Delay asks Justice Scalia to remove him from ballot.

“The Texas Republican party asked the Supreme Court on Monday to block an appeals court ruling that says the name of indicted former House Majority Leader Tom DeLay must appear on the November ballot…The case was routed to Justice Antonin Scalia, who handles appeals from the 5th U.S. Circuit Court of Appeals.”

UPDATE: Scalia denies DeLay’s appeal. That was fast.

    Birds of a feather flock together. DeLay and Scalia certainly add credibility to that old saying. Watch for Scalia to stay reverse lower court decision and rule in DeLay’s favor.

    Sometimes the law is just clear. Even though the GOP tried their best to ignore it, they are not the President. Only the President can break the law and get away with it in court.

    I guess this brings new meaning to the phrase “Justice DeLayed is Justice Denied”, but I’m not really sure what.

    1) DeLay doesn’t want to go back to Congress. This messes up his plans for lobbying or working in whatever bogus foundation he was planning for.
    2) He’s already resigned, so he’s not likely to get any committee leadership positions, even if seniority rules would still allow it.
    3) Can he still use campaign funds from before that he has since transferred over to his legal defense funds? Who’s going to want to donate to him, knowing what happened to earlier donations? Some of those people probably have hit their limit on donations to him, and their money went to his legal fees instead. On top of that, he still has huge legal expenses to pay, and he’s got the distraction of having to work on his defense while running for an office he doesn’t want.
    4) In the meantime, ongoing investigations still get into the news and mention his connections to people who have already been convicted.
    5) This isn’t a good situation for Tom. He’ll plaster that big phony smile across his face and try to psych everyone into thinking he’s in the catbird seat, but he’s screwed.
    6) Even if he wins, he may not get to serve much, if any, of his term. I don’t think they’ve set the trial date, yet, since they were waiting for the appeals to be finished.

    So the Dems want to run unopposed? Is that the only way they can win? Oh I remember studying this type of “democracy” in school, it was/is used in countries that are communists. Yes they get to “vote” but there is only one name on the ballot. Good job of the Democrats shedding their facade of being in favor of democracy.

    #26 the issue is texas ellection laws, Delay and the GOP are trying to skirt the law ( typical for the GOP ).

    Even Scalia has to rule according to the law ( the way it is written ) and texas election law is clear on this point.

    Delay screwed up and created this mess himself, can’t blame the Democrats for this one hahahahahaha

    Nice try but progressives just want the laws of the land to be followed and for our politicians to be honest. Delay does neither. He ran in the primary for reelection so he could still get campaign contributions so that they could be funneled into a legal defense fund. He does not care about the election itself. Republicans could have chosen someone else to represent them through the primary. They didn’t. It’s their problem. They have to live with it and not try to blame the Democrats.

    The Supreme Court will follow the orders of the GOP because they accepted the oil shares as payment. American now have no System of Justice as the members have been brought and paid for by the corrupt GOP. Abramoff and Cunningham will take their cases to the GOP Supreme Court and the court will set them free. Oh and look for the civil rights bill to be over turned as the US will need slaves again. Think about it fighting for a country that say thanks now your a slave again.

    I find it a lot more honest to have one name on the ballot for an election than it is to have two or more names on the ballot and have the voting machines and vote counters fixed so that only the votes for one candidate are counted. At least the honest crooks are honest about being crooks. The repug motto “I am not a crook.” still applies and still riles people like you who are not blind but yet refuse to see.

    #20, I heard some interviews with quite a few diehard Delay supporting Sugarland residents, who seemed unmoved by/deaf to any allegations of wrondgdoing. They seemed completely blindsided by how much money he brought to the district, the power he wielded, and his hollow “righteous” talk. Unfortunately, I gather he’s probably about as popular as if he never tried to build up a campaign war chest by running in the primary (a/k/a building up his legal defense fund) and then splitting for Virginia.

    Isn’t this just a formality? Didn’t Scalia just do DeLay a favor by providing a judgement on the stay so quickly? Scalia didn’t say that the Supreme Court can’t hear the case, just that the stay wasn’t valid. By taking such a short amount of time to come back with a decision, the case can move forward to the court with less.. >groan

    Thanks, but Grandma learned about our meeting last week and she may be suspicious. However, if Keith is kicked out let me know. If Virginia is kicked out it is obvious a Bushco plot and ploy so call Scalia. If Heather goes the rule for Virginia applies.

    To stay honest I must comment on the thread and in a non-sarcastic manner (I know it is difficult, dammit!). The significance is not what happens during the election, the significance is what happened today and the speed in which it happened. The scrotum of the SCOTUS has just done a big CMA (Cover My Ass). He finally realized that his tenure on the SCOTUS was no longer than that of Queen George the Dumb in the White House. We have just witnessed the first tremor in the fall of the house of corruption.

    First the SCOTUS rebuffs Bush on Guantanamo, then Scalia takes DeLay to the woodshed. Gosh, Bush’s robot court seems to have grown a mind of its own! Eeeek! So much for all the scare-mongering about Bush filling the courts.

    There are not too many of us around that remember the terror attached to a trip to the woodshed. It is a shame too, because fear of punishment many times overwhelmed the greed associated with instant gratification, as it should be. It is also a shame that the whole concept of authority requires responsibility has been lost on modern day politicians. The only law they will obey is the law of a shyster divorce lawyer arguing for the vengeful and greedy soon-to-be-ex-wife: “What is mine is mine and what is yours is mine too!” (Apologies to Marie, Trueblue, Unbelievable, and Zooey, et al) Remember, we are talking metaphor.

    I’m amazed that Scalia made the correct decision, but he did in this case. I wouldn’t necessarily take this as an indication that Scalia has suddenly decided to be ethical, but I’m glad that he followed the law this time.

    #26 – Good attempt at spin, there. The Democrats feel that the election laws should be upheld. I can only assume that you don’t agree with that. Of course, you are a Republican, so election laws aren’t all that important to your kind.
