LETTER: Coast Guard Warnings Over Terrorist Infiltration Never Addressed

Last week, it was revealed that the U.S. Coast Guard had warned of “many intelligence gaps” concerning the potential for Dubai Ports World “to support terrorist operations” if it assumed control of U.S. ports.

Bush administration officials insisted the Coast Guard’s concerns had been addressed before the deal was approved. National Intelligence Director John Negroponte testified that DP World had sent a “letter of assurance” pledging to turn over any information that was needed to fill the gaps cited by the Coast Guard.

But in sharply-worded letter written this week, Senate Homeland Security Committee chairs Susan Collins (R-ME) and Joe Lieberman (D-CT) say the “letter of assurance” did no such thing. The Coast Guard’s concerns over intelligence gaps were never addressed:

A careful review of the “assurances letter” reveals that DP World is not, in fact, bound to provide the U.S. government with the information it would need to close the intelligence gaps the Coast Guard identified. … The language is weak. … Indeed, the assurances appear to amount to little more than a restatement of what the FBI or other law enforcement agency could gather anyway in the course of an investigation.

    This is especially true considering a part of their deal is that they are NOT required to keep a copy of their records on US soil. They get to keep any and all records on thier home soil.

    THis is unheard of and means if something happens it is impossible to find out why or how since there will be no evidence in the US to check.

    The Administration has argued, as they no doubt will today, that Dubai Ports World will only conduct terminal operations, and that the company will have no involvement in port or terminal security. They couldn’t be more wrong. Security is an integral part of operations.

    To draw a parallel, ground maintenance crews and the crews that clean and prepare planes are not directly responsible for airport security. However, it is not difficult to imagine ways in which they could have a deleterious effect on air security. Similarly, while terminal operators might not have primary responsibility for security, their actions directly affect the ability of Customs and the Coast Guard to perform their security functions.

    While much of the public attention has been focused specifically on the matter of port operations, this one situation simply underscores the much broader concern of how we even got to this point, and the answer lies in a flawed CFIUS process. Again, the ports deal only typifies the lack of transparency and congressional notification in the current process. The fact that the Administration fails to acknowledge any weaknesses in this system only makes me more concerned.

    Agreeing with a Republican senator goes against everything I care about, but when he’s right, he’s right…

    Let’s, for a moment, consider other topics that we might expect the U.A.E. gov’t to cooperate. Situations where we might have expected “assurances” with respect to curtailing and prosecuting illegal activity. I speak of human trafficking and sexual slavery. This shouldn’t be too hard, as I would hope it would be very hard for any govt to argue that such actions aren’t wrong. But turns out that is not the case.

    The U.A.E. is a destination country for women trafficked primarily for the purpose of sexual exploitation…the U.A.E. does not fully comply with the minimum standards for the elimination of trafficking and is not making significant efforts to do so. Despite sustained engagement from the U.S. Government

    Thus, judging from current actions of the govt of the UAE, we can not expect them to meet “minimum standards…despite sustained engagement” from us. And this is on a topic most can agree is wrong.

    We can not expect the gov’t of the UAE to put the needs of US security ahead of their own needs and priorities.

    The message that has been dutifully delivered by the MSM is that the Coast Guard’s concerns had all been addressed and they were now comfortable with the sale.

    Jay,it’s not that Bush intends to carry it out,the deal has already been approved. That’s what the company is talking about receiving on 1/17/06. For DPW to not be permitted to own the leases would require payment to the company for the value of the leases by the US. And for the legal side of the ledger,this would have to be a sale either to the government or perhaps a no-bid contract assigning the leases to a new company.
    Bush wants to forge ahead (as well with the other engine company purchase) because this is a done deal,legally.

As for monetary penalty for buyer: they got an illegal approval to buy the British company, so their case would be weak in court!The deal can still be canceled!     No,Jay,you haven’t been reading the papers. The approval was granted by CFIUS. Bush has nothing to do with it and neither does Congress.
    The company was sued in London by their co-lessee in Florida and 2 shareholders. That suit was dismissed and the deal in the UK closed. The company has agreed not to take operational control in the US for the 45 day period of review.They are insisting that the profits in those 45 days are theirs.
    The case is a slam dunk for the company.

    Jay,first of all,calm down and read the article. The Dubai company has bought the stock of P&O. Among the assets of P&O are the leases to operate port terminals in the US. They would not have bought that stock for the price they paid without having obtained all the necessary governmental and regulatory approvals.
    Among the approvals they obtained was the approval of the CFIUS and that includes the US assets. Bush is defending this deal because legally,it is a done deal.
    I’m simply stating a fact that DPW has purchased P&O.

It does not matter that the British company sold all their assets to the UAE firm > since port operations have to be cleared through our Federal and State governments!     Revoke the ports deal. It is just plain not in the interests of American security, and is bloody stupid besides.

    Then, because Bush is the one who pushed it, and basically put America in the dwang, take the money won in any settlement with the UAE out of his, and his party’s, pocket to pay them.

    Jay,perhaps you’ll see this. The approvals have already been granted. In order to stop the UAE company from owning the leases to operate the terminals,the US will have to acquire the leases from DPW (or have some other acceptable company acquire the leases) and pay them for the leases.
    If GWB does nothing,then Congress will have to legislate against the ownership. Either way,Dpw will have to be paid for the value of the leases.

    No one can make an informed decision on whether or not it is a “done deal” based on the information that has been released thus far. If CFIUS gave approval, yet all the legal steps were not followed, their approval is a nullity, as if it never happened. The contract could either be rescinded or voided.

    I would hazard to guess that if the “done deal” does not go through, it will take teams of lawyers on both sides countless hours of legal research and brief writing to explain just why this is or is not a “done deal.” This will be all the more difficult because He does not want to release any information as to how this deal was struck without the proper vetting.

    Bris,I understand that most Americans oppose letting a UAE company from running the ports. Nonetheless,CFIUS granted the company govenment approval. Absent the approval,the company and P&O would have said that they had not obtained all required regulatory approvals. CFIUS did something that perhaps the majority of people would not have but the approval they granted was legal.
    This is a fairly common coporate buy-out. The deal awaits the outcome of the London High Court potential appeal by Eller Corp. When the appeal time limit runs its course,the deal will close and the P&O shareholders will be paid 520 pence per share;DPW will then own title to the leases.

First off the CFIUS group has been shown to be inept and a failure by many senators in the hearings. They are in fact run by underlings that didn’t even do any proper questening, just sign off’s. The review was total pass off’s from one department to another, little to none was checked out and only one short meeting after a month of paper shuffeling. This deal may go through, but it should not. It is illegal, unethical and a huge threat to our security. If the UAE needs to be paid off, so be it, send them packing and send Bush packing as well.     Sharon you confuse my providing the facts of the corporate transaction (the payment by DPW of 520 pence per share to P&O shareholders) with either approval or disapproval. The comment I wrote had nothing in it about whether I was in favor or opposed. You read into it your own opinion of me and the process.
    I’m sorry you are unable to separate your emotions from an objective analysis of what occurred and the outcome. Holding hearings isn’t enough.
    Congress has no authority at present to undo the transaction. Congress would have to craft a new piece of legislation to accomplish the goal you seek and/or the pres. would have to agree to buy out the value of the ports in the US.

    TJM, as I am a voter, patriot and citizen of the USA I take my countries safety personaly. Yes I do get emotional about my country and her people. You may be right in some of your information and in some, wrong. First off the ports lease was with a Canadian company but 100% owned by american subsidery. The new proposed owner is 100% owned by the Dubi government. CFIUS as I have been informed has passed 1499 of 1500 requests in the past few years with much of the same quick review, no accountability and very little research. In that number up to 12 foreign governments have purchesed land or leases here and to date the public is not informed of who or where they all are. In the present state of affairs and administration we are sold out to the highest bidder. If it were not for a leak we would not know of this recent proposed sale.

    From your post’s you seem to be in favor of this port deal, fine, I am not. I will not support a country that has and does support HAMMAS, it’s royalty has funded BenLauden and is now Bush’s new best friend…..Blessings

    I used to think this and in some ways still do; however, it’s become quite clear that those with scads of money and power are quite happy with what Satan’s Dopier Brother (Beelzedumb? Beelzebush?) is doing.

    Obviously, Bill Clinton’s ruinous and shameless act of sexual congress with a woman not his wife (!!!!) made even the Brigadier General Baby Jesus’ cheeks burn bright red, and thousands of caucasian innocents were slaughtered as a result. The nation is still trying to forget that bloody day! Furthermore, thusly the floodgates were opened for skeletal HIV-rotted armies of SODOMITES to come clattering over the horizon, slavering for the genitalia of normal white midwestern children.

    Plus, Clinton’s brazen command of the English language did the double dirty deed of 1) making folks feel dumb and 2) making folks drop the remote and haul that big heavy dictionary out of the attic, therefore having to miss /American Idol/.

    So, maybe Clinton was only 100% in the pocket of Mammon. Do I hear 101%? 102? Just, I’d argue, less so than Dumbya.

    For you see, you seem to imply so – but I can find no evidence that this is the case. Please engage me in friendly dialogue on this topic.

    Also: I did a search on this page for the term “unbelievable” which you used twice in your post. Yours are the only two uses thereon. I can only conclude therefore that you are referring to someone or something on another thread, website, Internet, planet, or spiral galaxy. Please correct me if I am wrong. That is, unless it is uninteresting. I hate to be bored.
