office in 1993, conducted without federal warrants.

In 1994, President Clinton expanded the use of warrantless searches to entirely domestic situations with no foreign intelligence value whatsoever. In a radio address promoting a crime-fighting bill, Mr. Clinton discussed a new policy to conduct warrant less searches in highly violent public housing projects.

Previous administrations also asserted the authority of the president to conduct searches in the interest of national security.

In 1978, for instance, Attorney General Griffin B. Bell testified before a federal judge about warrantless searches he and President Carter had authorized against two men suspected of spying on behalf of the Vietnam government.

It is foolish to play politics at a time of war. I know of over 3000 Americans who had their civil rights permanently revoked on 9/11.

I want you all to answer one question for me. Why do you hate President Buss more than you love our country?

This is the most rediculous thing I have read in years. Everything said here is your opinion, just like I have mine. I've done my research and I know all I need to, he's good with me. I'm not going to take your word on what you say just like I know you wouldn't take my word for 'the truth'. If President Bush gets impeached it would be the worst thing I've ever seen. He is doing what he feels is right to protect you and I from terrorists. And who really cares if he hears about my date last friday, let them listen to the details, I hope they enjoy themselves. It seems to me that the only people who would be really upset by this are the people who DO have something to hide. This is all nothing but political B.S. I love the way this President gets ripped apart if you don't think he's doing enough. But when you find out that he was doing more than you thought and really trying to protect us you rip him apart for that. You people also want us to impeach him for lying to us about Iraq? He was acting on the intellingence he had and I commend him for that. And yes I'm a veteran: Five years in the Military Police(only deployable for three of those years-injury) deployed to Kosovo, Africa and Iraq, that's three deployments in three years, and I would still be in, serving my country and this President proudly if it wasn't for an injury. I say God bless him for trying to protect my family and friends, and Thank You!! At least we have a President that has a backbone which isn't real common among politicians. Instead of Impeach, I say "Re-elect!!!!!!!!!" God Bless You President Bush.

And one more thing, under the terms of use is says that we can't "post any messages or provide any links to any messages that endorse or oppose a particular political party or candidate for office." What the hell do you consider calling for the impeachment of the current President!?! The entire premise of this blog which you started goes against the first rule for what we're not supposed to post. Shouldn't you abide by your own rules? and if you're so concerned with our rights and freedom of speech why do want to limit what we can say so much?

This is the most rediculous thing I have read in years. Everything said here is your opinion, just like I have mine. I’ve done my research and I know all I need to, he’s good with me. I’m not going to take your word on what you say just like I know you wouldn’t take my word for ‘the truth’. If President Bush gets impeached it would be the worst thing I’ve ever seen. I love the way this President gets ripped apart if you don’t think he’s doing enough. But when you find out that he was doing more than you thought and really trying to protect us you rip him apart for that. You people also want us to impeach him for lying to us about Iraq? He was acting on the intellingence he had and I commend him for that. And yes I’m a veteran: Five years in the Military Police(only deployable for three of those years-injury) deployed to Kosovo, Africa and Iraq, that’s three deployments in three years, and I would still be in, serving my country and this President proudly if it wasn’t for an injury. I say God bless him for trying to protect my family and friends, and Thank You!! At least we have a President that has a backbone which isn’t real common among politicians. Instead of Impeach, I say “Re-elect!!!!!!!!!” God Bless You President Bush.

I was put on a terrorist watch list in 1996 for reasons unknown. I did not begin to feel the effects until 1998. By December of 2001, I had been fired innumerable times and denied employment with the government or any agency conducting background checks, and I had been denied the Ph.D. in English for the following reasons: "Women who demand the right to their own opinions end up in a place colder than Siberia," "You are overly-confident and too opinionated," "Rebels never get what they claim they want--a teaching position."
I was working at a bookstore in Dec. 2001 as a cashier. I was forced to run a register, forced to clean the bathrooms every night, and forced to mop the entire store every Sunday. I was given extra duties to perform at the register and forbidden to talk to other employees. I was forbidden to go near a computer or discuss books. All of my book orders were cancelled, and no one would tell me why. Every night my purse was searched as I left the store. No other shift was ever searched. I was frequently screamed at by two big fat ugly women: the general manager and the district manager. I was forced to attend 7 AM meetings even though I typically got off at 12 or 1 the night before and had a 45 minute drive home and back.
Three managers walked out the door never to be seen again, but they said nothing to me. The tension was unbearable and I suffered greatly, but my horrific, bourgeois mother was screaming at me constantly that I couldn't quit because she wasn't going to support me. I did finally quit without telling my mother. My next job was delivering pizzas and it was equally horrifying. My boss was in constant contact with the Sheriff's office.
Beginning in Dec. 2001, black helicopters would fly in from MacDill, buzz my house, turn around and fly back over on their return. Unmarked, white patrol cars were constantly staked out around my house. My neighbor's house was confiscated after he received a DUI, and strange men lived there in shifts. The locks on my doors were broken. My car battery and all replacement batteries were constantly dead. High altitude helicopters would hover over my house for hours.
Every administrator and manager I've had any contact with knows I am on a terrorist watch list, yet not one of them has said anything to me, not one, so my brutal, brainwashed mother doesn't believe it.
The U.S. government and all of its minions in education, health care, business, and whatnot are killers, fascistic killers. They had permission to torture me, so they did willingly. I wrote hundreds of letters yet received no helpful responses. Not one organization in this country would help me.
I have no idea why I was put on this list, but I know that the vast majority of Americans are dumb beyond belief and willing to torture anyone if they are assured the Patriot Act protects them. This country is worthless.
The Bush junta, which was illegally given the election in 2000 by the supremely corrupt court was behind 9-11. The 2004 election was rigged by Diebold and thousands of corrupt election officials. I wrote to dozens of newspapers in 2002 explaining the facts of my situation and what would happen to Bush and his murderous, illegal wars. Not one letter was ever published, and no one ever contacted me. I do not personally know one person who is not a brainwashed automaton. Despite computers in every home, people have just gotten dumber. It is so easy to read about WHO REALLY RUNS THE WORLD. It is no conspiracy. The media whores are all paid to never write one true thing or else be fired and hounded like me. No one in education has a functioning brain. They work for the elite and don't really mind as long as they are well paid. I am surprised I am still alive. I have been through sheer hell over and over again, with no one on my side. I have survived for no particular reason. I am a minimum wage employee. I have no time to plan a revolution. I don't really believe the planet is going to survive. Some say the poles are shifting. Some say the earth has ceased to wobble. Whatever the cause, I see the sky being covered every day with massive chemtrails. The fluoride in the water, the aspartame, the chemtrails--all of these things are causing people to become dumber, more forgetful, more lethargic. They are fat beyond belief and so incredibly dumb. The put microwave devices to their heads, They microwave their food. They drug themselves on behalf of the pharmaceutical companies, and they kill anything free, beautiful, and alive.

Presidents Clinton and Carter absolutely authorized warrantless searches. In Clinton's case he sold information for campaign contributions so his contributors could use the information against their political enemies. The Washington Times and American Thinker.com have comprehensive stories concerning such actions by Presidents Clinton (including his "Operation Echelon") and Carter. By the way, where are the Death Camps and Genocide in Bosnia that was the reason for sending us to war there???

(b) Activities described in sections 2-202 through 2-205 for which a warrant would be required if undertaken for law enforcement rather than intelligence purposes shall not be undertaken against a United States person without a judicial warrant, unless the President has authorized the type of activity involved and the Attorney General has both approved the particular activity and determined that there is probable cause to believe that the United States person is an agent of a foreign power.
