Therefore, if it is legal to buy in Iraq and legal to bring back to the States then where is the legal violation. Trust me, this issue was investigated at length by the Staff Judge Advocates office to ensure service members were not violating the law. 

But you did show something here. You obviously have not read anything about the case other than maybe Michael Moore&#039;s side. Try going back and looking at all the information before you call something a  frivolous lawsuit. The Sgt tried to get an apology before hireing a lawyer. After being stonewalled, he decided to up the stakes in order to get that fat ass that wanted to use his image and words to at least recognize the mistake and misquote. As far as I know, Michael Moore still will not comment on the case. I guess he is above apologizing to soldiers. We are just there for his conveniance.

Things that need to be concidered are (1)the fact that the Sgt took steps to gain a simple apology (2) the Sgt was undergoing recovery from his wounds and (3) The Sgt fulfilling his military duties. 

Keep in mind that this soldier was shown, out of context,  denouncing the United States military action in Iraq and attacking President Bush. Both of these are chargable under the Uniform Code of Military Justice. So, Moore, for his own desires not only damaged this mans reputation but threatened his livelyhood.

He has pride in his country and despite his disability, he has no regrets in his service to our Nation. He is truly an inspiration to all who meet him. He will continue to serve just as long as he is allowed to. The footage of my husband is pretty graphic, It&#039;s amazing he survived. Ironically it was the body armour that saved his life, the body armour that Kerry voted against. He lost his right eye, hearing in his right ear, loss of sense of smell and is legally blind in his left eye. He says &quot;Our country is still at war and I will not leave the military without a fight.&quot; I don&#039;t think this is what Michael Moore was expecting to hear from this bloody injured Marine he used for quite the opposite effect. Just because many of us respect and admire Michael Moore doesn&#039;t mean that if he messes up we won&#039;t call him on it.  

I guess you&#039;re on the moral high ground, Robert, since you&#039;d rather put money in the pockets of criminals than a law abiding filmmaker.</description>

The good Sgt Damon would have been happy for a simple apology but kept getting stonewalled while Moore kept lining his pockets using the good Sgts name. Just because NBC sold the rights to Moore does not give him the right to take statements out of context and twist them to meet his own agenda.</description>

Let&#039;s face it, the guy gave NBC permission to use the footage. NBC sold the rights to Mr. Moore. It&#039;s not like Moore had a secret camera and video taped the guy without his knowledge.

The only &quot;truth&quot; in your link, robert, is that the guy found a lawyer two years later who would file a lawsuit on his behalf. I&#039;m sure if you looked for two years, you could find a lawyer to take on just about any case, especially if you paid him or her up front!

Personally, I&#039;m wondering if the attorney involved got sanctioned for filing a frivolous lawsuit. I also wonder if this suit has the financial backing of any of the right-wing groups that financed the Paula Jones litigation against Clinton.
