SOURCE: Obscure Trade Settlement Could Create $480 Million Slush Fund for White House

The resolution of an obscure trade dispute involving imports of Canadian lumber to the United States could result in a $480 million slush fund for the White House, according to a lawyer familiar with the case.

For years, the United States has been in contentious litigation with Canada over tariffs imposed on Canadian lumber imports. Canada maintained that tariffs imposed on lumber imports to the United States violated the rules of NAFTA and the WTO. Pending the resolution of the litigation, the Department of the Treasury held these tariffs in an account which now contains five billion dollars.

The United States lost virtually every major aspect of the litigation for the last five years, and as a result, a settlement seem elusive. Then, last April, the United States and Canada reached a surprise agreement. Here’s what we know about the deal from public sources:

– $4 billion dollars from the account will be returned to Canada. $1 billion will be returned to the United States. Of the $1 billion dollars that will remain in the United States, half is designated to the U.S. lumber industry.

– The remaining $500 million is to be split between “a joint initiative benefiting the North American lumber market” and “meritorious initiatives in the United States” such as “Katrina reconstruction.” (The New York Times reported that it is “not clear what will happen” with the money slated for this purpose.)

– The deal was struck after direct communication between President Bush and Prime Minister Stephen Harper, who are political allies and personal friends.

ThinkProgress spoke with a lawyer familiar with the case, who said the following about the agreement:

– The United States is requesting $480 million for “meritorious initiatives” and just $20 million of the joint initiative benefiting the North American Lumber market.

– The agreement contains a complicated escrow system that may allow the $480 million to be funneled from the Treasury Department to the White House.

– It is the position of U.S. negotiators that Congress does not need to have any involvement in the deal.

ThinkProgress contacted the U.S. Office of the Trade Representative. A spokesman said that he didn’t know if the White House would be involved in dispersing the funds or if Congress would be consulted, and was doubtful he would “be able to discern” this information in the future.

The fact that hundreds of millions of dollars may be headed to the White House with no oversight raises the possibility of abuse — especially five months before a federal election. This is a significant amount of money and the administration should explain exactly how it will be spent and who will be overseeing the process.

    Once again, BushCo will ignore the fact that they do not have the authority to snatch this money. It belongs in the Treasury, and how it is spent is up to Congress to appropriate.     Obscure? Listen, bucko, it may be “obscure” down there, but to us it’s been the most irritiaitng and long-lasting trade dispute our country has ever had.

    Despite many, many NAFTA rulings in our favor, the US has refused to return these (illegal) duties to us.

    Rightfully, the money should be refunded, in full, to the Canadian companies that had to pay it.

    This “obscure” dispute has made us question the very foundation on which NAFTA was built. If one of the three countries invovled won’t negociate a fair settlement, won’t abide by arbitration and illegally charges exorbitant duties, then what’s the point of NAFTA?

    No slush fund!

    Last time I was up in Vancouver BC. about a year ago. This dispute was all over the news. The canadians were pretty pissed off. Back home in Seattle though, barely a peep about it. I agree with #25, the money should be returned to the Canadian companies that paid the tariff.

    Anyway, from what I understand of this, yes, like theswan posted June 12, 2006, at 2:18 pm, it seems to me that the whole $5bn should be returning to the Canadian government and taxpayers. If this is indeed legally true, then what is going on is that Stephen Harper is actually aiding and abetting the US, i.e., G.W. Bush et al, thievery of $1bn from Canadian taxpayers, and this alone should be more than sufficient cause for immediate impeachment, and then prosecution, of Harper, because he’s then and hereby complicit in helping to literally steal $1bn from Canadian taxpayers (which would make the few hundred million or less that the prior Liberal Party has been strongly slammed for misappropriately using to counter separational movement in the province of Quebec during the 1990s).

    Imagine that, Canada has high taxation across the board, high on incomes, high on purchases of goods and services, and high enough taxation by provincial governments on incomes, as well as surely other forms of taxation. And here we have schmuck Harper helping the Bush team to literally hijack, steal a whopping $1bn from Canadian taxpayers; not from the government bureaucrats and employees, but from the taxpayers, who had absolutely no opportunity to have a say in this deal-making process.

    But Canadians were awfully stupid and quite morally devoid to elect Harper to begin with, because he is a war criminal. He is this in two ways. First, he was the most maddog wardrum beater in the Canadian government, having demanded again and again that the Chretien government fully embark Canadian forces into the then entirely, certainly extremely anyway, obvious war of entirely criminal and unjustifiable aggression. And secondly, since he’s taken over as PM, he has done nothing to address Canada’s crimes of war and againt human rights with respect to Haiti. (Of course we should be able to add on his continuing support for the war in Afghanistan, but it’s not as clear-cut of a case as those of Iraq and Haiti are, the UN, as far as I’m aware, has not stated that the former is illegal, while having done so with respect to the war in Iraq, and then while not having any word or statement needing to be said regarding Haiti, for it is such a clear-cut, totally obvious war of criminal aggression that it does not really matter what the UN says; if the UN opts to stand by the hell reigned on Haiti by the US, France and Ca, then the UN will only be making it extremely clear to the whole world that it is nothing but a GANGERTERS’ side-arm, utility, something it’s already committed too much so far and therefore needs to cease doing, aiding and abetting in war crimes and crimes against humanity.)

    Ca’s hasn’t been doing well over the past 15 years or more. It’s had four lousy, corrupt, corporatist, …, PMs in a row, which should be nearing some kind of a record, I suppose anyway, and three of whom are now all war criminals; Chretien for at least the gangster war of aggression on Kosovo/Yugo. in 1999, and then the present Iraq War, given he made Ca the greatest ally contributor in the US military build-up for this war, which no one could even remotely justify, including as of first public mention of it during Oct. 2002, if not a bit earlier; Martin, for the hellbent coup on Haiti; and Harper, for his dogged warmongering politics to try to get Ca fully into the war on Iraq. (And we still have the war on Afghanistan, Taliban regime anyway, which was certainly illegal and unjustifiable, for they had nothing to do with strikes on the US on Sept. 11 2001, and to make it all the worse, Bush had recently enough before that date criminall threatened them; having literally told them, over the oil pipeline deal he et al were trying to arm-twistingly, really gangsterishly, negotiate the Taliban into accepting, telling them that they had to accept carpets of either bombs or gold, depending on whether they reversed course, ceased their then new objection to the deal, or not.)

    Great (not!) record for Ca, with these four PMs bang, bang, bang, bang in a row. And it’s such a petit country, having only around 30-33 million population, a “nice and neat” little puppet-regime-north for the US, eh!!!

    At this present or recently concluded meeting, not recalling what the dates for it are, just that it’s this month, this Bilderberg group (BG or Bg) is holding private, secret talks over very important world affairs, including the potential US war of entirely criminal aggression on Iran. They have an odd kind of security set-up too, as well described in the excerpted Canada Post article in the above post of Ruyssenaars’. That post also specifies the names of some of the bigshot schmucks attending the meeting, too, at least some of the names being familiar to most of us by now, while some of them are corporations, like Coca-Cola.

    What’s particularly odd about that is that the Canadian PM is allowing this ‘freewheeling’ (a really fitting term for criminal order racketeers, …, or simply gangsters if you prefer, too), it’s a secret society, extremely so, it is criminal, provably so if only courts of law and governments would stand by law instead of against it, while only pretending to truly stand by laws, it is not a state or government group of any kind, it’s going to be freewheelingly discussing what is to or should be done about Iran, which only state bodies and the UN should have the right to do, while the rest of us only have the right to voice our views to our political representatives, and then to be able to get laws applied with respect to accountability, etc., Canada has established anti-gangsterism and anti-terrorism laws, etc. (in case I’m leaving some other pertinent aspects omitted).

    And all of this international gangsterism-and-terrorism affair has been “blessed” by Harper.

    I wonder what the BG has to fear from Canadian police forces, and why Harper is treating Canada’s police forces in this manner. He is doing it, for he’s “blessed” this extremely unholy event.

    P.S.     Money that was supposed to go to tobacco farmers, who were sold out by NAFTA was used by the states to meet their depleted budgets. I know a tobacco farmer in N.C. who lost his family farm because he believed the federal and state govts. would do what they said they would. Now I’m seeing mills going out of business because huge companies like Home Depot get their lumbar from Norway. How can this save money with the price of fuel. Meanwhile our tax base is depleted . State and Fedral govts. are going in the red. While Bushco and Corporate Hill grin and ruin this country. The only way to stop them now is to stop giving them money.     I thought any money from any source that the treasury has a claim must be deposited into the general fund of the treasury and then dispersed to the various budgetary accounts. It is improper and illegal to do otherwise. No individual or entity can claim monies that belong to the people of the United states, Mr. Bush included. That’s why we have laws and audits to protect the treasury from being ravaged and plundered. However since the dolt in the White House and the corrupt republican congress have been stealing us blind for the past five(5)years, the American people have gotten used to it, ignore it and just go on their merry way.
