FACT CHECK: Only Conservatives Have Made Up Their Minds About Alito

Sen. John Cornyn (R-TX) yesterday complained that some senators on the Senate Judiciary Committee have already decided to vote against Alito:

I do think that there are those who have already decided to vote against your nomination and are looking for some reason to do so.

But not a single senator in the hearings has said he or she plans to vote against Alito.

Instead, Cornyn should look toward the four senators (including himself) who have already pledged support for Alito:

Sen. John Cornyn (R-TX):

Judge Alito, the reason why these groups are trying to defeat your nomination because you won’t support their liberal agenda is precisely why I support it.

Sen. Lindsey Graham (R-SC):

It’s possible you could talk me out of voting for you, but I doubt it. So I won’t even try to challenge you along those lines. I feel very comfortable with you being on the Supreme Court based on what I know.

Sen. Jon Kyl (R-AZ):

These are the standards for a Supreme Court justice, and you plainly meet these expectations. As a consequence, I view your nomination with a heavy presumption in favor of confirmation.

Sen. Sam Brownback (R-KS):

I will be supporting your nomination in front of the committee and on the floor. I think you’re an outstanding nominee, and I have appreciated your thoughts that you have put forward here.

Alito Will ‘Keep an Open Mind’ About Schumer

The judge declined an invitation to characterize the senator’s long history of hostile questioning to Republican nominees as “super-precedent” or “super-duper precedent.”

“Any sort of categorization like that with regard to Sen. Schumer reminds me of the size of the disposable diapers in the supermarket,” Judge Alito said.

Somebody should accuse him of being a marijuana user. It would be all over the the Supreme Court nominee. He would qualify for the position of Supreme Court Jester, not Justice.

Vote him in and forget about. Then get the US out of Iraq, it is the only thing of importance the US gov. should be doing.

Another example of how neocons have problems distinguishing reality from fantasy. It's almost as if they don't understand that the game has changed. Information is out there. Your previous statements can be googled and used against you. Maybe someone should send the RNC a memo informing them about "the internets".

It's no more surprising that the Donks can't find anything against Alito than it is they'd vote against him anyway, and some will of course. But what's really interesting is the sour grapes that are starting to form on some of the lower hanging branches of the Donk Berry Bush....Joe Biden...what a loser.

Supreme Court nominees are so mum about the major legal issues at their Senate confirmation hearings that the hearings serve little purpose and should probably be abandoned, Democratic Sen. Joe Biden said Thursday.

  7. Clyde the Ripper Says:

A question for the trolls--and the other unthinkers: Why would Alito claim a leadership role in CAP on his resume and deny any knowledge of the organization at the hearings?

In keeping with the old legal theory that one should never a question unless one knows the answer I will answer it for you. He is an opportunistic liar. I don't know, nor do I care, which is the true answer but since they are direct opposites one or the other or possibly both are untrue. Both cannot be true statements, hence, Alito is a liar. QED

To begin with there is not one person on the planet with a brain that would actually pay to listen to Howard Stern. Secondly, a man like Alito would never condescend to appear in the same room with a person of Stern's character and reputation. It's a fact, some people don't deserve the time of day.

Heard on the radio that Sen Brownback was observed sleeping throughout the questioning. Then, when it was his turn, he said, "Well, I've heard all I need to hear," and then announced that he was voting to confirm Alito, and yielded back the balance of his time. (Talk about not doing your job!) I guess he didn't need to hear anything because he slept through it all. He must have already made up his mind to vote for Alito. Why is this acceptable to Republicans, but anyone saying, "I have some doubts and some questions that I would like to hear the answers to before I make up my mind," is accused of already having decided to vote against him? Could it be that the Republicans know that the Democratics will not get the answers they seek?

If you support illegal actions, distortions and outright lies because of party loyalty, then that makes you a partisan hack. Try something different in 2006. Hold "the party of responsibility" responsible for their own actions instead of trying to use progressives as your scapegoat.

Here's a clue loser: If I support illegal actions, distortions and outright lies (and I do under the right circumstances) it's because some people don't deserve fair play, don't deserve the truth and should be shot in the back as soon as the opportunity presents itself. That's what you do to your enemies both foreign and domestic if you want to win. I'm not saying that any of that has happened in this case. I'm just saying....

I don't think twelve years is a part of any person's initial service in anything. But it would have been nice if Senator Kennedy remembered to call the authorities when his car INITIALLY went into the drink, or if he thought about saving his passenger INITIALLY along with himself; barring any of those possibilities - he might have called the police when he INITIALLY returned to his room. Hmmmmmm.......

  37. HAIRY THRUST Says:

According to Kelley, these congressional limits on the presidency, in turn, led "some very creative people" in the White House and the Department of Justice's Office of Legal Counsel (OLC) to fight back, in an attempt to foil or blunt these limits. In their view, these laws were legislative attempts to strip the president of his rightful powers. Prominent among those in the movement to preserve presidential power and champion the unitary executive doctrine were the founding members of the Federalist Society, nearly all of whom worked in the Nixon, Ford, and Reagan White Houses.

The unitary executive doctrine arises out of a theory called "departmentalism," or "coordinate construction." According to legal scholars Christopher Yoo, Steven Calabresi, and Anthony Colangelo, the coordinate construction approach "holds that all three branches of the federal government have the power and duty to interpret the Constitution." According to this theory, the president may (and indeed, must) interpret laws, equally as much as the courts.

HEY IRI are you telling me that BUSH,after how man signings? more than any president? Can interpret Law? as equally as the courts hes stuffed? isnt that like conflict of interest?

Your comments are so lame MA. Your attempts at wit fall far from the mark. How many times must you beat this same dead horse about Kennedy's accident? Does his accident somehow absolve all congressmsn of their duty to advise and consent on SCOTUS nominees? Face it MA, you're a partisan cheerleader that doesn't really care about what is best for the country as a whole. Continue giggling and thinking that you're "winning" something. Attacking Kennedy isn't going to change any of the inept decisions that have been made by this administration. Continue your demonization of dems and progressives while republicans rob the country blind and lay the foundation for an Imperial Presidency. Keep on concerning yourself with events that happened decades ago while ignoring all of the corruption and criminal behavior taking place right now under your nose. You are a perfect example of the type of conservative that Michael Scanlon (Tom Delay's former press secretary) spoke about:

"The whacko’s get their information through the Christian right, Christian radio, mail, the internet and telephone trees. ... Simply put, we want to bring out the whacko’s to vote against something and make sure the rest of the public lets the whole thing slip past them."

This is getting insane. Of COURSE the democrats have made up their mind about voting against Alito! You will be hard pressed to find a single democratic in the senate who will vote for him (but I should hold my tongue, there could be a few). Since when does what people claim mean anything in politics to all of you? You seriously think that beacuse Feinstein and Kennedy are SAYING that they haven't made up their minds really means that they haven't? They each have NEVER voted to elect a republican/conservative supreme court justice. NEVER. And they won't this time either. And it's a shem, because not only is Alito honest, but he's experienced and even-minded.

About the club Ted Kennedy was in...

    Drudgereport.com had this report:

Conservative activists aree eager to point out that Sen Ted Kennedy was on shaky ground accusing the Judge Alito of associating with people opposed to the inclusion of women in private institutions, the WASHINGTON TIMES is fronting on Thursday.

The eight-term senator belonged to an all-male social club -- the Owl -- at Harvard University. The Owl refused to admit women until it was forced to do so during the 1980s, according to records kept by the HARVARD CRIMSON, the student newspaper.

A Kennedy spokeswoman said it was an entirely different matter.

"No one can question Senator Kennedy's commitment to equality, justice and civil rights," said Laura Capps. "What he was part of was a social club, not a radical group pushing a radical agenda."

Anyway, she said, even though women were admitted to the university during Mr. Kennedy's tenure, they weren't fully integrated to the campus until much later.

    Satisfied?

  52. Bobbytoo Says:

sorry James...your sucker punch at Kennedy does not make the grade. I would imagine those whom you are addressing are not satisfied. Look, from what I have seen of this Alito guy he might make a good Judge. But it seems the Repubs are still shifting in the swirling sands of their incredible denial of what is wrong in this country. They alone have divided the US. Not Osama, Not the Iraqi Insurgency and Not Irans pursuit of bombs to blow us away. In my opinion John Snake eys Cornyn Lindsay Graham and the rest of the Republican Rightwing are FAR Greater Threats to America than anything facing this country. Satisfied?

Ha!
Clearly some Senators intended to vote for him and others against him before they even knew who "he" was. We can only hope that at least some Senators will make an effort to form a real decision of their own. Alito will be confirmed. The only question is how much squirming, whining and posturing various politicians do before that.

  55. Cyra Brown Says:

Why is it that Alito feels that he shouldn't comment on his PERSONAL beliefs about Roe v. Wade, saying that it wouldn't be right, because the issue could come before him on the S.C.? Hasn't he said that his personal feelings would not affect his rulings? So WTF???? He is obviously showing himself to be a liar, and saying exactly what his plans are re: R. v. W. Say Buh-Bye.

When convenient Catholic, (and aptly named) Dick Durbin, deemed it necessary to wear his heart on his sleeve, it was too funny having Alito quietly lecture the august Senator from Illinois that he was merely following the law PASSED BY CONGRESS (and might be changed by Congress) regarding search and seizures (in the oft touted outrage about 'strip searches' of 10 year olds.) As Alito noted, drug dealers MIGHT tend to hide their drugs on minors. Who knew??

Republicans hold the Presidency, the Senate, the House and a majority of the Governorships. Spare me the whiny garbage about "stolen" elections. If your side is so stupid it really allows elections to be stolen year after year and from coast to coast maybe you deserve it. Your advocation of violence makes it sound like shooting you down in the street would actually be self-defense. Perhaps you have forgotten who owns most of the guns? Yep, the very people you despise and threaten. Not very smart are you? Now I will await your no doubt brilliantly witty reply (chuckle).

Look what the cat dragged in.... another delusional, violent, raging neocon troll regurgitating the same old tired vitriol. Haven't you got something new? Something challenging for us? Look clone, we already get all the whackos who've just listened to the latest Rush and Hannity reicht-wing propaganda... can't you come up with something original? Yawnnnnnnn..... zzzzzzzzzzzzzzzz

Funny that you decided to post in an older forum that most people have left, rather than a current one where the activity lies.

  61. TheRef Says:

Uhm, just like you apparently. Actually I'm just more interested in Justice Alito than the un-ethical foibles of Congressmen. I didn't start the threats of violence. Just offered a gentle reminder to the delusional, violent, raging "progressive" troll that they should be a little more careful before slinging empty threats. Sorry to hear that you find the truth "tiring". As for something new and challenging that is rather amusing since you use troll, neocon, whackos and reicht-wing. What? Nothing original? What's "unbelievable" is that you take yourself so seriously. Ahh well, fish in a barrel!

    Uhm, just like you apparently.

Was concluding a conversation from earlier and wanted to see if that person had responded yet.

Actually I’m just more interested in Justice Alito than the un-ethical foibles of Congressmen. I didn’t start the threats of violence. Just offered a gentle reminder to the delusional, violent, raging “progressive” troll that they should be a little more careful before slinging empty threats.

Gentle? If you'd been gentle I'd not have responded.

This is a progressive blog, that makes us residents... and non-progressives the trolls (google it).

What empty threats? This is Freedom of Speech. I hear it's something the conservative blogs don't allow. In here we can say anything we want. The Constitution allows that. You should read it. It's really cool...

Sorry to hear that you find the truth “tiring”.

You weren't telling the truth. That's what I found tiring.

As for something new and challenging that is rather amusing since you use troll, neocon, whackos and reicht-wing. What? Nothing original?

I try with you guys, but it always goes over your heads... so it's just simplier (like your thought process) to use words you already know to get out point across.

What’s “unbelievable” is that you take yourself so seriously. Ahh well, fish in a barrel!

I forget that you guys have no creative bones in your chubby bodies... I'm an Atheist. I don't 'believe' (as in 'un')... plus I just got tired of typing the word in response to all of you trolls, so it's now permanently attached to the bottom of my posts...

Your moniker, however, requires no explanation... how lame...

Wake me if you have something to offer...

  63. TheRef Says:

Was concluding a conversation from earlier and wanted to see if that person had responded yet.
What a coincidence! So was I!

Gentle? If you’d been gentle I’d not have responded.

Of course you would. That's what makes this so much fun. You can't resist.

I try with you guys, but it always goes over your heads

That's because I have my feet on the ground and hot air rises.

I forget that you guys have no creative bones in your chubby bodies

As if you have even the slightest clue who I am. To flaunt your ignorant assumptions I will tell you that I am actually rather thin and have never been described as chubby. The jibe at your moniker was for my own personal amusement. I couldn't care less what it means to you just as I don't care what you think of mine, nor should you. Progressives exist for the amusement of the rest of us and I'm glad. The country would be less interesting if everyone were rational.
The fun now will be seeing if you respond. If you do it means you feel this silliness constitutes "something to offer" since you had to wake-up to respond.

So, still nothing intelligent to say... I thought not.

  65. TheRef Says:

I knew you couldn't resist! Just like Pavlov's dog! Too funny. Actually my comments about justified defense were intelligent and reasonable. So was my observation that you leaped to erroneous conclusions about me. The bit about a less interesting country was intelligent. The mini-sermon about progressives being a losing minority was intelligent though rather obvious. The bit about stolen elections was both intelligent and rather witty. The line about monikers wasn't particularly intelligent. Actually it was rather snide but quite truthful. As for waiting for your response, not terribly mature of me but I did have a lot of fun with it.
The closest comment of yours to intelligence was the "over your heads" although, as you see, it was too easy to parry. Now that I think about it, your moniker line wasn't too bad so I give you half-credit. Isn't this fun? An intelligent person (me) and a self-styled progressive (you) excercising our right to free speech. By the way, why didn't you respond to post #48 by Bobbytoo who introduced threats of violence and vigilantism into your peaceful, progressive blog (snicker). Could it be that you approve of violence threats by your side and only disapprove of others? Hypocrite! Your serve if you're awake...

  66. unbelievable Says:

    Comment by TheRef — January 14, 2006 @ 7:54 pm

Yes, you will just keep blathering if I type a few words in response... uh, yeah, clearly I'm the trained monkey here... Wanna buy a bridge in Brooklyn? Has a great view...

Your ball was out of bounds. Nothing to return.

  67. TheRef Says:

Didn't think you could offer any rebuttal. I accept your surrender. The "out of bounds" thing was your best effort yet though. Too bad you ran out of steam so quickly. Of course, you didn't really have any anyway. Where's the anser to my comment about post #48? Let me try a "liberal-progressive" response okay? Here goes...
You loser repugnican reich-winger liars lie everytime you open your stupid, childish, ignorant pie-holes! I hate you all and wish you were dead! You will be dead when we rule the world as we inevitably will! If you disagree with me you must be the most criminal animal on earth! You hate women! You hate anyone with a brain! You are zombies! Religious freaks! You aren't happy with a dictatorship, you demand a theocratic-dictatorship! You stole all elections we ever lost! You want to destroy everything we have accomplished since yesterday (just threw that in)! I'm running out of exclamation marks! Uhm, what am I yelling about? Oh yeah, you suck, your children suck and your dog sucks! Did I say you suck? Oops, your fat and that sucks!
How was that? Pretty accurate? No? Then try actually reading the multitude of posts on pretty much every thread here and you'll see I nailed it. Still wonder why you can't get any real people to take you seriously?

  68. TheRef Says:

Gotta give you credit for something. This thread is going to disappear soon so you were right that I should be posting my incredibly witty post #69 (bet you love the number eh?) on a thread nearer the top of the web site.

  69. unbelievable Says:

    Comment by TheRef — January 14, 2006 @ 8:43 pm

    Pathetic...

The only think you nailed is your blow up doll... and I think she's leaking air.

If you are 'real people', then I'm going to go hang out with some plastic mannequins. I'm sure they'll be more original and clever than you have thus far...

What do you want me to say? You haven't said anything worth responding to... and I'm bored now. Find me in another post of you come up with something. Otherwise, if I have to talk to trolls, I'd rather talk to IRI, he may be just as unstable as you, but at least he's got a sense of humor.
