BREAKING: Libby Guilty On Four Of Five Counts»

libby.JPGScooter Libby has been found guilty on four out of five counts:

Count 1 - Obstruction of Justice: Libby intentionally deceived the grand jury about how he learned, and “disclosed to the media,” information about Valerie Plame Wilson’s employment by the CIA.

Count 2 - Making a False Statement: Libby intentionally gave FBI agents false information about a conversation he had with NBC’s Tim Russert regarding Valerie Plame Wilson, who is married to Joseph Wilson.

Count 4 - Perjury: Libby knowingly provided false testimony in court about a conversation he had with Russert.

Count 5 - Perjury: Libby knowingly provided false testimony in court about his conversation with reporters regarding Valerie Plame Wilson’s CIA employment.

Libby was found not guilty on count 3, a charge that he gave false statements to the FBI about his conversation with Time magazine reporter Matt Cooper.

UPDATE: Fox News reports from inside the courtroom: “Scooter Libby had a rather sad, resigned smile on his face. The kind of smile you get from resignation, not happiness, obviously.”

UPDATE II: Washington Post: “Under federal sentencing guidelines, Libby faces a probable prison term of 1 1/2 to three years when he is sentenced by U.S. District Judge Reggie B. Walton. … As the jury forewoman read each guilty count in a clear, solemn voice, Libby was impassive, remaining seated at the defense table, gazing straight ahead and displaying no visible emotion.”

UPDATE III: Fox news legal analyst Andrew Napolitano spins the verdict for the defense, arguing that there is a basis for Libby’s defense counsel to say the jury “misunderstood the nature of the charges” and was “hopelessly confused.” Watch it:

I welcome the jury’s verdict. It’s about time someone in the Bush Administration has been held accountable for the campaign to manipulate intelligence and discredit war critics. Lewis Libby has been convicted of perjury, but his trial revealed deeper truths about Vice President Cheney’s role in this sordid affair. Now President Bush must pledge not to pardon Libby for his criminal conduct.

UPDATE V: Speaker Nancy Pelosi (D-CA) says the problem is not just Libby.

Today’s guilty verdicts are not solely about the acts of one individual. This trial provided a troubling picture of the inner workings of the Bush Administration. The testimony unmistakably revealed — at the highest levels of the Bush Administration — a callous disregard in handling sensitive national security information and a disposition to smear critics of the war in Iraq.

    Technically, no, because the obstruction and lying came during the investigation, albeit very, very early. But, practically, yes you are correct that the investigation never really got out of the station. Nonetheless, you and I are in agreement - let’s get the justice party started.

    How did outing Plame make this country safer as a result?

    How did outing Plame make it easier to recruit the best and the brightest to help keep WsMD out of the hands of rogue regimes, groups and individuals?

    When Plame was outed, it was inevitable that her CIA front of Brewster Jennings would be disclosed as well, thereby exposing all those undercover operatives and double agents in other Govts

    How did outing Plame, and then Brewster Jennings make it easier to recruit the foreign operatives and double agents needed to keep WsMD out of the hands of rogue regimes, groups and individuals?

    How did the Administration’s DELIBERATE outing of Plame increase the trust level between the White House and the CIA’s intelligence analysts?

    There’s no way to answer those questions in ways both logical and positive for this Administration

    So much for the preliminaries, now to the main event!

    Libby will, of course, be pardoned, and I expect Cheney’s resignation due to “(political) health reasons” within six weeks or so. On the other hand, I’ve hoped for Darth Cheney’s resignation before, so I won’t be holding my breath.

    Whatever happens now, this is a victory for justice. These people fancy themselves above the law, and this is a welcome rebuke.

    My hearty congratulations to the prosecution for their excellent work.

    I am confused! As usual. An earlier post about CNN’s announcement indicated that he faced a THIRTY year sentence if convicted on all five counts. The WaPo now claims a THREE year sentence for four counts. That fifth charge must have been a good one. But it was the same as the second charge-lying to the FBI-except it was about Cooper of Time rather that Russert of NBC. If I were Russert I would be raising hell for discrimination. The end is in sight and if I were “Scooter” I would be real concerned about who was doing the sighting of my end. “The Dick” Cheney will be aiming his shotgun while some shotgun inmate will be aiming something else.

    I am happy that justice was served. Luckily the crimes didn’t lead to injury or death of Plame. I do think that congress should investigate this matter further. Currently, Reid is just guessing and making assumptions as is Pelosi. I have little doubt that Cheney is involved in some way, but our Leaders in Congress are being brash in saying that without any investigation or proof. Furthermore, it is damn funny listening to this crowds expectations.

    Do any of you for a moment honestly think this will lead to Impeachment of Cheney and Bush? If they could somehow prove any of this with factual information that perfectly shows Cheney or Bush knew and instructed Libby to do this, they may have a case to reprimand Cheney or Bush but the crime certainly wouldn’t lead to impeachment.

    Reids other charge however would. He is claiming, like many of you, that the administration intentially manipulate intelligence that they provided to congress for their vote on the Iraq war. If any of that was true, that certainly could lead to impeachment. Currently, there is no evidence of that and its scary seeing leaders of Congress publicly acting like this crime happened when they have no clue.

    Lastly, Pelosi and Reid must think it is some type fo crime to disagree with critics of a war. The are sadly mistaken as disagreeing and poltically discrediting your opponent is what this country is all about. Free Speech is paramount to this country. While it is very nasty poltics, at the end of the day that is all it is. Both side are famous for doing it on almost every single issue.

    Again, they certainly should hold hearings and see if their rhetoric has and true standing. It would serve the country well to finally figure out if congress did in fact get the same intelligence the adminstration did and no crime was truly commited like the American public currently have to believe as we assume everyone inicent until PROVEN guilty. If they find evidence that Bush manipulated evidence, then impeach the bastard.

    Of course I don’t understand why they are getting all worked up about it. Afterall, the Dems are now on board and fully supporting the war by working towards voting yes to the current Iraq war money in front of them. Why do they care now why we are there if they are now supporting the war anyways?

    Libby did a lot of damage. When Plame was outed, everyone associated with the Brewster Jennings cover was outed. This group was responsible for tracking weapons of mass destruction around the world, and may well have foiled a plot to smuggle WMDs into Iraq, North Korea, Iran, Mexico or even the US.

    This at best severely damaged CIA covert operations and national security and at worst got some agents killed.

    Feel free to argue the trivia of legality but this did severe damage to our safety as a nation and the safety of all the other agents under the Brewster Jennings cover. How any American can defend this is beyond my comprehension.

    No RR I don’t think this will lead directly to the impeachment of Bush or Cheney. But the more stamina this story has (I’ m betting Fox heavily de-emphasizes it by the end of the day) the more it will contribute to an atmosphere where impeachment becomes a more palatable option.

    Also you are glad the crime did not lead to the death of Plame, but we have no idea if any of her contacts have been liquidated. You wonder if she had sources inside Iran who are no longer feeding us info for one reason or another. But lets assume no one has died as a result of this. What if this case lets informants/associates know that at any moment they could be revealed by high ranking US officials for political reasons. Would you continue to work for us? If you did not work for us would you even start knowing that this is a possibility? Heck no.

    As to the intentional mis-representation or twisting of intelligence by the administration, it is coming out little by little exactly that they did. Heck last week they admitted that they fudged the Korean intelligence, what do you think of that? Don’t you think it is possible for them to do that multiple times? What they did with Iraq was looked for intelligence that served their purpose. As the Vice president said he wanted to see the intelligence in it’s original unfiltered format. In other words, he did not want the CIA/NSA/State Department/ Pentagon to vet the intelligence. So a crack pot claim easily disproven under normal conditions, such as the yellowcake assertion, or the Atta met in Prague assertion gets the VP’s attention because it fits his needs. Normally this stuff is vetted and only passed on when it is real intelligence about real possibilities, such as “Bin Laden determined to strike in the US” That is where the VP and the administration fixed the intelligence around the policy, they did not let the intelligence agencies work, they in essence broke our intelligence services. Heck the State Department did not agree, and I can’t think of the guys name right now, but he was shocked when Powell made his UN presentation because even then he knew that it was full of crap.

    I think you are intentionally mis-representing Pelosi and critics of war critics. It is a crime to lie to congress/the courts/the FBI etc… It is a worse crime (IMHO) when you do it for political purposes. Criticizing Murtha or Pelosi because you do not agree with their stance is no crime and Pelosi ahs ever said it was, unlike the right wing who try to paint the exercise of democracy as treason.

Rather, they are encouraging the war to go on longer and longer by voting yes to the spending bill that actually increases money for the Iraq war. And finally, they are now bogging themselves down in hearings and investigations, which is fine if you are also working to pass bills to fix the problems your investigating but their not. They are simply holding hearings for political gain as they currently haven’t even talked about possible fixes and more needed money for our Military.

His judgement may have been off as he isn’t a intel expert, but I see nothing wrong with wanting all the info. Furthermore, didn’t the CIA claim to fudge the intel. The Administration never said or did that. Now if you want to blame the CIA for misrepresenting the evidence against Iraq, Fine (still need some proof). In that situation, the CIA is as fault, which looks likely, but the Administration alone with Congress both got bad intel. That is only the CIA’s fault.

    You are correct about the CIA and Plame though. If this plame leak by Libby got anyone killed, he should be facing much more jail time. Furthermore, it certainly hurt the CIA deeply. I don’t think his punishment is long enough but I don’t have a say in it.

    Lastly, I didn’t misrepresent anything about Pelosi. She is in fact working other Dems to gain more support for a yes vote in the new Iraq Spending Bill Bush presented her with. If the Dems vote yes to extending this war when they had the simple chance to end it, they certainly lied to get elected. The only real question is do they now truly support the war or are they simply voting in a way that will garner them more seats and more power? Either way, it is completely unacceptable and I thought you folks would agree with me.

    In order to maximize the effect of the verdict against Libby, the Court should not allow Libby to be out of prison on bail pending an appeal. The Appeal will take over a year if not until the end of bush’s term at which time I expect he will pardon Libby. By putting Libby behind bars now the court will force bush’s hand to pardon Libby now with its consequential fall out; or better yet get Libby to talk about cheney, rove et al. It is within the court’s discretion whether to allow Libby out pending an appeal. If as everyone suspects, and I wouldexpect Jd. Walton would believes as well, Libby was doing cheney’s bidding. The Court should be interested in getting to the bottom of this entire affair.

    Who really care what Fox News espouses. Bush only has as much validity as Fox News has, and that is less than 30%, and dropping. I have more respect for John Daily, thirty minutes a night, than Fox News, 24-7. Their commentators are the living jokes of the entertainment world and tend to give Hollywood total legitimacy, while making the Republican Party look like total fools.     President Bush should pardon Libby and fire Patrick Fitzgerald. From the very beginning of the investigation, Fitzgerald knew that there had been no criminal violation since Plame wasn’t a covert agent.

    Fitzgerald knew that Richard Armitage told Robert Novak about Mrs. Wilson, before Libby testified. Fitzgerald knew that before he questioned anyone before the grand jury. Fitzgerald knew everyone was innocent, before he started questioning them. This made the whole grand jury investigation into a politicized fishing expedition. Fitzgerald‘s actions from that point on were illegal. The perjury trap that he set up was illegal.

    There should have been no referral, no special counsel, no indictments, and no trial. This trial was a politicized prosecution. Justice demands that Bush issue a pardon and fire Patrick Fitzgerald.

    One of the few things I remember from high school is that the constitution provides that the penalty for treason is death. Sadaam Hussein was tried and hanged for acts against his own people. The Bush administration is responisble for the deaths of thousands of Americans, tens of thousands of Iraqis, numerous constitutional violations, perjuries, racketeering, global security destabilization, deteriation of the global econ
