Taliban: Execution will intensify jihad
SPIN BOLDAK, Afghanistan (Reuters) — A top commander of Afghanistan’s Taliban said on Saturday that the execution of former Iraqi leader Saddam Hussein would galvanize Muslim opposition to the United States.
Mullah Obaidullah Akhund, a former Taliban defense minister and top insurgent commander, also said Saddam’s execution on the Eid al-Adha Muslim festival — marking the end of the annual pilgrimage to Mecca — was a provocation.
This mockery of law
The Iraqi Higher Criminal Court that passed a death sentence on President Saddam Hussein is a farce. Not only is it grounded on illegality (occupying powers under international law are expressly prohibited from changing the judicial structures of occupied states[iii]); the trial itself stands distinguished in legal history by its sheer number of due process and international standard of fairness violations.[iv]
These violations have included, often with systematic effect: American imposed censorship of court proceedings; withholding evidence from the defence; forcible ejection from court of defence lawyers and the placing of defence lawyers under house arrest; denial of defence counsel access to defendants; blatant lack of impartiality of court judges; overt political interference in the selection of court officials and the prejudicing of the trial and trial outcome by statements made by invested political figures — including George W Bush — affirming progress towards, or demanding, execution; the replacement of four of the five originally selected court judges; lack of equality of arms between the prosecution and the defence; refusals to accept key defence team submissions, especially motions challenging the competence and legality of the court; violations of key fair trial principles and standards and international humanitarian law[v]; violation of Iraqi law[vi]; intimidation of witnesses; failure to ensure the security of the defence leading to the murder of three defence lawyers.
Created by Paul Bremer, the Iraqi Higher Criminal Court was never anything but a US-orchestrated puppet court.[vii] The imposition of a death sentence after an unfair trial stands in direct violation of international law.[viii]
The truth about this court
From day one, this court has been nothing but a smokescreen: an attempt to establish a veneer of legality to an illegal invasion of a sovereign state. From day one, the final conclusion — the illegal execution of Iraq’s lawful president — has been a fait accompli. The only question has been when.
As 2006 ends, the United States is desperate. Defeated militarily on the ground, long defeated politically and morally, the occupation is preparing to open the year 2007 with a barrage of atrocities, including the open murder of Iraq’s lawful president. This, like all other US-authored atrocities in Iraq, will not allow the US and its criminal partners to impose on Iraq a future that is contrary to the fundamental interests of the Iraqi people.
The imminent execution of President Saddam Hussein is a challenge to the world. Its occurrence would mark a watershed in the imposition by force of a global state of exception to law and to international standards of justice and due process.
States are obliged to protect international law and oppose acts that undermine it.[ix] International law is the arbiter and final guarantor of world peace. When states cannot or fail to act to protect it, or when they act resolutely to destroy it, it is the duty of citizens everywhere to oppose global tyranny by direct action.

Anger simmered in the Arab world over the decision to execute Saddam on the holiest day of the Muslim year.
While his victims, their relatives and the US rejoiced at Saddam’s demise, many Muslims questioned the wisdom of killing the former dictator at the beginning of Eid al-Adha.
Leading Sunni Muslim Arab power Saudi Arabia criticised Iraq’s Shi’ite leaders for executing Saddam, saying his trial had been politicised.
“There is a feeling of surprise and disapproval that the verdict has been applied during the holy months and the first days of Eid al-Adha,†a statement read by the presenter of the official al-Ikhbariya TV said.
“Leaders of Islamic countries should show respect for this blessed occasion … not demean it.â€
Many Arabs said his hanging for crimes against humanity was provocatively timed to coincide with Eid al-Adha and would worsen violence in Iraq.

President Saddam Hussein is a prisoner of war with protected status under international law. Further, he is the lawful president of the Republic of Iraq. He cannot be executed legally by this occupation.
Under the Interim Constitution of Iraq of 1990 — which remains in force despite the illegal imposition of a permanent Iraqi constitution written by the United States — President Saddam Hussein, like heads of state worldwide, including in the US and Europe, is afforded sovereign immunity to prosecution.
That the US invaded Iraq illegally and established an illegal political process and a quisling Iraqi government only exacerbates the violation of President Saddam Hussein’s personal and sovereign rights and the affront to the whole of Iraq. His imminent execution is an attempt to establish, de facto, a global state of exception to law. Force cannot make just what law denies.
I’m sure glad Dumbo believes in fair trials. Dumbo, just be prepared for your impeachment trial.

BAGHDAD, Dec. 30 (IPS) – New divisions appear to be opening up between Iraqi political and religious leaders following the execution of Saddam Hussein Saturday.
Corpis is completely right about the illegality of the trial, the denial of due process, and I would add to that the insanity of an “appeal” which occurred in thirty days on a capital case. If anyone cares to recall, the Nuremberg War Crime trials were held at the Hague, in an international forum, and the Nazi criminals could be said to have committed crimes equally as heinous as Saddam’s — perhaps more heinous since he was only tried for his killing of a group of people in 1982, whereas the Nuremberg trials encompassed a far greater scope of death, torture, and evil than was presented at Saddam’s trial.
Those people got due process — not a trial where their lawyers were serially murdered, and the judges essentially took turns and rushed to finish before the next assassination.
We didn’t achieve a single useful goal for democracy with this “trial” and execution. This is not the model about justice and democracy we want the rest of the world to remember and imitate. It was Texas posse and hanging — frontier justice.
We are in a ridiculous situation. Our president is morally bankrupt and criminally insane. This is indisputable; all we have to do to see it is open our eyes and look at what he is doing. Bush defiantly continues to break innumerable domestic and international laws of basic ethical human behavior. The US helped the people of Iraq by removing a deadly dictator and help establish a democratic government. A government the people of Iraq voted for. The people, via government judicial system, tried and convicted the “Bucher of Baghdadâ€, and he hung for his crimes. This is a good day for Iraq and a good day for the USA.

And yet, Nancy Pelosi and the Democrats have no intention of impeaching Bush. What is wrong with this picture? What does this tell us about Nancy Pelosi and the Democrats? If they don’t hold the Bush administration accountable for their endless crimes against humanity, Pelosi and the Democrats are complicit in the madness and criminality that is being perpetrated by the Bush administration. -The government is not unified and the Prime Minister of Iraq is not who the people voted for. Iraq is basically run by different militias.
I know Saddam’s been dead for close to 24 hours now and that we should move on to other things, but I couldn’t help make an observation that gave me pause.
One of my commenters just said that “it wasn’t an execution; it was a performance”, which just about perfectly says it all.
I agree completely with your position on bushco. I would suggest, however, than you go easy on Nancy and the Democrats. They, officially, have not yet taken over from DUHbya and the Right Wing-Nuts. Talk of impeachment at this point in time is accepted, expected, and mandated for you, I, and our kindred souls. Such talk, until next week is inappropriate, for the incoming 110th Congress members. Let them get sworn in, settled down, psyched up. and started out. Then, Brothers and Sisters, the Choir will start singing to the Preachers. Could you explain how the huge american embassy US is building in Iraq or the 10+ permanent military bases are related with the democracy of Iraq? Could you also explain why the iraqi Ministry of Oil was the most protected building in Baghdad after the US forces entered while the city was left for the looters?
I hadnt seen the video of Saddam´s execution. One question, why are those guys putting the rope around his neck have their faces covered? Sure, sounds like a really legitimate hanging. Whatever that means.

If Saddam did what he did,according to Bush with solid evidence, what other arena would be better than an international court to document all what he did? what better place would be than international court so the whole world can see this? We did that for the Nazis in Nuremberg. If the US media spends a year long coverning O.J.Simpson trial..I think such trial of Saddam would have been worth watching by the world to see how compelling the reasons Bush gave to go to war. But such court might have put the Republican administration in uncomfortable position being supporters of Saddam and his regime in the past, during the Iraq-Iran war,under Reagan/Bush administration,because they might ask some US officials like Rumsfeld and others to testify before the international body.

When I think about, politicans aren’t very decent folks. Money is soooooo tempting to them. At least Gerald Ford was a likeable guy. Granted, too many things were not so likeable but his exterior was likeable. Nixon had mental problems and was a nasty guy. Again, though, being a politican is a pretty nasty profession. Being truthful and honest is not part of the job.
I’ve watched a little of the TV coverage tonight. Just a little. Why do our elected representatives spend our tax dollars buying Cadillacs? A lot of the cars are Cadillacs. There are a few Lincolns, a few Chrysler 300s, and a good sampling of big SUVs. Do our politicans deserve Cadillacs? Why can’t they ride around in a Chevrolet Malibu?

If the democratic congress is unwilling or unable to hobble this administration and our madman leader,I do believe it will take a number of “Extremely Patriotic” events to wake this country from its downward spiral. Yes we had elections and yes we won…so what? I agree we need to see what the new congress has planned but if still nothing changes it is OUR constitutional duty to force change in any way possible.

Perhaps America is about to witness a far more serious impeachment than Nixon was threatened with. Nixon’s crimes were not directly connected to war crimes and death, although the bombing of Nicaragua’s harbors and the arming of the Sandinistas certainly approached war crimes.
Now we are witnessing a President who blatantly and flagrantly committed war crimes and boasted about them, proud of them, claiming he did them to protect Americans.

I do believe we are about to enter interesting and volitle times. Never in my life have I heard more people in private say what they would love to happen to our president. I also believe that so many are on the cusp of action,they are just unsure if they are alone.

I still believe that human beings when faced with the reality of pain are moved to do something, with certain exceptions.
I believe, sociopaths like Bush and other mafioso types, live in a world of double talk where pain is quickly turned into profit, and the person quickly forgets any momentary winces. Money can soothe any pain, especially conscience. The upper classes have felt special and exempted from the pain and suffering of the rabble of mankind.

I’m curious as to how many readers here know what Saddam Hussein received the death penalty for. I’ve been asking people today, strangers on the streets of an affluent, well-educated major metropolitan city, and none of them knew what the trial that found him guilty was about.
If you think it was for gassing the Kurds, it wasn’t. Hussein’s execution ends that trial, which had begun in August, 2006.
If you think it was for draining the marshes, killing the marsh arabs, it wasn’t that either.
If you think it was for killing Kuwaitis or Iranians, no, that trial hadn’t begun.
Saddam’s Ba’ath party threatened to retaliate if their ousted leader was executed.
A statement posted on the internet said: “Our party warns again of the results of carrying out such a verdict on the situation in Iraq and America in particular … It is the most dangerous red line that the American administration should not cross.â€
All the industrialized nations of the world compete for the oil available, so it does not matter if the US technically gets oil from Iran or not. So if a war with Iran caused all the oil from the Persian Gulf states to be cut off, then oil availability worldwide would be reduced by at least 30%, which means an extreme price increase for gas at the pumps in the US.
That would mean gasoline skyrocketing to $6 to $10 a gallon, and rationing of gasoline, if the oil was disrupted from the Gulf region more than a couple of months. The Bush Regime seems to desire anarchy for America too, because this would cause our economy to collapse and loss of jobs, so another “Great Depression” created by Bush Junior!
I just viewed an uncensured video of Saddam being hanged. Apparently somebody smuggled in a video camera to film it secretly. It’s a shocking film to watch, because what the press has been showing was doctored footage. This bootleg copy will eventually be seen worldwide and all hell is going to break loose. The raw footage got posted on AmericaBlog.com thread a short while ago. Bush has just ignited the beginning of WWIII > stockpile food, water and cash!
Nobody really mourns Saddam. He was no longer important for anyone, he was powerless because of the invasion/capture and was never a Sunni leader (in any reigious sense). Shiites cheer both Iraqi and Irani. I don’t know if the Kurds do, because they really didn’t get to tell their complete story.
There are oddities about the events of the past several days and about the trials themselves. The trials do not measure up to the integrity expected from international law regarding crimes against humanity and they are tainted by revenge.
For the Kurdish trial, one can only suspect that Saddam’s lawyers would have tried to bring out into the open -> from whence Saddam obtained chemical weapons and what countries were implicated. If allowed, this information woud have been embarassing to certain western countries including the US, if not just because of supply then because of acquiescence when the attrocities were being committed.
It is also rather interesting that the main incompetent stooge of the US post invasion restoration (Bremer) was also involved in setting up the legal boundaries for holding the Saddam trial. One wonders really how much one man can really mess up (destroy all socio-economic, military and para-military infrastructure and then set up legal systems without political legitimacy?)
In truth, until he crossed us, Saddam was a US sponsored dictator just as were Batista, Samoza, Noriega, Marcos, Pinochet, or the Shah.

Hussein should have been sent to The Hague and put on trial by the International Court of Justice. As it stands, he was only convicted for some of his crimes — the massacre of 148 men and boys in reprisal over an assassination attempt. Now, he will never be put on trial for gassing entire Kurdish villages, and other assorted atrocities. What was the haste to hang him all about? Revenge, I suppose. But it has deprived countless Kurds and other Iraqis of vindication.

When I think about, politicans aren’t very decent folks. Money is soooooo tempting to them. At least Gerald Ford was a likeable guy. Being truthful and honest is not part of the job.
I’ve watched a little of the TV coverage tonight. Just a little. Why do our elected representatives spend our tax dollars buying Cadillacs? A lot of the cars are Cadillacs. There are a few Lincolns, a few Chrysler 300s, and a good sampling of big SUVs. Do our politicans deserve Cadillacs? Why can’t they ride around in a Chevrolet Malibu?

I’ve been asking people today, strangers on the streets of an affluent, well-educated major metropolitan city, and none of them knew what the trial that found him guilty was about.
If you think it was for gassing the Kurds, it wasn’t. Hussein’s execution ends that trial, which had begun in August, 2006.
If you think it was for draining the marshes, killing the marsh arabs, it wasn’t that either.
If you think it was for killing Kuwaitis or Iranians, no, that trial hadn’t begun.

So if a war with Iran caused all the oil from the Persian Gulf states to be cut off, then oil availability worldwide would be reduced by at least 30%, which means an extreme price increase for gas at the pumps in the US.
That would mean gasoline skyrocketing to $6 to $10 a gallon, and rationing of gasoline, if the oil was disrupted from the Gulf region more than a couple of months. The Bush Regime seems to desire anarchy for America too, because this would cause our economy to collapse and loss of jobs, so another “Great Depression” created by Bush Junior!

It’s a shocking film to watch, because what the press has been showing was doctored footage. This bootleg copy will eventually be seen worldwide and all hell is going to break loose. He was no longer important for anyone, he was powerless because of the invasion/capture and was never a Sunni leader (in any reigious sense). Shiites cheer both Iraqi and Irani. I don’t know if the Kurds do, because they really didn’t get to tell their complete story.
There are oddities about the events of the past several days and about the trials themselves. The trials do not measure up to the integrity expected from international law regarding crimes against humanity and they are tainted by revenge.
For the Kurdish trial, one can only suspect that Saddam’s lawyers would have tried to bring out into the open -> from whence Saddam obtained chemical weapons and what countries were implicated. If allowed, this information woud have been embarassing to certain western countries including the US, if not just because of supply then because of acquiescence when the attrocities were being committed.
It is also rather interesting that the main incompetent stooge of the US post invasion restoration (Bremer) was also involved in setting up the legal boundaries for holding the Saddam trial. One wonders really how much one man can really mess up (destroy all socio-economic, military and para-military infrastructure and then set up legal systems without political legitimacy?)
In truth, until he crossed us, Saddam was a US sponsored dictator just as were Batista, Samoza, Noriega, Marcos, Pinochet, or the Shah.
The truth will eventually win out.

No one here (that I have seen) is sating Saddam was innocent and should have been released or (god forbid) been put back in power.
IMHO, he deserved to die – but that does not mean he should be executed without an internationally recognized and respected trial. We have risked what little credibility we have left by flaunting and manipulating the legal system of Iraq and international law.
Just we did something did may seem correct, does not mean we did it correctly.
