In ordinary cases of foreign direct investment the Committee on Foreign Investment in the United States (CFIUS) first conducts a 30-day “review” of the transaction. After the review, the committee makes a judgment as to whether a 45-day “investigation” is necessary to address national security concerns.
The law, however, was amended in 1993. That amendment makes the 45-day investigation mandatory in cases like the Dubai World Ports transfer. From the CFIUS website:
The Dubai World Ports purchase triggers the automatic investigation. First, the company is “controlled” by a foreign government. Second, it’s undeniable that port operations “could affect the national security of the United States.”
Yet, the investigation never happened. Bush administration officials “could not say why a 45-day investigation did not occur.”
It’s hard to see the world when your head is up your arse.

The FACTS (if you even care about them or can recognize them through your hate) are that the ports are not being sold to anyone and the security is not being taken over by anyone. The ports are and will be owned and controled by the various U.S. port authorities and the security at those ports is and will be the responsibility of the Coast Guard, Border Patrol, and local police.
This deal is analogous to Pakistan International Airlines leasing gates and terminals at JFK International Airport. They do not own the airport, they do not control the operations at the airport, and they do not run security at the airport. They simply lease various gatesand terminals and manage the operations at them subject to prevailing laws and regulations under the authority of the the Port Authority of New York who owns the airport.

It is only mandatory when 1- “the acquirer is controlled by or acting on behalf of a foreign government;” and 2- “the acquisition could result in control of a person engaged in interstate commerce in the U.S. that could affect the national security of the U.S.”
That “and” is critical and it means both conditions must be met to require the 45 day investigation. The first condition is clearly met but the second is clearly not. The Dubai ports Worldwide is only leasing use of various terminals within American ports as other intternational businesses already do. This is not a nnational security issue. See my commennt above for all those reasons.
Additionally, the CFIUS statute governing this deal stipulates that only “those transactions for which an extended 45-day review (or “investigation”) is completed” requires a report to the President and a subsequent announcement by him. Because the 45 day investigation did not occur, the President did not receive a report and thus cannot make an announcement.

KuwAm also financially backed Aviation General, formerly Commander Aircraft, which brokered the sale of airplanes to the National Civil Aviation Training Organization (NCATO), located in Giza, Egypt, the hometown of lead hijacker Mohammed Atta and the only civilian pilot training school in Egypt. NCATO has a training agreement with Embry-Riddle University in Daytona Beach, Florida, the flight school that was investigated by the FBI for possibly training at least one of the 911 hijackers.
Neil also developed close connections to the Maktoum family of Dubai, the same family that has interests in the state-owned firm, Dubai Ports World, that is poised to take over the operations of six U.S. ports (New York, New Jersey, Philadelphia-Camden, Miami, New Orleans, and Baltimore) after its purchase of the British-owned Peninsular and Oriental Steam Navigation Co. O’Neill also asked UAE authorities to close down accounts used by Al Qaeda and affiliated partners like Victor Bout. The UAE complained about O’Neill’s demands to the Bush administration. O’Neill’s pressure on the UAE and Saudis contributed to Bush firing him as Treasury Secretary in December 2002.

Could this Administration be considering this port deal as a way of softening the threat by giving the Middle East some sort of vested interest in our continuing economic success? Not that I think this is a good idea of course, but there must be some reason for this apparent sell-out and this feeble logic seems to be the only one. If this is true, then it would seem Washington truly fears the impact of this Iranian action, and could be why Bush would veto any attempt to derail it. If this is not the reason, then God help us, we are watching our own demise as it happens, and Dubya may just be the last American president.

What are known positions of UAE regards Iran, and regards funding Hamas goverment of Palestine? And UAE’s vulnerability to attack by Iran could become another vulnerability for us, especially if records are kept there without being available in the US (& subject to US courts too.)
Also, forget secuirty, what about the UAE’s ability simply to cause a slowdown of all ports they control. That alone could put a huge monkey wrench in our economy!!

The response to this post of Judd’s, only three days old, seems to indicate widespread, no pervasive, concern over giving away valuable national assets. This has been going on for some time (jobs, gold, Panama Canal, etc) and we have never even slowed it down with all our protests. The blog by Seixon, #99 provides a great view of the legality of this port deal, but when has legality ever stood in the way of gain? Rep. Ron Paul, always a sensible voice, gives an overview of financial empire maintenance in his report “The End of Dollar Hegemony” (find it at Rense.com or wwwhouse.gov/paul/legis/shtml), the point being that the dollar must be propped up at all costs to hide its destruction through inflation.
This deal has no doubt been in the works for a while and in the back rooms where such agreements are made perhaps the control of ports was required as a price for UAE and Dubai’s assistance in the unpleasantness about to unfold in Iran. Such a sine qua non is also not unheard of.
Not very long ago (the 70’s or 80’s) merely mentioning the term New World Order or globalization would brand one as a conspiracy theory nut case, a smear intended to blunt dissention. At that time to suggest a deal like this, or even the invasion of Iraq, would have seemed too far out for even the most wild-eyed radical to accept and yet here we are. We are “addicted to oil”, our economy dependent upon Asia and the Middle East for products and energy as well as the support of the US dollar.
It is unlikely that Europe will support Asian industrial growth the way the US can, or that they will consume oil and gas as freely as we do. Somewhere, someone will try to keep American money flowing to these places, such money’s value or lack of value notwithstanding. It remains to be seen how well we survive the assured strain on our economy, stress which is already being endured by Americans largely unaware of why they just cannot make ends meet anymore.

It also provides guidance for the triggering of an extended investigation, and sets a maximum time for the investigation at 45 days. It does not require an intestigation to last 45 days ad the premise of this discussion falsely claims. In fact the Exon-Florio regulations clearly specify the mits of their domain:
“The Exon-Florio regulations do not define national security. The preamble to the regulations provides guidance that products, services and technologies important to U.S. defense requirements would be significant to national security.”
