Bush Supports Constitutional Amendment Banning Gay Marriage, Distorts Meaning of Democracy»

President Bush used his radio address this weekend to lend his support to the Marriage Protection Amendment, a constitutional amendment banning gay marriage. This paragraph stuck out:

A constitutional amendment will put a decision that is critical to American families and American society in the hands of the American people, which is exactly where it belongs. Democracy, not court orders, should decide the future of marriage in America.

This statement is endemic of a larger problem in the Bush administration – the failure to recognize the judiciary as a co-equal branch of American democracy. Courts are tasked with enforcing laws that are the will of the people, as expressed through the legislative and executive branches.

President Bush has every right to support a constitutional amendment banning gay marriage. But, in doing so, he is no more a supporter of democracy than those who would leave this question up to the states.

Maybe before we start amending the constitution, we should brush up on basic civics.

    Who are we to legislate whom someone can or cannot love?

    Did marriage originate with the Church, or the State?

    If the Church, then defining marriage is a Church issue, and Amending the Constitution to define marriage puts the State in the position of regulating religion.

    If the State, then defining marriage based upon gender is gender discrimination and a violation of the Equal Protection clause of the 14th Amendment.

    In either case, passing this Amendment causes the Constitution to be in conflict with itself. Thus far, the Supreme Court has not had to deal with an unconstitutional Constitutional Amendment. Thus far, the American people have yet to Amend the Constitution to make discrimination the Supreme Law of the Land.

    Those who foster their bigotry and intolerance in the Name of Christ upon the rest of us are becoming more and more isolated by their own hatred. The last I checked, the Pledge of Allegiance still ended with the phrase, “One Nation….with liberty and justice for all.”

    Almost, but not quite. Courts are tasked with interpreting laws that are the will of the people. The executive is tasked with enforcing the laws, and the judgment of the courts.

    It would be more appropriate to say Courts are tasked with interpreting the laws that are enacted by the legislative branch and enforced by the executive branch. The crucial function of the Courts is to interpret the laws consistent with the Constitution.

    What happens when the Constitution says,

    “Congress shall make no law respecting an establishment of religion”

    and

    “No State shall … deny to any person within its jurisdiction the equal protection of its laws”

    and

    “Marriage in the United States shall consist solely of the union of a man and a woman. Neither this Constitution, nor the constitution of any State, shall be construed to require that marriage or the legal incidents thereof be conferred upon any union other than the union of a man and a woman.” http://thomas.loc.gov/ cgi-bin/ query/ z?c108:H.J.RES.106:

    when a Church supports gay marriage,

    The United Church of Christ became the first mainstream Christian denomination to officially support gay marriages on July 4th, 2005 when its general synod passed a resolution affirming “equal marriage rights for couples regardless of gender.”

    a situtation is created where the Constitution invalidates a tenet of a mainstream Christian Church. This Amendment, were it merely a statute, would be unconstitutional (assuming 5 out of 9 Supreme Court Justices agree with the above analysis).

    This proposed Amendment is a reaction to Federal Judges’ reading the equal protection clause of the 14th Amendment as prohibiting gender discrimination when it comes to State regulation of marriage. Those judges have been labled “activist” because they seek to protect the rights of the minority in face of discrimination fostered by the majority in power. They are to be commended.

    The Constitution used to be all about the PROTECTION of individual rights but for the religious Right, that concept is so quaint and so pre-9/11. In a post 9/11 world, they must now amend the Constitution to DENY individual rights.

    Psychiatrists and psychoanalysts are the first to admit the latent homosexual tendencies between occupational groups, such as postal workers, they all wear the same uniform. Members of Congress all wear suits that look the same. Members of the military with the exact look-alike uniforms. Members of gangs with the same colors, hats (ties), et cetera.

    Especially, members of religious sects; like the priests in the Roman Catholic Church.

    Forget about gay marriage, it’s dumb. We’re all married, if you think about it.

    Have a freaking nice day in America. America is for the people, of the people, by the people, and devoid of the US government. Glad it’s gone to hell in a handbasket.

    Queen George the Dumb probably doesn’t even know what an amendment to that “God-damned piece of paper” consists of much less giving a shit about marriage or GLBTs. He read whatever somebody put on the paper for him. The somebody that decided the repugs would get more votes from the right-wing-nut rednecks and bigots than they would lose in the GLBT community.

    The only legitimate amendment would be one that allows the American people the right to a vote of confidence in any elected official that abuses his/her office and makes impeachment/removal mandatory by the governing body.

    That, my friend, would be a true democracy.

    The real sad part of all of this is how conservatives fall for this bait every two to four years. There is probably a small minority of republican representatives that actually want to amend the constitution to back up their dogma, but most prefer to keep the issue unresolved so that they can use it as a wedge during elections. It is such an obviously shallow ploy, but sadly this shit works.

    What is odd, to me, is that many of these Lawyer groups, have worked to take power away from the Judiciary, and the Congress thru the Unitary Executive, and the Presidential signing statements mantra.

    Heres the part I don’t get yet. If Bush issues all these, 750 over the last five years, signing statements, and they have, then, yet to go back to the Judiciary for Interpretation?

    WTF? Its as if The Judiciary has hamstrung itself and congress?
    But these Signing Statements, are still just floating around somewhere? No Vetoes to send the Bill back to Congress either.

    The only good example of democracy I can think of right now are Scandinavians countries, which in fact are socialists-monarchists. Well, Socialism is a very old idea of what democracy should be. Do we really get to decide about the course of our democratic countries?     If we ban marriage for gay men and women, then are we not placing limits on human love?

    After all, that is really why we are here, so that we may eventually triumph at whatever this game of life is, through love. Love over evil. We are being sorely tested.

    Do what’s right, regardless of your feelings about homosexuality, and write your newspaper, your congress-person, your senator, and tell them to get on to the real issues. Especially tell that to your newspapers.

    Judd, I do NOT disagree with your assertion that the Constitution sets forth three co-branches of government as the method of checks and balances. What you are neglecting to mention is the pervasive use of the courts by plaintiffs seeking to promote their social agendas.

    The MO often begins with “cherry picking” judges whose ideology mirrors the plaintiffs and who has demostrated overtly or subtley this ideology in their decisions. These “maverick” loons regularly go against the vote of the people. Cases in point: Mt. Soledad cross in San Diego. 75% of San Diego voters voted to KEEP the 29′ cross on Mt. Soledad, which has had a cross on it since 1913. I propose we not force atheist-plaintiff Philip Paulson to be chained to the cross any longer, or have his eyelids peeled back and force his gaze to fall upon the offensive cross - (tongue in cheek for you humourless progs.) The whole point is that Mr. Paulson is not forced to accept other’s views - and we must respect his right as an atheist. The cross does not endorse Catholicism, or any of the Protestant faiths.

    In another matter, five liberal judges eroded private property rights in Kelo, et al v. New London, CT. Three of the four justices often vilified by the Left, Scalia, Thomas, and Rehnquist, joined O’Conner in standing up to the small homeowner versus the government.

    IF the proponents of gay marriage want to legalize these “unions, perhaps they should pressure their elected representatives to change the law. Or statewide referendums could take place - but THAT’s been done…

    What it really comes down to are company insurance benefits, “family” leave, and entitlement programs. Period. People who love each other are free to live with whomever they wish, buy life insurance, purchase homes, make out a will and last testament, construct a living will, etc. It comes down to people trying to “normalize” what is not normal - or any of my business.

    What a disgrace it is that in this day and age, when we need a strong president and a proven leader, we have this lily-livered former cheerleader as our court appointed president.

    The man has been a failure at everything he has touched, including this, his mandate, to lead the people of this great country.

    His only following are the oil company execs, the rich and powerful of this country, the corporate managers to whom he has given alms to time and time again, and the wealthiest 5% of the country. He has not given anything to the poor or the working people of this country, except for lower wages and lowered expectations.

    He abandoned the religious people after they got him re-elected in 2004, and is now on his knees once again ready to service them. What a hypocrit!

    Their view of democracy is a warped sense of “majority rules”. It is warped because they pick and chose the terms by which who is considered the majority and who isn’t. In their mind, it makes no difference that the majority of Americans support equal rigths for gays, they majority of loyal conservatives DOn’t and besides…the majority of Americans are straight so in their mind they have majority support.

    When the people disagree with Bush on every single issue, Bush simply acts like the people are clueless idiots and says the majority of people who truly know what is going on backs him.

    When everyone and their dog disagree with Bush he falls back on the excuse that since the majoiryt of the Senate and COngress back him, that is still a majority so he must be right and supported by America as a majority.

    When you have no grasp on reality, and Democracy is considered to be little more than “might makes right”, then you end up with sociopathics ideologues who would rather push America more towards a dictatorship than a true Democracy. Bush doesn’t want the people to have a voice and control, because he has nothing but spite for the average person. Bush is a spoiled brat of priveledge and the rest of the citizens are little more than trash for him to rule over…for their own good of course.

    First on the Christian aspect of this proposal….

    Why does everyone know Mary Magadelane’s (sp?) last name but nobody knows Jesus’, Mary’s, Joseph’s and Moses etc. last name? Why was it so important to document a whore’s last name but not God’s sons and the mother of his sons?

    Second: across the board polls indicate that more than 80% of American’s feel that the war in Iraq, the economy and jobs are most important to them.

    Does Bubble boy really think that fullfilling his promises (ban gay marriage, abortion etc) to the Christians is going to get his base back? Not, his base is included in the 80% figure.

    Bubble boy has made such a mess of his base’ lives the Christian agenda has been put on the back burner of voters minds.

    Give it up Bubble boy, until every American can puchase a gallon of gas for $1.50 (the price it was when you stole the election) you will not get one single former supporter back.

    As for those who never supported Bubble boy, there’s not a chance in hell iof getting us to change our minds.

    Seems to me that if people put this much effort into worrying about their own marriages, there wouldn’t be a need to worry about the failure rate of marriage…

Just to do with human nature (evolution). Which Christianity rejects, so it again finds itself expecting human beings to be something they largely are not (always exceptions), and blaming its failure on a host of conceived ‘demons’…

All of my female friends who have a child become so busy caring for it that they have practically no time for adequate sleep, much less the ability to spend hours every day in a blog. And it exponentially increases (the demand) with each subsequent child.

    All the women who post here as much as MA are women with groen children or no children. I’ve never heard any of the regular women say that they have two young children - much less four, a high demand career, and a house and husband.

    It’s not only not logical that Mighty Mouth’s story is true - it’s impossible.

    I have a cousin who is three years older than I am. She has two little kids (6 and 4). Her husband is retired and she does not work. Prior to the family, she would email me atleast four times a week (she likes to debate and discuss politics also) for several years. Now, I hear from her once every three or four months with an apology as to why she hasn’t written sooner. She’s a lapsed Catholic who is a moderate. If she can’t find time to write, who does MA with twice as many kids and a job find hours? Doesn’t add up…

    Have you seen the article on Michael Moore’s website that is a compilation of the events of the 2004 election that show the discrepancies between the exits polls and the outcome? There are a few studies that have been done, but this one is a cohesive explanation of why exit polls, throughout history are never wrong. And yet 2004 was off by a huge percentage in comparision.

Things have changed drastically in the last 20 years. Adn illness has certainly been one of the things that has increased disproprtionately.

    It’s just a hypothesis. I know people actually get sick. Why I avoid using absolutes :)

Too many people enter marriage without giving a single thought to the relationship AFTER the wedding reception, and they lack the maturity to think beyond their own wants and needs.

I dont do to others what I would not like others do to me. Therefore, If I am in a relationship, I HAVE to be monogamous.     As if we didn’t already know there was absolutely NOTHING Bush won’t do, except tell the truth.

    So Monday will roll around and in order to try to bolster support for his sad, sad approval ratings he will again try to cultivate fear, hatred and intolerance by telling everyone what they already know about him….THAT HE IS A HOMOPHOBIC BIGGOT.

    His announcement Monday to that effect should be a non news item, but in true toady form the MSM will pick it up as the news of the day and run it straight into the ground.

    The only thing that might possibly take some attention off his non news moment is if Natilie Holloway or the runaway bride make an entrance or another white chick going missing.

    Who will be the next group after the gays, and Latinos, so called enemy combatants at the secret torture prisons, or those innocent Iraqi people that are executed in their homes to be persecuted and denied civil rights? Will your severed head be one that the soldiers are playing soccer with next time Bush issues a call to hate?

    So here we have it Bush pandering to the homophobic racists that worry way too much who everyone else is having sex with and who they want to marry than minding their own business and worrying about how this sad little mad man is systematically tearing up the Constitution, which he has referred to as “just a Godam**d piece of paper” and his codpiece Gonzolas deems “an outdated document”.

    The very sad thing is that Bush’s poly to refocus America’s attention away from his miserable lies, and illegal behavior and corruption to Gay Marriage will probably work.

    You see in Bush’s little world the truth does not matter, only winning matters. He believes that he can repeat a lie often enough and have the MSM repeat the lies until the public takes it as gospel.

    Bush as a young boy used to insert fireworks in frogs and cats and set them off. You see most little boys that torture animals don’t grow up to be president, they usually become serial killers. Food for thought.

    And one final note: they call the Church congregation the “flock” for a reason. That reason is sheep never lead, they only follow.

    So when Monday rolls around you’ll see a whole new effort to deny civil rights, and a brand new call to hate.

    If a man has a sex change operation
    (after a year of taking female hormones whom the pharmacutical companies profit from) can he marry a man? Would it be considered a same sex marriage?

    Can a hermaphrodite marry at all?

    There are about half a dozen people who I routinely skip over. Mighty Mouth is usually one of them. Today, I was curious as to what the resident closet case would have to say on this particular subject - considering he himself is gay and ‘married’. And as I figured - he did not come out and call homosexuality any vileor derogatory names (which he is never short on for the rest of people the neocons find inferior). Interesting, huh? So, I point it out and Drag Queenie goes ape, as usual because he doesn’t like people who can see through his lies. Which equate to most of us around here… And yet he stays.
