With Attention Focused Elsewhere, Cheney Wages Stealth Defense of NSA Wiretapping
While the public attention has been very focused on his shooting accident, Vice President Cheney has been using the time to wage a vigorous, behind-the-scenes defense of Bush’s domestic surveillance program.
The AP reports Cheney has been playing “the role of point man in the National Security Agency’s warrantless wiretapping program in the war on terror.†And the Washington Post claims Cheney is winning the argument by lobbying conservative critics of the program:
[Senate Intelligence Committee members] attributed the shift to last week’s closed briefings given by top administration officials to the full House and Senate intelligence committees, and to private appeals to wavering GOP senators by officials, including Vice President Cheney. “It’s been a full-court press,” said a top Senate Republican aide…
It appears Cheney may be figuring out a way to placate critics in Congress. The Post explains what the compromise might be:
Senate intelligence committee member Mike DeWine (R-Ohio) said in an interview that he supports the NSA program and would oppose a congressional investigation. He said he is drafting legislation that would “specifically authorize this program” by excluding it from the 1978 Foreign Intelligence Surveillance Act.
DeWine’s solution completely overlooks the major problem with Bush’s illegal domestic spying program. The administration has argued that FISA doesn’t apply to its program, and DeWine simply wants to embed that viewpoint into law. By doing so, the DeWine legislation would grant authority to the administration to continue to conduct its program without any legal checks or safeguards on its powers.
DeWine should know better. His efforts to reform FISA were disingenuously rejected in 2002 by the Justice Department. The administration clearly has no problem misleading Congress about its program, and DeWine now wants to reward Cheney and other administration officials by giving them a legal blank check.

Since this is much more important than someone having sex in the White House, we should spend more on this than was spent investigating Pres. Clinton. That was about $70 million, right?
OK, so lets spend $140 million on the investigation of why the current administration felt they could violate the laws and the constitution as flagrantly as they did.
Anyone who questions this investigation will be denounced as aiding and abetting illegal activity and must be an un-patriotic fascist that hates America.
Since “Imitation is the sincerest form of flatteryâ€, I’m sure Pres. Bush will be flattered by this suggestion and support it fully.

Feb. 13, 2006 issue – Newly released court papers could put holes in the defense of Dick Cheney’s former chief of staff, I. Lewis (Scooter) Libby, in the Valerie Plame leak case. Lawyers for Libby, and White House allies, have repeatedly questioned whether Plame, the wife of White House critic Joe Wilson, really had covert status when she was outed to the media in July 2003. But special prosecutor Patrick Fitzgerald found that Plame had indeed done “covert work overseas” on counterproliferation matters in the past five years, and the CIA “was making specific efforts to conceal” her identity, according to newly released portions of a judge’s opinion. (A CIA spokesman at the time is quoted as saying Plame was “unlikely” to take further trips overseas, though.) Fitzgerald concluded he could not charge Libby for violating a 1982 law banning the outing of a covert CIA agent; apparently he lacked proof Libby was aware of her covert status when he talked about her three times with New York Times reporter Judith Miller. Fitzgerald did consider charging Libby with violating the so-called Espionage Act, which prohibits the disclosure of “national defense information,” the papers show; he ended up indicting Libby for lying about when and from whom he learned about Plame.
