Vice President Cheney’s handwritten notes, disclosed in a new court filing by Patrick Fitzgerald, show that he was “acutely focused” on smearing Joseph Wilson. Among the questions Cheney jotted in the margins of Wilson’s op-ed: “[D]id his wife send him on a junket?” PDF available here.

I looked through the filings before and didn’t find anything listed that would answer those questions. I realize Darth knew he went on the trip and was briefed etc. Knowing that there was an article about it he would have to cover talking points for the press.
I could see them asking if we normally send Ex Ambassadors to spy, He said it was Pro Bono, is that normally what the government does? The questions about his wife could simply be to know how to field the question “The CIA paid for the trip, why was this done” if he knew his wife sent him then he could deny/adjust the story as needed to keep her identity secret.

i think the last full paragraph on page 8 is interesting in that fitzgerald seems to have other annotated articles of the hersch article that he is more or less ‘threatening’ to use, depending on the defense… what i am guessing fitz’ intention with this 10-page filing is to a) alert cheney that libby–or someone else in the ovp–gave this to fitz; and/or b) this one nyt article with annotations is not the only annotated material he has–so, either libby/rove/or cheney have to be wondering exactly what fitz has… a great technique to get all the criminals wondering who has what and who is giving what to whom…
with any luck, cheney will be indicted for violation of the underlying statute. and if so, they can drag his rotten corrosive carcass off at the federal pen with tom delay, mr foggo, and nine-fingers for a card game in orange jumpsuits!!!!

Yes it’s a weasle clause but that’s the way law has been used. When I try to determine whether a crime has been commited I look for intent. Now if what the NY Times says is true about the VP ordering domestic alls to be monitored without a warrant when the NSA attorneys spoke out against it I’d have to wonder what was the VP’s intent in going around the FISA court. The big ticket to me seems to be Did any of this surveillance occur BEFORE 911?
