Bill authorizing warrantless wiretapping stalls.

“President Bush’s support proved insufficient to push a bill authorizing his warrantless wiretapping program through the Senate Judiciary Committee Thursday.” The bill stalled after Sen. Russ Feingold (D-WI) “spoke against the bill for about a quarter of the panel’s two-hour meeting and offered four amendments.”

    Russ Feingold sums it up well. From the article:

    “The president has basically said: I’ll agree to let a court decide if I’m breaking the law if you pass a law first that says I’m not breaking the law,” Feingold said. “That won’t help re-establish a healthy respect for separation of powers. It will only make matters worse.”

    Feingold is being constructive by proposing amendments to the bill to make it less onerous…but predictably, the Repubs call it ‘obstructionism’. Sen. Arlen Specter sez:

    “We have seen the incipient stage of filibuster by amendment. Filibuster by speech, filibuster by amendment. Obstructionism.”

    I had no idea that you could ‘filibuster’ in so many imaginative ways, Arlen. According to you, anything that departs from rubber stamping a bill is ‘filibustering’ and ‘obstructionism’. God forbid the legislative branch actually does its job…

    President Bush’s support proved insufficient to push a bill authorizing his warrantless wiretapping program through the Senate Judiciary Committee Thursday.

    Sen. Arlen Specter, the committee’s chairman, said the bill stalled because of election-year obstructionism.

    “We have seen the incipient stage of filibuster by amendment,” the Pennsylvania Republican testily declared as he called off a vote to move his bill to the Senate floor. “Filibuster by speech, filibuster by amendment. Obstructionism.”

    The target of his ire was Sen. Russell Feingold, D-Wis., who spoke against the bill for about a quarter of the panel’s two-hour meeting and offered four amendments. . . .

    Opposition to the bill was no surprise. Feingold and five other senators, three of them Republicans, wrote Specter a day earlier complaining that a new version of his bill should be studied further before the panel votes.

    Forced to delay his committee’s vote, Specter grumbled that without his legislation the White House would continue its domestic wiretapping program virtually unchecked by the courts.

    One such measure, backed by a group of moderate Senate Republicans, poses the biggest threat to Specter’s bill because it would impose tighter restrictions on the administration’s power to wiretap. The House, too, was considering a measure that would impose tougher checks on the president’s power.

    Here is what ticks me off so much.

    Forced to delay his committee’s vote, Specter grumbled that without his legislation the White House would continue its domestic wiretapping program virtually unchecked by the courts.”

    He admitted that he knows they are breaking the law.

    Specter, when you took the oath of office, you swore to protect the Constitution!!!!, not a bunch of Crooks. They are commiting not only midemeanors, but Felonies. It is YOUR job Spector, to investigate and foreward charges if wrongdoing is found to the house of representatives. Your job not only as chairman of the judicial committie, but as a US Senator that swore to the oath of office.

    Enforce the Law, Enforce and protect the Constitution, Oathbreaker!!

    The only reason Bush wants to do an end-around FISA is because FISA would leave a paper trail and accountability. It is plainly obvious that that is the very thing Bush is trying to avoid. FISA grants about 99% of the requests it recieves. Looks like our Fuehrer doesn’t want any constraints on his fishing expeditions. After all, how are you going to maintain party loyalty without a little blackmail? And how can you keep the Democrats down without “getting the goods” on them?

    Oathbreaker is what he is. Every rubberstamp representative in the house and senate, that have let this travesty go one, while the PNAC group has been raping the US , the Constitution, but other countries as well, in there well documented but ignored by the MSM plans for a Pax Americana world ruling empire.

    Like pinky and the brain, they want to rule the world, and Bush is definately not the Brain.

    Feingold is my hero. I met him in Los Angeles two weeks ago at a party. We briefly discussed the NSA spying issue. Not in any real depth as it was a cocktail party and too loud and crowded for any substantive talk. But I was even more impressed with him after our encounter.

    And 7/8 Wayne, I was thinking the very same thing as I read your post — send it via fax to Spector. (emails are too easy and letters get delayed for examination). We need to give this issue the same passion as the blogosphere has given the ABC 9/11 mini-series. This week’s effort on the part of Think Progress, Aravosis, Kos, FDL etc has really demonstrated the power of the blogs to get a story out to the major media and politicians and have an effect.

    “…this administration…” is correctly translated as Cheney and his cabal. And Spector doesn’t rat’s ass because he will probably retire. If he doesn’t voluntarily retire, then the voters of PA will retire him.

    Good for Feingold. The Repubs are afraid, they are very afraid.

    As I recall, Congress cannot make a law that overrules the Constitution. Arlen Specter cannot outlaw the 4th Amendment! Bush is a criminal and no amount of legislative sleight of hand will change that.

    very true.

    No matter what Congress does short of State ratified Constitutional Amendments, the wiretapping, extraordinary rendition, “special” justice systems for enemy combatants are not Constitutional.

    Article II does not apply. We have a secret (OK not very secret for anyone who is paying attention) dictatorial coup on our hands…..and language that projects the dictatorships own faults (insinuating that liberals or Democrats are fascists – no, they’re not in power).

    When the Democrats wind this fall, there need to be some corrections on foreign policy, separation of powers….and/or jail time for the Emperor-wanna-be.

    Thank you Mr. Feingold. Now here, ladies and gentleman, is how a true Senator should serve his country. Russ is acting for the good of the country and for those who live here. Senator Spector is a good example of someone who is NOT doing his job to protect the people … he is protecting only this administration.

    This is WHY Russ stalled this rotten sticken bill:
    Right now, this administration is spying on anyone they choose (with no oversight) without a warrant from the FISA court. Anyone meaning political rivals, peace groups, or anyone else they care to. They have to get a warrant from the FISA court to tap phones – this is the law. They are breaking the law by refusing to get a warrant. Russ, just like everyone else would like to stop terrorists from their dastardly deeds, and tap those who are suspect in order to stop them. So why, if they are only tapping terrorists calls, do they refuse to get a warrant? What do they have to hide?
