A group of conservative lawmakers, led by Armed Services Committee Chairman Duncan Hunter (R-CA) and Judiciary Committee Chairman James Sensenbrenner (R-WI), called on House Government Reform Committee Chairman Tom Davis (R-VA) to once again investigate former National Security Adviser Sandy Berger’s handling of classified documents.
For a Congress that has conducted “only minimal oversight” of the Bush administration, the move to investigate a former Clinton administration official long out of office is both misplaced and a waste of time. In a letter objecting to the investigation, Rep. Henry Waxman (D-CA) wrote:
The Berger incident is not new, and there is no conceivable standard under which it would be considered a vitally important national security matter. As you know, the Justice Department thoroughly investigated the incident in 2004, and Mr. Berger pled guilty in April 2005 to a misdemeanor charge of taking classified documents without authorization. At the time of Mr. Berger’s please, Noel Hillman, the chief of the Justice Department’s public integrity section, said Berger “did not have an intent to hide any of the content of the documents.”
Instead of pursuing a politically-motivated, dead-end investigation, here are some legitimate national security issues over which Congress should be exercising its oversight:
– The release of an intelligence estimate that paints a “grim” picture of the situation in Iraq which is being suppressed by the Bush administration
– The White House’s role in manipulating intelligence about Iraq through their pre-war public statements
– The National Security Agency’s warrantless wiretapping program
– The complicity of senior administration officials in the torture and mistreatment of detainees

If our concerns are substantiated, it would appear that Bilbray broke the law in the very district whose past representative is now in federal prison for betraying the public’s trust.

In December of 2005, Bilbray’s children testified under oath that they lived in Virginia with their father. The context was a lawsuit in which Bilbray claimed his children were out-of-state residents who deserved to pay the same tuition as undocumented immigrants who lived in-state. A few months later, he signed a formal declaration of candidacy to run for Congress (2/23/06), citing his mother’s house on Unicornio Street in Carlsbad as his residence.
Throughout this entire period, he was receiving a homeowner’s tax exemption on his property in South County’s Imperial Beach, where neighbors had spotted him in the community ever since he began to run for the North County seat

Berger admitted last year that he deliberately took classified documents out of the National Archives in 2003 and destroyed some of them at his office. He pleaded guilty in federal court to one charge of unauthorized removal and retention of classified material and was fined $50,000.

“It’s important that the House conduct its own review to ensure there is a clear understanding of the facts, and sensitive and highly classified security information is not potentially compromised in the future,” Kasper said.
Berger’s lawyer, Lanny Breuer, did not immediately return a call for comment. A spokesman for the Government Reform Committee said the panel was reviewing the letter.
At issue is a strange sequence of events in which Berger admitted to sneaking classified documents out of the National Archives in his suit, later destroying some of them and then lying about it. The Bush administration disclosed the investigation in July 2004, just days before the Sept. 11 commission issued its final report.

On two separate occasions, in September and October 2003, Sandy Berger took a total of five copies of a classified report from the National Archives. The document, an “after-action memo” written by Richard Clarke, was about the failed “Millennium plot” to blow up part of the Los Angeles International Airport during December 1999.
Berger destroyed three copies by cutting them up with scissors. He kept the other two copies, but returned these after being contacted by the Archives. Staff at the Archives had been monitoring an unusual pattern of activity during Berger’s visits and (the Washington Post reports one source as saying) had “specially coded the papers to more easily tell whether some disappeared,” after noting some had previously gone missing.

Hey Walt that is not what happened. THAT’s how they knew documents were MISSING.
Staff at the Archives had been monitoring an unusual pattern of activity during Berger’s visits and (the Washington Post reports one source as saying) had “specially coded the papers to more easily tell whether some disappeared,” after noting some had previously gone missing.
So the documents were being removed. He was not just going to a copying machine and removing copies. He was removing documents.

Of course documents were removed. Documents that were copies of other documents that existed (and still exist) somewhere else. Even the lead prosecutor in that case said so:

“Those documents, emphatically, without doubt — I reviewed them myself — don’t have notations on them,” Mr. Hillman tells us. Why don’t you close your business for the holiest of my holidays? The government displaying a 50 foot cross is a very clear statement that this government is a Christian organization. Insisting that the 10 commandments be displayed in a courthouse is to demand that the courts be Christian. If the courts are Christian then Christianity must receive preferential treatment.
