Bill Frist, J.D.: ‘I Know the Program Is Constitutional’

    Today, on CBS’s Face the Nation, host Bob Schieffer pressed Senate Majority Leader Bill Frist (R-TN) about his views on Bush’s illegal NSA surveillance program. Frist, who famously flaunts the fact that he holds a medical degree, didn’t hestitate to share his legal diagnosis:

    FRIST: I believe the program — I know the program is constitutional — that it is legal –

    SCHIEFFER: Alright, let me just stop you, and let me just get back to the question that I asked you. Since you know all about it, as you’re one of the 8 who knows more about it than the others, do you think that the whole situation needs to be brought under the control of the court? Do you think we either need new laws to do that or do you think it’s ok to just keep going as you’re going?

    FRIST: Does it have to be thrown over to the courts, going back to the question you just asked? I don’t think so. I personally don’t think so.

    SCHIEFFER: You don’t think that the court needs to issue a court order before they do that?

    FRIST: No.

    While Frist was busy parroting the White House view, Sen. Lindsey Graham (R-SC), who served six-and-a-half years of service on active duty as an Air Force lawyer, suggested the program is illegal and needs to be brought before a court:

    GRAHAM: I am adamant that the courts have some role when it comes to warrants. If you’re going to follow an American citizen around for an extended period of time, believing they’re collaborating with the enemy, at some point in time you need to get some judicial review because mistakes can be made.

    If there is anyone who should understand that mistakes can be made, it’s Bill Frist.

      frist was clearly uncomfprtable talking about the subject of cheney shooting a 78 year old man - but he had no trouble blaming the democrats for making it a problem...

      thinks will help him politically without
      regard to anything else, including his
      hippocratic oath (though with Frist, it was
      likely to have been a hypocritic oath).
      This includes defense of anything BuchCo
      does, since Frist seems to think the WH will
      help him in 2008. I think he will be surprised
      when that doesn't happen.

      When these people say "to those ends, we will do a fair amount of killing" they don't just mean foreigners, they're also talking about the need to kill Americans if need be.

      Illegal wiretapping is only the first step.

      Actually, Mr. Frist is half right. The program is Constituional, under a strict constructionist view.


      Amendment 4 - Search and seizure
      The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized

      There is nothing in the 4th Amendment protecting searches and seizures of electronic communications. Any so-called "right to privacy" is a court construed doctrine, an "interpretation" of the Constitution. And, stare-decisis not withstanding, the Supreme Court has been known, on occasion to overrule prior decisions. Indeed, individuals are nominated to the Supreme Court in hopes that their views might influence the Court to overrule prior decisions.

      Next, is the progam illegal? Many have said so. However, under One-Party Rule, nothing the Party does is illegal. Already there is a great deal of talk about passing whatever legislation is necessary to allow the Government the power to monitor each and every citizen each and every moment of each and every day, without probable cause, nor warrant, nor any form of independent judicial oversight.

      The next logical extension would be to pass legislation specifically authorizing the President to hold "enemy combatants" indefinately without a trial. This could be achieved by removing federal jurisdiction over any person so accused.

      A totalitarian state needs terrorists, or some common enemy, to keep the people in fear and justify its actions suppressing individual liberties. That is why the terroist threat will be with us indefinately. And a totalitarian state must supress dissent. That is why it needs to monitor each and every citizen.

      As President Bush said in 2001, "You're either with us or against us in the fight against terror." If you disagree with the current regime you have chosen to side with the terrorists. The extension of this doctrine:


      Article 3 - The Judicial Branch
      Section 3 - Treason
      Treason against the United States, shall consist only in levying War against them, or in adhering to their Enemies, giving them Aid and Comfort.

      Thus it will come to pass that if you speak out against the current regime you will be found to have adhered to the enemy. You will have committed treason against the United States. This will be sufficient to label you an enemy combatant. Your next of kin will not be notified.

      R.J. Rushdoony is a former member of the Rutherford Institute Board of Directors. Those are the delightful folks who helped finance Paula Jones's legal defense.

      Now he's the head of the Chalcedon Institute, a California-based religious think tank that argues that every Bible passage must be taken literally.

      R.J. is considered the spiritual father of Christian Reconstructionism, which promotes the idea of rebuilding society in accordance with biblical law.

      He has called for restoration of the Old Testament law that would require we stone to death all adulterers, atheists, gays, and even bratty children.

      And what about folks who misbehave, but not enough to merit a death sentence? Oh, they would become a member of a new slave class. Isn't that clever?

      The MSM has done very well not to EXPOSE this group of Constitution destroyers, only 43 Lexus Nexus Articles Listed for them. Pat Roberston doesnt mention this Ideology on his show.

      I was willing to wait and see the details of the program before deciding whether it was illegal or unconstitutional. Or at least have some credible Democrat say it was once they had been briefed.
      But now that Frist says it's legal and he's reviewed the details of the program,I don't think there is much doubt that it is illegal and unconstitutional. Frist is the best negative weather vane in the Senate.

      Jack, I assume you are refering to my post as #9. Under a strict constructionist view, wiretapping is not a search nor a seizure, as it does not involve a person, house, paper, nor effect as was in existence in 1787. Orwell pointed out in 1984 that history is mutable.

      Certain people argue even now that our Constitution was based on the 10 Commandments, and the the Constitution incorporates the Declaration of Independence to place the Christian God as the religious foundation of our country. They conveniently ignore the fact that Jefferson refered to "Nature's God" in the Declaration of Independence, that his beliefs were more akin to Universalism or contemporary Paganism than to mainstream Christianity of his day.

      History is being re-written. Witness now the rise of Big Brother in the form of a Unitary Executive with the power of Commander in Chief as a War-Time President in a perpetual state of war against...ourselves.

My medicare provider wrote all with the company and said: "DO NOT"..sign up with the gov. plan, we have a better one, and they did.       I think its time to start a third party in the United States, because neither party is doing the things most American care about. The both parties are in the pocket of special interest groups and are owned by foreign businesses and governments. Think about this before you jump to conclusions: If a third party had twenty seats in the U.S. Senate, they would hold the balance of power, if the other two parties had forty seats each. It takes a 51 vote majority to past any bills, so neither party could do a thing without the "Independant Party".

      Since the majority of Americans are in the center when it comes to politics a third party made up of dissatified Republicans and Democrats could basically control Congress. All we would need to do is run a Candidate in every Congressional district and some of our people would win. The problem that Ross Perot faced when he tried it was they failed to enter into the Congressional races and that left them with no power.

      We should get together on line at try to put this new party together. I'm looking for volunteers in every state to start this new party. It won't be easy but neither was the American revolution. I'd like to start this new party by the 2008 elections.       NEW YORK Sen. Jeff Bingaman (D-N.M.) has asked Veterans Affairs Secretary James Nicholson for a thorough inquiry of his agency's investigation into whether a V.A. nurse's letter to the editor criticizing the Bush administration amounted to "sedition."

      Merely opposing government policies and expressing a desire to change course "does not provide reason to believe that a person is involved in illegal subversive activity," he said. Bingaman said such investigations raise "a very real possibility of chilling legitimate political speech."

      Laura Berg, a clinical nurse specialist for 15 years, wrote a letter in September to a weekly Albuquerque newspaper criticizing how the administration handled Hurricane Katrina and the Iraq War. She urged people to "act forcefully" by bringing criminal charges against top administration officials, including the president, to remove them from power because they played games of "vicious deceit." She added: "This country needs to get out of Iraq now and return to our original vision and priorities of caring for land and people and resources rather than killing for oil....Otherwise, many more of us will be facing living hell in these times."

      The agency seized her office computer and launched an investigation. Berg is not talking to the press, but reportedly fears losing her job.

      Bingaman wrote: "In a democracy, expressing disagreement with the government's actions does not amount to sedition or insurrection. It is, and must remain, protected speech. Although it may be permissible to implement restrictions regarding a government employee's political activities during work hours or on government premises, such employees do not surrender their right to freedom of speech when they enlist in government service."

      Have you read "The Way of the Shaman" by Dr. Harner? If you truely wish to understand, that would be a good place to start.

      Reiki is a label applied to healing energy. I believe it is the same energy refered to in the Bible when it talks of a laying on of hands. I was asked if I was a Reiki Master before I had ever heard of the term. All I knew was that I could help.

      In ancient times, people would turn to Shamans for healing. And a little over a year ago, the uncivilized tribes "knew" to go to higher ground and were unharmed by the tsunami that wiped out about a quarter of a million people living in a more advanced culture.

      Perhaps it is not the Shamans who are mucking things up.

      #8 - To answer the argument that because electronic eavesdropping is not mentioned in the 4th Amendment, I would argue that the citizens of the US are covered against that by the 9th Amendment. The 9th Amendment states that: The enumeration in the Constitution, of certain rights, shall not be construed to deny or disparage others retained by the people. Just because a specific right is not spelled out, it doesn't mean that US citizens do not have that right inherently - think suffrage.

      I agree with your point. Unfortunately the 9th and 10th Amendments have largely been eviscerated by Supreme Court decisions upholding acts of Congress which erode individual liberties.

      It would be absolutely amazing if a strict constructionist would enforce those provisions against the overreaching of the federal government, but I do not see Justices Scalia nor Thomas inclined to do so. Justice Alito was nominated because he was seen as following the Scalia mold, while Chief Justice Roberts is of similar ilk to his predecessor.

      That leaves Justice Kennedy as the swing vote. Sadly, he authored Bush v. Gore in 2000.

      I concur. Unfortunately the 9th/10th don't delineate what is "inalienble", what is states rights, and what is federal territory. It's amazing that the authors of the Bill of Rights even had the forethought to anticipate overreaching of the federal (vs. states and individuals), but over the years have been able to use wordsmithing to eviscerate the constitution when they saw fit. What disappoints me is that while weakened, it seems our esteemed legislators have forgotten them entirely. It is debateable that the ordinal position of the amendments shows the relative trump position, as each were made to correct previous errors. Thus, Bill of Rights trumps Executive authority, but no one is debating it. Just food for thought.

      For "unalienable rights" look to the Declaration of Independence. We the people have ALL the rights. Governments - federal and state - have no rights and only the powers we delegate to them.

      It all goes back to the philosophy of natural rights which Jefferson and other founding fathers believed in. (Indeed, they considered them "self-evident." We don't need to look to the Constitution to defend our rights; they were granted to us by "our Creator" and cannot rightfully be taken away by any government.
