Gonzales Lied Under Oath, Said All Bush-Appointed Attorneys Would Be ‘Senate-Confirmed’»

gonzales33.jpg A little-noticed provision slipped into the Patriot Act in 2005 allows the President to appoint “interim” U.S. attorneys for an indefinite period of time, without Senate confirmation. On Jan. 18, Attorney General Alberto Gonzales assured the Senate Judiciary Committee that the administration never intended to take advantage of it:

GONZALES: And so let me publicly sort of preempt perhaps a question you’re going to ask me, and that is: I am fully committed, as the administration’s fully committed, to ensure that, with respect to every United States attorney position in this country, we will have a presidentially appointed, Senate-confirmed United States attorney.

I think a United States attorney who I view as the leader, law enforcement leader, my representative in the community — I think he has greater imprimatur of authority, if in fact that person’s been confirmed by the Senate.

But in mid-December, an e-mail by Gonzales’s chief of staff, D. Kyle Sampson (who resigned yesterday), showed that the Justice Department clearly intended to skirt the Senate altogether and use the Patriot Act provision to appoint U.S. attorneys that would serve until the end of Bush’s term:

There is some risk that we’ll lose the authority, but if we don’t ever exercise it then what’s the point of having it?

Gonzales also told the Senate Judiciary Committee that the Justice Department was “working with home state senators to get U.S. attorneys nominated.” But as the Washington Post notes, e-mails show that “as early as last August,” Justice officials “discussed bypassing the two Democratic senators in Arkansas, who normally would have had input into the appointment.”

UPDATE: Also on Jan. 18, Gonzales stated, “I think I would never, ever make a change in a United States attorney for political reasons or if it would in any way jeopardize an ongoing serious investigation. I just would not do it.”

    The chief White House lawyer floated the idea of firing all 93 U.S. attorneys at the start of President Bush’s second term, but the Justice Department objected and eventually recommended the eight dismissals that have generated a political firestorm two years later.

    The long-simmering feud erupted with the new revelations, causing Attorney General Alberto Gonzales to cancel a planned trip Tuesday to Syracuse, N.Y., amid calls from Congress for his ouster.

    Additionally, Gonzales’ top aide, chief of staff Kyle Sampson, announced his resignation Tuesday.

    In a statement, the attorney general said he is “very appreciative” of Sampson’s service, which began when Gonzales was White House counsel. Sampson resigned Monday night, the statement said.

    White House spokeswoman Dana Perino said Monday that then-White House Counsel Harriet Miers raised with an aide to Gonzales the prospect of asking all chief federal district prosecutors to resign in 2004 as a logical way to start a new term with a new slate of U.S. attorneys.

    Perino also acknowledged Monday that complaints about the job performance of prosecutors occasionally came to the White House and were passed on to the Justice Department, perhaps including some informally from President Bush to Gonzales…

If so, how’s that ’selective moral outrage’ working out for you?

    Can someone explain this to me? Couldn’t Gonzales just say that at the hearings he was referring to the Administration’s attitudes at the time towards USAs and not their attitute two months prior? There must be something more incriminating than the quote above. I mean I know he’s lying in the sense that they really wish that they didn’t have to get Senate confirmation, but lying about ones state of mind at a congressional hearing is kinda par for the course. I doubt that when someone says that they’re “Happy to be here” at a hearing that they really mean it, but who cares? Aren’t there any examples of him lying about something factual?

    “Gonzo” gonzales was just on TV and said that “yes, he made some mistakes” and that “he believes in accountability”, after which he said that “no, he will not resign” and he “stands by his decision that the firings were justified”.

    So there you have it. Mistakes were made, but apparently just admitting that means that the accountability part really doesn’t apply and the fact that the firings were justified means that the only mistakes made were that this all became public.

    I’m curious about the legislative history behind the “little noticed provision” in the 2005 Patriot Act. Who exactly slipped it in to the legislation? Has anyone in the media interviewed that legislator, to ask about the intention of that provision? Did the White House or the DOJ initially suggest this provision, or support its inclusion in the law?

    I’d like to see the mainstream media dig into this a little deeper.

    It’s OBVIOUS that the firing/replacement of these U.S. Attorneys WERE politically motivated. That said, why won’t the Bush folks just come out and admit the obvious. If they are allowed to do this at will, WHAT’S THE PROBLEM?

    The fact that these attorneys were replaced WITHOUT Senate confirmation under this “little known” clause of the Patriot Act is the REAL smoking gun here!

    I predict that Bush will end up firing Gonzales over this scandal - if only for the purpose of protecting his political master-mind Karl Rove.

    I also predict that we’ll see impeachment efforts towards Bush & Cheney during the last few months of this administration. It’s inevitable!

    I know what ya mean, but don’t forget that Bill Moyers wore a flag lapel pin not long before he left BPS. He said that he decided to put it on because “it’s time to take it back”. It doesn’t belong to Bush & Co…It belongs to “We The People”.

    What is really maddening is that these idiotic ideologues say that they represent us and that they are protecting us from terrorism. Regime change begins at home, but our corporate government is not recognising the will of the people. For wealth and political gain they have dishonered themselves and stand before as as an enemy willing to gamble whatever capitol they still have to attain their Neoconservative aims.

    These people are not Americans, they are not republicans, and they certainly are not worthy of wearing the flag of the United States of America…Lets take it back.

    It’s deplorable that Cheney & Rove have used this “Terrorism” scare-tactic to coerce Americans into voting for Bush and supporting his illegal, self-serving baseless war. It’s SHAMEFUL that Rove and the idiots like Senator Bill Frist, Tom DeLay and Rick Santorum used Terri Schiavo and gay marriage as divisive issues to gain the votes of evangelicals, while their beloved president was stomping all over the U.S. Constitution; wasting U.S. lives and squandering hundreds of billions of dollars of their tax dollars on his illegal and immoral war – all based on lies!

    I firmly believe that by or before 11-2008, these folks are going DOWN! Anyone in Bush’s administration with ANY integrity has already left as being associated with this administration is political suicide. If the Democrats in power now have any balls, they will initiate impeachment against BOTH Bush & Cheney!

    This is sad that all you people have time to do is criticize. It is a large title to have, being the leader of the great United States of America. Lets have some patriotism people. How can you expect a man (that’s what he is, just a man) to do his job to the best of his ability when so many people with uneducated opinions wont let him. Agreed he is not our best president, but he didn’t ask for terrorists to come attack our country and kill our loved ones. By our constitution, he was elected our leader. As our leader he is charged with doing what he thinks is best, and he did. What would you have him do? Wait around to see if they had weapons of mass destruction? “Oops, too late, they just bombed us again. Darn, better luck next time.” You don’t think we should be at war? Well that’s not you’re call. Who are you? There is information floating around that the people in the white house see that citizens like us never even dream of. The president makes his decisions off of those facts and we are right on his heels criticizing with little or no information at all to back our useless attacks. What good does it do? We are the United States of America. We are known to pull together when we are down so that we may rise up bigger and better than ever. Be American. Be supportive.

    Americans and the world is LESS safe because of GWB’s baseless war in Iraq. Iraq had NOTHING to do with 9-11. There WERE no weapons of mass detruction. Al Qaeda wasn’t in Iraq until after we invaded that country. Nobody seems to even care if about Bin Laden anymore. We’re NOT doing enough in Afganistan where those 9-11 terrorists were based.

    I’m so sick of hearing the same old tired talking points designed to impart fear in Americans - how it’s better that were fighting over here that on our own soil - as if somehow some small terrorist group is going to wage a full-scale attack on our country. It’s bogus and it’s shamefull to keep using what happened on 9-11 as a justification to remain engaged indefinately in a civil war.

    I’m watching the Senate hearings with Kyle Sampson. Poor Kyle has turned into “Scooter” Libby #2.

    What’s most interesting is that the most confrontational questioning of Mr. Sampson is from Republican Senator Arlen Spector. As I said in my previous post, the smoking gun in this whole issue is the fact that the Justice Department knowingly and deliberately took advantage of that little known clause in the Patriot Act which allows the president to replace US Attorneys WITHOUT Senate confirmation.

    On an unrelated point, and to add insult to injury, now the King of Saudi Arabia has condemed GWB’s war in Iraq as the “illegitimate foreign occupation” of Iraq. It’s looking bad for the Bush crowd when the Saudi’s, long time friends of the Bush family, are now condeming the U.S. occupation of Iraq.

    Bush just needs to conceed and agree that he’s made some VERY BAD decisions. He’d save face with U.S. citizens and citizens of the entire world if he’d just come clean with the fact that he’s made some bad decisions.

    It’s sad when a Democrat like me, actually misses the days of Reagan and GHW Bush. Unlike others, I don’t actually see our current president as “evil”. I think he TRULY believes in what he does and what he says. For that, I respect him. Unfortunately, I think he’s surrounded himself with a bunch of unscrupulous corporate/political cronies, the likes of Karl Rove, Dick Cheney and John Ashcroft (to name just a few). Cheney & Rove seem to be the REAL source of all of the secrecy and corruption in the White House.

    Thank GOD that the American people got fed up in this past election and put Democrats in office to finally put this out-of-control Executive Administration in check. I’m not saying that Democrats aren’t corrupt themselves, nor do they pander to their own agendas and special interests - but still, at LEAST there are now some checks-&-balances in place in Washington to keep the ideological agendas of the likes of Dick Cheney and Karl Rove under scrutiny.

    Again - I predict there WILL be impeachment proceedings against BOTH President Bush and Vice President Cheney. I don’t believe it’s a “stretch” for me to make this prediction since now we’ve got Republican Senators and the mayor of Salt Lake City, Utah invoking the “I” word.
