Yesterday on Fox News, Michelle Malkin mocked the suicides of three Guantanamo Bay detainees. Her reaction was so out-of-line that even O’Reilly took exception. Watch it:

People are crazy to think we need to be trying these people in US Courts, they are Not US Citizens therefore they have Zero rights and if anyone thinks otherwise is flat out wrong.
My question to all of those who think that is do you really think if a US Soldier were taken prisoner in a radical middle eastern country would they be treated the same way we have treated these individuals at Gitmo?..The answer is no they would be tortured and some probably killed but no one who champions for human rights would care about that, instead your all worried about torturing some foreigner about information on terrorist activity.

You obviously haven’t read the constitution. There is this small section known as the Bill of Rights….
That includes bits like this…
See what that says? Notice it uses the term “PERSON” not “CITIZEN”. The distinction is clear… No Person means NOBODY. No Citizen would mean No person who is a citizen. The framers of the constitution must have understood the difference because in Article II we find this…
If they had meant “No Citizen” then they would have said “No Citizen” The difference is clear.
So, if you don’t mind being held, without charge, indefinitely, that’s fine… But don’t impose your will on others.
And as for Michelle Malkin… WTF… She’s a Political Analyst? Doesn’t Analysis require critical thinking?

The Bill of Rights (and the entire constitution) did not distinguish between Citizens and non-citizens for a very good reason… The disctinction was exceptionally arbitrary at the time.
The British Government refused to allow anyone to give up citizenship until the middle of the 19th century. Thus if you were born British you could always be tried (or conscripted, or shanghaied) as a British Citizen. Anyone who was a “British Citizen” in America before the revolution was still considered by the British to be a British Citizen. Given that the constitution uses both People/Person and Citizen and DRAWS A DISTINCTION between them it is not surprising that the courts have found in the past that the two terms are not indistinguishable.

Clearly, there is not expressed authority in the Constitution that gives the government the right to hold these people without a trial or charges. That is the point of the Bill of Rights – it is a double stricutre: individuals have rights that are protected, AND the government has no basis upon which to deny those rights. That’s just what I thought.

Both Coulter and Malkin have made the fortunes by these types of statements. It is a damn shame that either of these fakirs are considered “analysts” by anyone, even if we are talking about Faux News.
The truth about Gitmo is that the United States is illegally holding prisioners outside of our territory to place these detainees in a grey legal status and so that they can avoid (for as long as possible) the due process that is guaranteed under our Constitution. There is no reason that the men being held at Gitmo can’t be brought to US soil and face trial. President Clinton was able to pursue and prosecute the men responsible for the first bombing of the WTC without resorting to holding them on foreign soil, throwing out the Geneva Convention and ignoring the US Constitution. Why can’t Dubya do the same thing with these men? Despite the possibility that some of them could be members of Al Qaeda or the Taliban, are they not still human beings? Have we no respect whatsoever for the lives of other people? It doesn’t matter one whit if “the other side” would respond in kind; what matters is who we are and how we comport ourselves.
PS: I’d like to suggest that we stop feeding the trolls. They are not here to discuss issues, or even to learn new facts or to hear the opinions of others and engage in civil discourse. They are here to bog us all down in tangential discussions that are (mostly) irrelevant to the topic at hand. Since they can’t seem to defend Malkin’s remarks they resort to name-calling, spurious arguments and outright lies. If no one engages them they will go away. There are innumerous examples of absolutes in the Bible—good and evil, right and wrong, heaven and hell, wise and foolish, friend and foe. Jesus himself said that he who is not with me is against me. That being said, there are absolutes in the world today. We are at war against an enemy who will terrorize our cities, our citizens, and our way of life—unless we stop them. When a war is declared, a line is drawn. Assuming that you are a U.S. citizen, your country is at war! You’re either on one side of that line, or on the other. I saw a show on television years ago. It was documentary show. They aired the results of a study that scientists had done with plants. They connected electrodes to the plant to monitor its biorhythms (I think). The plants were subjected to a series of tests to see if they had any measurable reaction to their own abuse, as well as the abuse of other plants and animals. The results were profound.
Not only is a plant stressed by abuse it receives, but it is also stressed by the abuse to other living things in its envirnoment. They used the results to explain the health of house plants…
I think those who abuse anything are the problem – whether a plant or a puppy or another human being. Someone who gets off on torturing other living beings is not fit to be around other living beings…

What made America great was a group of liberals who had the forsight to write it down (Constitution) that everyone had the right to life, LIBERTY, and the pursuit of happiness. The Third Geneva Convention, inexplicably, says that guerrillas have combatant status, not in wearing a uniform but in carrying a weapon (http://www.genevaconventions.org/). And when they aren’t carrying a weapon, they are, conveniently and maddeningly enough, civilians.
Usually people say that the GenCon requires uniforms for guerrilla fighters to be accorded prisoner of war status.
They are human beings, but the Gitmo internees are humans who chronically mix into and out of civilian populations, putting civilians at risk and even publicly announcing the intention to harm civilians. What particular rule of law should apply to such slippery combatants?
They’re humans–we should give them access to some things but they should not be accorded the same legal rights as an American citizen or even a uniformed prisoner of war fighting for an organized and internationally recognized opposition. Al-Quaida, so far as I know, has not recieved official diplomatic status in any semi-reputable country.

* Rolling back the huge tax giveaway that Bush and the GOP have given to the wealthy
* Removing the cap on the amount of income that is taxable for Social Security, etc.
* Placing a 100% tax on all income over $1 million
* Publicly-funded healthcare for all Americans
* Publicly-funded election campaigns
* Publicly-funded education, free to all Americans through the PhD level
* Expanded representation in Congress and a realignment of how seats are distibuted in both the House and the Senate
* Working with the UN and our international allies to rebuild Iraq and Afghanistan, as well as to address the ongoing genocidal conflicts in Africa and other parts of the world
* Removing obstacles to the civil rights of women, African-Americans, gays and lesbians, etc.
I could go on and on, but I think you get my point. A true “Left” would be much more radical in its demands than the center-right leadership of today’s Democratic party. How sad that we don’t have such an entity active in American politics. It would be a nice alternative to the “more of the same” crowd who dominate the Democratic party.

I’ve known this most of my life. I only said it because of your past and present comments equating religion with inequality.
We’re different physically, emotionally, and psychologically. In face, recent studies have proven that there’s even a difference between male an female brains. The way we process information is different.
To a degree, our brians are slightly different. But a degree of that is a result of cultural indoctrination during our formative years when girls are given dolls to play with and coddled, while boys are expected to be chin up if their Red Rider shoots an eye out.
In general, men have approximately 6.5 times the amount of gray matter related to general intelligence than women, and women have nearly 10 times the amount of white matter related to intelligence than men. Gray matter represents information processing centers in the brain, and white matter represents the networking of – or connections between – these processing centers. Simply put—there’s an existing physical difference that has nothng to do with the formative years.
Hence we have a generation of girls living in confusion—overwhelmed by the pressure of living up to ever changing expectations of who they’re supposed to be.
Did you just time warp out of the Middle Ages? Girls are NOT confused. Ask any high school girl what she wanst in life and she can tell you. It’s traditionalist like you who try to tell her she is confused… Stop and she’ll be fine.
How can someone who works with kids be so out of touch? There have been numerous articles written on this subject. Todays girls are more likely to get in trouble than the boys. They are more likely to be truant, they start drinking at younger ages than the boys, and they become sexually active earlier than the boys—to give a few examples. In addition, they are bombarded by media images, depicting woman to be smarter than men, hard-nosed and more determined than men, and even physically stronger than men. Women are depicted as being able to do and be everything, and this in fact has affected girls in our society. They’re confused and angry. To claim otherwise is just pure denial. One author went so far as to say we have a whole generation of girls gone wild.
I did do my research. I explained it already. Societies are better off when women aren’t stoned for being witches… Or told that they must give birth to a baby they don’t want… or call them whores for enjoying sex… or telll them that they came from some guy’s rib – whenthe reality is that the Y chromosome evolved from an X – to increase the ability for stronger species…
Going for the extremes and passing them off as the norm is only a caricature of the truth—a strawman—a sign of a failed argument. I’m also not impressed with your research. It seems more probable that you’re seeking and embracing humanist doctrine in an attempt to run from a God you refuse to acknowledge.

Secondly, while it’s nice to believe that our legal system would effectively handle the situation with the prisoners i Guantanemo, it clearly won’t. One of the main reasons that Bill Clinton did not ‘accept’ OBL when he was offered to the U.S. by the Taliban was that we did not have enough evidence to do anything with him/detain him…He was therefore able to plan an operation that murdered thousands of American citizens.
The vast, vast majority of prisoners in Guantanamo have taken up arms against U.S. forces, but are not loyal to any government. They are inessence loyal to a global terror network bent on the destruction of freedom and implementation of a global Muslim Fundamentalist Theocracy. They chose the wrong side in the War on Terror and now they are paying the price. I have no more sympathy or love for them than I would have for Hitler’s SS, the guards at multiple concentration camps or probably a more appropriate analogy, the pilots of Japanese Kamikaze aircraft…

Due process is meaningless to them, they don’t deserve the same rights that our citizens do. The use of the term is indicative of a belief in a Supreme Being…This is typical of the transcendentalist literary movement of which the founding fathers of this country would have been students/followers.
The founders clearly intended to indicate that rights were bestowed on all men by a Supreme Being, not their parents…

There have been numerous articles written on this subject. Todays girls are more likely to get in trouble than the boys. They are more likely to be truant, they start drinking at younger ages than the boys, and they become sexually active earlier than the boys—to give a few examples.
That conflicts with teh fact that more girls go to and graduate from college than boys. SO, your studies are based on an assumed morality and not on asking the girls any real questions about their happiness. Boy that double standard sure is convenient.
In addition, they are bombarded by media images, depicting woman to be smarter than men, hard-nosed and more determined than men, and even physically stronger than men. Women are depicted as being able to do and be everything, and this in fact has affected girls in our society.
They do the exact same thing to boys. It’s all about selling products…
They’re confused and angry. To claim otherwise is just pure denial. One author went so far as to say we have a whole generation of girls gone wild.
Your imposed morality again… How many girls do these studies speak with? I’d love to se your link. It sounds like religious-based excuses to oppress women at an even younger age by suggesting that hey have gone wild…

I have however seen both dogs and PArrots while attending science classes.
When younger we even had a school camp where we spent a week in the Highlands of Scotland and learned about ecosystems, wildlife and the like… If you are willing to count that as a science class then we definitely saw deer during that too.
So, I have seen dogs, and parrots, and maybe even deer, attending science classes. Does that cheer you up?

Let me deflate your theory. In my copy of the Declaration of Independence, many words are capitalized. It is very hard to imagine how your “proper noun” theory operates in the following: “But when a long Train of Abuses and Usurpations, pursuing invariably the same Object, evinces a Design …” Help me out with this.
I never noticed this before, but, I’m just scanning the document, and I can’t say for sure, but it looks like EVERY NOUN is capitalized (not the pronouns). It looks like German in that respect; every noun is capitalized. Every noun is capitalized, no belief in a supreme being indicated.
For what it’s worth, the D of I carries no weight of law. It was written long (more than 10 years) before there was a United States of America.

Yup, you’ve got it… We think that the US should treat everyone the same… It doesn’t matter if they are “foreign” or not. In fact the Constitution does not make that distinction. It specifically uses the term “No Person”, not “No Citizen”. Given that it uses both terms in different places then it makes sense that they are meant to mean different things.
A measure of true greatness is the ability to treat even your enemies the same way. The Constitution does not say that it only applies to citizens (actually, it does, but only in some small places, where it draws a distinction between people and citizens. Look at my earlier post for a good example.) The constitution applies to the United States dealings with all people. If the Constitution didn’t apply to non citizens then I could refuse to pay taxes on the grounds that the Constitution (which gives the government the right to tax people) doesn’t apply to non-citizens.
Don’t you find it scary that non-natives frequently know more basic civics than natives do? It might be because we choose to live here, so we care more about what the society we are living in is like.

Fox Reporter Ms .Malkin said ‘’BOO HOO’’ in regards to the 3 Suicides at ”Getmo” Bay Prison. Sarcasm and Ignorance is a dangerous combination, when its related to the ”Prison”.
When I was in Prison, I saw 2 suicides, one hanging in Rikers Island Nyc, one Throat slashing. Federal Prison. It took the individual who slashed her throat , two times to finally succeed. They put her right back in the same Solitary confinement cell, after stitching her up after the first attempt. I knew then, as I withdrew in my solitary cell, It was going to happen again.
I was there because I was Protesting the fact that a handful of whites were in a Lab tech. Program, the Hispanics were sewing pajamas for mental patients , and the blacks were in the Kitchen. It took me 18 months until the B.O.P Prisons said ”She’s not Violent” cant keep her. Give her the damn class, or she’ll ‘’sue”.
At 18 it made a difference. A 15 yr. old Drop out. I needed that class, when I got out on a 6 yr. sentence. I went on to BARD College, Nursing school, and Albert Einstein Medical college. Some fights are worth fighting, maybe dying for.
The responses were the same by the ”Prison” as Bush and his fake concern. After the suicides at the Prison, Until yet more deaths, and increases in violence in General Population in the Prison. Then Finally they closed the solitary confinement section.
Anyone that makes the comments that Malkin made has never been up close to it, been depressed by it, or sacrificed anything. Or lived with people that felt that a sacrifice had to be in order for change. Yes its extreme, but Its a statement that says. Something has, and Must change. Put Malkin in Prison just one week, take away her freedom, her loved ones, put her in a dorm with killers, and Animals from all over the USA. I must also admit I was doing that the last few days partly to procrastinate with some tax-related documents that had to be prepared by June 15. IF the prisoners are guilty of a crime – charge them and let them be tried in court before the world. If there is no evidence, let them go. It’s really that simple. This is a fundamental principle of our country.
Just like in Abu Ghraib, we detained over 5,000 people for over two years, and then just decided to (wait for it…) let them go. NO charges, NO court dates, NO apologies, nothing. We said they were dangerous terrorists for two years and then one day we said no they were not. This is not what a free country does, this what Soviet Russia or Communist China does. It’s a disgrace.

Really? No one? Not even Fox News? It may interest you to take a look at the websites of groups like Amnesty International and Human Rights Watch. Many of their current statements are directed at terrorists, regimes that sponsor terrorism and oppressive governments. Historically, they have led unending, uncompromising assaults against the regimes of Saddam Hussein, Ayatollah Khomeni and numerous others, notably even during times when the United States was providing some of these regimes with the weapons and know-how to kill their own people. They don’t care who you think you are.
Republican Senator Arlen Specter stated on Sunday regarding Guantanamo, “some prisoners are being held on the flimsiest sort of hearsayâ€. And he was putting it politely, compared to say, the British government, who now virtually demand that Guantanamo is shut down. At least Senator Specter has the courage not to ignorantly defend the indefensible.
Many/most Americans have no idea about the dubious nature regarding the circumstances of why many people ended up being tortured in Guantanamo. Many people arrived in Guantanamo because they were denounced by neighbors and personal enemies… for cash rewards.
The Tipton Three were realeased from Guantanamo Bay Prison after two years of torture… released after the British Secret Service informed the U.S. government that the three were actually still in Britain at the time they were supposed to be having meetings with Al Quaeda. The British government was obviously so worried to have them back in Britain, that it sent the police (not secret agents) around to question them for a couple of hours. The police, who had already spoken with the Secret Service, reported that they could find nothing to suggest that they were a danger to British society.
Guantanamo is a total disgrace and a PR catastrophe for the United States. The existence of Guantanamo Bay Prison is the real threat to the safety of Americans. Its’ existence is a recruiting magnet for terrorism worldwide. To allow your enemies to exploit an appearance, is stupid. To hand it to them on a plate is madness. To actually become like them is suicide.
What sets us apart as Americans is our not our INability to make mistakes, but our ability to acknowledge, investigate and set wrongs right. Without that, we are nothing. If anyone thinks they are being patriotic or defending America by pretending we are ‘goodness and light’, they are at odds with the American way. We make mistakes, we acknowledge them, we fix them, we move on. That takes courage and it’s what (should) set us apart from Sauda Arabia, Egypt, Syria any other number of other countries.
Personally, I used to get a kick out of being different from odious regimes.
Forget muslims – not even the people of Britain (where I now live) believe that the United States stands for anything at all, let alone freedom and democracy. This movie (below) is being released on June 23rd. Love it or hate it, agree or disagree, it’s the first of many that millions or billions of people around the world will see. It’s the United States looking like Nazi Germany. The legacy of this will live on for the next fifty years or longer. Actually the revolutionary war was largely started over a riot to do with taxes, and indeed the slogan “No taxation without representation” actually comes from the Boston Tea Party. It’s not about my team vs. your team. It’s not about the war on terror. What this is about is the fact that many of the detainees in Gitmo are very possibly not guily of a thing and there they sit. In doing crap like this, we become more like the actual terrorists we despise. We lose our humanity and raise our “cause” to the status of justifying anything we do. If the situation were reversed and possibly innocent Americans were being detained, there would be hell to pay. What if it was your son or husband or father? If there are legitmate terrorists, flush them out and punish their asses to the max, by all means. I am not saying let them go or go easy on them. But this is not a black and white issue and requires more than a bare basic thought process, which requires mental work, which most Americans are too damned lazy to do unless American Idol or Survivor or something else of such high relevance is at stake.
As far as giving terrorists what they want by closing, Gitmo, etc.., well, if they despise our freedom as Bush and the cons claim they do, then isn’t Bushco doing more to aid the terrorists by tearing down our freedoms bit by bit? Do you numb-skulls realize that YOU now live in a country where YOU can be picked up with little or no cause, detained in secrecy and indefinitely without being charged, have no right to contact an attorney or family members or anything? YOU can be spied on in numerous ways without a warrant at the government’s whim. If you trust the government to utilize that option only for legitmate purposes, then you are naive or nuts. But if we recognize a moral equivalence between a US citizen, a Mexican immigrant, and an Al-Quaida operative held in Gitmo, then what’s the value of US citizenship?
If the detainees are held as combatants under Geneva Convention, and it appears that they are (see my previous post), then they are POWs, but no easy Constitutional equation can be made between just any “person” and a POW–otherwise the US would never have been able to set up POW camps in any of its previous wars.

True, however once somebody is a POW, they do retain certain rights. That’s the problem facing the US today, that those rights aren’t being enforced, further, not everyone being held is a combatant, some are just people who attended protests, said they didn’t like the US, or just had greedy neighbours who didn’t like them.
When you employ the same tactics as were used to hunt witches in the middle ages, and Jews in Germany, you are bound to get quite a number of innocents mixed in with the guilty, and frequently the guilty are the guys whose neighbours actually do like them, making the issue even harder to solve.
There needs to be some investigation done before this issue gets worse, a lot needs to be brought to light because right now, because we don’t know what the heck is going on on Gitmo. All we know is that really horrifying pictures and stories are coming out of there, and that tends to make us all feel like there is a lot worse stuff still to be released.

And Coulter’s book is already being discounted, while supposedly number 1 (A lot of the “sales” already go to her friends, who buy up the book to help it to get to “number one.” I have even been offered a free copy on one website.) In Stalin’s Russia, anyone who disagreed with the party in control could be sent to the Gulags (Prisons) never to be heard from again. No Lawyers, no due process. This is what you want America to become? What’s next, gas ovens for the traitorous Liberals?

Chris, inre to comment #360; I doubt that Bush would be re-elected today, if a vote took place and an HONEST count were taken. However, I do believe that it would be closer than Kerry 63% Bush 37%, more like 51% to 49%, as people bitch and moan about change, but when it really comes down to it, they really don’t like change at all.

It’s been years since I saw a board as polarized as this one. “Liberals all suck and should die.” “Right-wingnuts have no soul and are already dead.” “He broke my dolly!” “She took my lollipop!”
Let’s give the kindergarten antics a rest, shall we?
Just to clear the air a bit, the “Christians” that you hear about most of the time are the nauseatingly vocal minority, and in this one man’s opinion are not, technically, Christians at all. Anyone can call himself a Christian. There is no entrance exam. Does it not say that you will know them by their fruits? Most of us are a good bit more laid back, and I daresay most of us take our Lord’s commands to love and do good to others seriously. My favorite OT verse is from Micah: “You have seen, O Man, what is good. And what does the LORD require of you but to do justly and to love mercy and to walk humbly with your God?” That works for me. Humility seems conspicuous by its paucity these days, especially in the current Administration.
A couple of topics got mentioned that quite often “get my back up” as the saying goes around here. I’d like to address them, if I may.
#1 – Gun control: bad idea. As was pointed out somewhere above, the whole point of the 2nd Amendment was to safeguard the other Amendments. While I do not own a gun myself, I strongly support the rights of any law-abiding citizen to protect himself. There were well over a hundred million people murdered by their own governments in the 20th century, and, amazingly, not a single gun-ban proposal would take guns from the government and give them to the victims.

#2 – Gay marriage: Not a problem. The fact that the gay community so vehemently works for this goal simply means that they recognize it as the gold standard, just as do most heterosexuals. If a gay or lesbian couple wants to form a life-long relationship (and a LOT of them do) it would seem to me the sensible thing to do to make it all nice and legal. Of course, there are other instruments that can accomplish the same thing, but it’s a total hassle to have to jump through all those hoops when a simple decree of marriage will suffice.
(If there is anything that represents a threat to marriage, it is the easy availability of divorce, not gay couples wanting to formalize their love for each other. I mean, get a life, people.)
And please, let’s not hear any more about how homosexuality is some sort of “willful perversion”. Sexual orientation is largely determined by the concentration of certain hormones in the womb. One’s early upbringing may have an impact on when and how this manifests in an individual, but the vast majority of gays are gay because they were born that way. As a friend of mine so pithily put it one time, “Choice? Are you nuts? Do you honestly think anyone would choose this lifestyle?”
