A little-noticed provision slipped into the Patriot Act in 2005 allows the President to appoint “interim” U.S. attorneys for an indefinite period of time, without Senate confirmation. On Jan. 18, Attorney General Alberto Gonzales assured the Senate Judiciary Committee that the administration never intended to take advantage of it:
GONZALES: And so let me publicly sort of preempt perhaps a question you’re going to ask me, and that is: I am fully committed, as the administration’s fully committed, to ensure that, with respect to every United States attorney position in this country, we will have a presidentially appointed, Senate-confirmed United States attorney.
I think a United States attorney who I view as the leader, law enforcement leader, my representative in the community — I think he has greater imprimatur of authority, if in fact that person’s been confirmed by the Senate.
But in mid-December, an e-mail by Gonzales’s chief of staff, D. Kyle Sampson (who resigned yesterday), showed that the Justice Department clearly intended to skirt the Senate altogether and use the Patriot Act provision to appoint U.S. attorneys that would serve until the end of Bush’s term:
There is some risk that we’ll lose the authority, but if we don’t ever exercise it then what’s the point of having it?
Gonzales also told the Senate Judiciary Committee that the Justice Department was “working with home state senators to get U.S. attorneys nominated.” But as the Washington Post notes, e-mails show that “as early as last August,” Justice officials “discussed bypassing the two Democratic senators in Arkansas, who normally would have had input into the appointment.”
UPDATE: Also on Jan. 18, Gonzales stated, “I think I would never, ever make a change in a United States attorney for political reasons or if it would in any way jeopardize an ongoing serious investigation. I just would not do it.”
Who’s surprised that AG Gonzales told a lie?
Anyone? Anyone at all?
I thought not. It’s a requirement that members of the Bush Administration tell lie after lie after lie. . . . . .
March 13th, 2007 at 11:06 amI think you mean “2005″ not “1995″?
March 13th, 2007 at 11:06 amCorrection needed! The Patriot Act did not exist in 1995!
March 13th, 2007 at 11:08 amGonzales is a lying sack of shit and should be made to take an oath everytime he talks to congress so that he can be tried for perjury later. How is appointment of U.S. attorneys without Senate approval neccesary to the Patriot Act. We should have let that legislation expire years ago!
March 13th, 2007 at 11:09 amThanks for catching – we changed it to 2005.
March 13th, 2007 at 11:11 amSo…did he lie, or did he just ‘forget’?
Somebody get Fitz on the line…
March 13th, 2007 at 11:12 amLying under oath? Oh that’s nothing. How about lying to illegally invade other countries. Well, i guess that’s nothing too.
Justice department? Hah. What a misnomer.
March 13th, 2007 at 11:13 amGonzales should be out! certainly he should face legal consequences for lying under oath… perhaps he can share a cell with Libby?
March 13th, 2007 at 11:14 amGonzo is just another Bush lackey. They all are crooked and corrupt. The whole batch needs to be thrown out NOW. If the Dems don’t start real investigations and impeachment, the people will march to the gates of the White House and demand change.
March 13th, 2007 at 11:14 amSo much for bringing accountability to Washington.

March 13th, 2007 at 11:22 amLooks like BushCo wanted to fire all 93 prosecutors!
[from: http://news.yahoo.com/s/ap/20070313/ap_on_go_co/congress_prosecutors ]
The chief White House lawyer floated the idea of firing all 93 U.S. attorneys at the start of President Bush’s second term, but the Justice Department objected and eventually recommended the eight dismissals that have generated a political firestorm two years later.
The long-simmering feud erupted with the new revelations, causing Attorney General Alberto Gonzales to cancel a planned trip Tuesday to Syracuse, N.Y., amid calls from Congress for his ouster.
Additionally, Gonzales’ top aide, chief of staff Kyle Sampson, announced his resignation Tuesday.
In a statement, the attorney general said he is “very appreciative” of Sampson’s service, which began when Gonzales was White House counsel. Sampson resigned Monday night, the statement said.
White House spokeswoman Dana Perino said Monday that then-White House Counsel Harriet Miers raised with an aide to Gonzales the prospect of asking all chief federal district prosecutors to resign in 2004 as a logical way to start a new term with a new slate of U.S. attorneys.
Perino also acknowledged Monday that complaints about the job performance of prosecutors occasionally came to the White House and were passed on to the Justice Department, perhaps including some informally from President Bush to Gonzales…
ITMFA!!!
March 13th, 2007 at 11:28 amSo is impeachment ‘off the table’ with this fascist too Madame Speaker?
March 13th, 2007 at 11:29 amYou are not going to prosecute poor Alberto Gonzales because of some sort of perjury trap? He’s such a nice man.

March 13th, 2007 at 11:31 amPatrick Fitzgerald for Attorney General
March 13th, 2007 at 11:32 amPatrick Fitzgerald is not qualified for Attorney General under this administration. He has brains, he has backbone, he is capable of independent thought and action, and he can and will act to uphold justice and the law.
March 13th, 2007 at 11:38 amBush administration is only interested in spineless, unprincibled lackeys who respect neither law, justice nor human rights. Or rights for small animals and plants.
Time to go now, Abu. Bye-bye now.
March 13th, 2007 at 11:40 amAmanda,
That is the definitive picture of Abu Gonzales. Thank you.
March 13th, 2007 at 11:42 amAlberto V0-5 is another Chimpyloving Closet Case.
I hope he goes to jail. Gonzales would be someone’s bitch before he got off the bus.
March 13th, 2007 at 11:43 amThe above photo of Gonzo has him looking sufficiently moronic and I can only imagine how proud his mother is of her ass-kissing, boot-licking son. I hope the hell Congress follows the trail from Gonzo to Rove and acts appropriately. Impeachment of these turd-balls should be the least of Congress’ concerns, if the people feel not enough is being done to purge the corruption from OUR government. Get on the f*ing stick!

March 13th, 2007 at 11:43 amOUT WITH HER—DID NOT SEND COMMENT BEFORE———
March 13th, 2007 at 11:43 amThe Senate confirmed Alberto Gonzales, including some Democrat Senators, so they are responsible for his actions and must impeach him.
March 13th, 2007 at 11:45 amMore from Sampson:
“I strongly recommend that as a matter of administration, we utilize the new statutory provisions that authorize the AG to make USA appointments,”
Heckuva job.
March 13th, 2007 at 11:45 amThere is some risk that we’ll lose the authority, but if we don’t ever exercise it then what’s the point of having it?
This is the essence of the administration’s mindset. Authority is meant to be used, damned whether its used properly or not.
March 13th, 2007 at 11:47 amOf course none of this is suprising but it’s good that it is coming out. If we had an opposition party maybe he and the rest of the illegitimate junta could be removed.
March 13th, 2007 at 11:49 amDamn, how I hate those condesending flag lapel pins.
March 13th, 2007 at 11:51 amBill Clinton lied under oath. Talk about selective moral outrage from the libs.
March 13th, 2007 at 11:53 amI have been comic blogging on this topic.
This is nothing new in Texas. Just bringing it to a larger audience.
I think this is part of the Master Plan to set the stage for the ‘08 elections. They already purged the Attorneys who might have posed a problem.

Hey, guess what? Clinton is not the President anymore! He’s been out of office for years now and, therefore, cannot be impeached (again). Those really long naps really make you lose the train of history. Of course, you obviously did not understand the issue regarding Clinton when you were awake. So, why don’t you get your blanket and pacifier, settle into your little bed, and go “nigh-night” for another six years?
March 13th, 2007 at 12:09 pmGonzales’ sole qualification to become Attorney General is Bush butt kisser, so like Michael Brown of FEMA Alberto is not qualified for his position. He is just a sleazy attorney and nothing more.

Bush I illegally sold weapons to Iran.
Reagan was a vegetable while holding the highest office in the land and the responsible people around him hid the fact he was unfit for the office.
Reagan sent Don Rumsfeld over to meet Saddam twice in 1984, and shipped the chemical weapons that may have been used on Kurds and Iranians.
Bush II….too long to list.
Clinton lied about an extra-maritial affair.
My outrage is not selective it is just tempered to the severity of the offense.

What’s your point, Dolores?
Are you contending that we must hold Gonzo to the same standards we held Bubba? If so, I agree wholeheartedly.
Or are you contending that since libs were justifiably upset over an impeachment brought by a lie under oath concerning a topic that was completely personal, we should now give Gonzo a free pass concerning his lying under oath concerning a topic that is critical to the entire structure of our government? If so, how’s that ’selective moral outrage’ working out for you?
(By the way, the year is 2007. You kool-aid swillers really need to stop living in the past… ^_^ )
March 13th, 2007 at 12:16 pmCan someone explain this to me? Couldn’t Gonzales just say that at the hearings he was referring to the Administration’s attitudes at the time towards USAs and not their attitute two months prior? There must be something more incriminating than the quote above. I mean I know he’s lying in the sense that they really wish that they didn’t have to get Senate confirmation, but lying about ones state of mind at a congressional hearing is kinda par for the course. I doubt that when someone says that they’re “Happy to be here” at a hearing that they really mean it, but who cares? Aren’t there any examples of him lying about something factual?
March 13th, 2007 at 12:16 pm#44 – Drop Gonzales off in the middle of East LA…

Pretty weak stuff there. Clinton has been out of office for six years. It’s all Bush’s responsibility now. And boy has he f*cked it up good.
March 13th, 2007 at 12:18 pm“His behavior,” says Lieberman, “is so over the edge. What is troubling is the deceit, the failure to own up to it. Before this is over the truth must be told.”

Whatever Clinton did or did not do he is not currently destroying this nation.
And Progressives are the people who respect other people’s personal sex lives. If he hadn’t been asked a question that was in no way relevant to any of the issues under investigation he would not have lied under oath. But if he had said immediately that he had sex with that woman you guys would have been all over him for not trying to protect his wife, child and said woman.
Now, go f##k yourself.

Hmmmmm… That sounds an awful lot like the conservative version of: “If it feels good, do it.”
Both approaches will lead to failure and discrace.
March 13th, 2007 at 1:19 pmHo hum. Another Bush Administration lie. burp. Opens a bottle of beer. Scratches self. Another day another lie.
Face it folks there will be no righteous indignation against this cabal until some intern in a blue dress gives Bush or Cheney or Gitmo Gonzales a sloppy blowjob that they can then lie about. Obviously obfuscation and lying about national security issues or firing highly competent (although Repugnican) US Attorney’s pale in comparison to the real issues that affect the psyche of ‘Merika.
Until the sacred blowjob is given under the Oval Office desk, all the handwringing and wishful thinking about impeachments and indictments and imprisonments will be for naught.

This makes me wonder what an otherwise “obscure” Gonzalez has done in his life, (what bad thing(s), he has done to warrant attaining the coveted “prize” of AG.
In BushWorld, it seems the more worse things that you have done, are equally rewarded with a position in kind.
Jesus, with that logic, it makes me really wonder what Condi Rice has done in her past to warrant Sec of State.
March 13th, 2007 at 3:04 pmHey “Impeach Clinton(Again)”,
Bill lied about getting his schlong swallowed, which IN NO WAY interfered with his ability to handle the office of president and about which I don’t care one whit.
Bush and his administration are GUTTING THE CONSTITUTION and LYING ABOUT IT LEFT AND RIGHT, EVERY SINGLE DAY.
The fact that YOU can’t tell the difference says awful things about your discernment, or lack thereof.
Are you also one of those who thinks it’s horrible to abort a fetus, but great to kill ‘the enemy’ during war? If so, you’d better re-read your Good Book, fellah…

March 13th, 2007 at 3:21 pm“Gonzo” gonzales was just on TV and said that “yes, he made some mistakes” and that “he believes in accountability”, after which he said that “no, he will not resign” and he “stands by his decision that the firings were justified”.
So there you have it. Mistakes were made, but apparently just admitting that means that the accountability part really doesn’t apply and the fact that the firings were justified means that the only mistakes made were that this all became public.

March 13th, 2007 at 10:50 pmI’m curious about the legislative history behind the “little noticed provision” in the 2005 Patriot Act. Who exactly slipped it in to the legislation? Has anyone in the media interviewed that legislator, to ask about the intention of that provision? Did the White House or the DOJ initially suggest this provision, or support its inclusion in the law?
I’d like to see the mainstream media dig into this a little deeper.
March 13th, 2007 at 11:18 pmNow that we’ve vented our collective spleens on the deserving Gonzalez creep, just one questions really ramains: will anyone truly be made to pay for these crimes? March 22nd, 2007 at 11:41 pmIt’s OBVIOUS that the firing/replacement of these U.S. Attorneys WERE politically motivated. That said, why won’t the Bush folks just come out and admit the obvious. If they are allowed to do this at will, WHAT’S THE PROBLEM?
The fact that these attorneys were replaced WITHOUT Senate confirmation under this “little known” clause of the Patriot Act is the REAL smoking gun here!
I predict that Bush will end up firing Gonzales over this scandal – if only for the purpose of protecting his political master-mind Karl Rove.
I also predict that we’ll see impeachment efforts towards Bush & Cheney during the last few months of this administration. It’s inevitable!
March 23rd, 2007 at 4:47 pm30 Damn, how I hate those condesending flag lapel pins.
I know what ya mean, but don’t forget that Bill Moyers wore a flag lapel pin not long before he left BPS. He said that he decided to put it on because “it’s time to take it back”. It doesn’t belong to Bush & Co…It belongs to “We The People”.
What is really maddening is that these idiotic ideologues say that they represent us and that they are protecting us from terrorism. Regime change begins at home, but our corporate government is not recognising the will of the people. They still think they can control us through the main stream media and outright lying that has been going for six years. For wealth and political gain they have dishonered themselves and stand before as as an enemy willing to gamble whatever capitol they still have to attain their Neoconservative aims.
These people are not Americans, they are not republicans, and they certainly are not worthy of wearing the flag of the United States of America…Lets take it back.
March 24th, 2007 at 8:47 pmThe neo-cons are basically SCREWED at this point! The fact that moderates like McCain & Juliani are the front runners for the Republican presidential nomination is proof that Americans are FED UP with all of the tired old divisive tactics of the Bush gang.
It’s deplorable that Cheney & Rove have used this “Terrorism†scare-tactic to coerce Americans into voting for Bush and supporting his illegal, self-serving baseless war. It’s SHAMEFUL that Rove and the idiots like Senator Bill Frist, Tom DeLay and Rick Santorum used Terri Schiavo and gay marriage as divisive issues to gain the votes of evangelicals, while their beloved president was stomping all over the U.S. Constitution; wasting U.S. lives and squandering hundreds of billions of dollars of their tax dollars on his illegal and immoral war – all based on lies!
I firmly believe that by or before 11-2008, these folks are going DOWN! Anyone in Bush’s administration with ANY integrity has already left as being associated with this administration is political suicide. If the Democrats in power now have any balls, they will initiate impeachment against BOTH Bush & Cheney!
March 26th, 2007 at 7:57 pmThe G-D Patriot Act is responsible for so many “liberties” taken by this Republican junta. I wouldn’t be surprised, if it were ever confirmed, that they orchestrated 9-11 in order to put forth their piece of Nazi legislation.
March 26th, 2007 at 8:06 pmThis is sad that all you people have time to do is criticize. It is a large title to have, being the leader of the great United States of America. Lets have some patriotism people. How can you expect a man (that’s what he is, just a man) to do his job to the best of his ability when so many people with uneducated opinions wont let him. Agreed he is not our best president, but he didn’t ask for terrorists to come attack our country and kill our loved ones. By our constitution, he was elected our leader. As our leader he is charged with doing what he thinks is best, and he did. What would you have him do? Wait around to see if they had weapons of mass destruction? “Oops, too late, they just bombed us again. Darn, better luck next time.” You don’t think we should be at war? Well that’s not you’re call. Who are you? There is information floating around that the people in the white house see that citizens like us never even dream of. The president makes his decisions off of those facts and we are right on his heels criticizing with little or no information at all to back our useless attacks. What good does it do? We are the United States of America. We are known to pull together when we are down so that we may rise up bigger and better than ever. Be American. Be supportive.
March 28th, 2007 at 10:26 pmBeing American shouldn’t be about blind patriotism. You can love this country and disagree with the president.
Americans and the world is LESS safe because of GWB’s baseless war in Iraq. Iraq had NOTHING to do with 9-11. There WERE no weapons of mass detruction. Al Qaeda wasn’t in Iraq until after we invaded that country. Nobody seems to even care if about Bin Laden anymore. We’re NOT doing enough in Afganistan where those 9-11 terrorists were based.
I’m so sick of hearing the same old tired talking points designed to impart fear in Americans – how it’s better that were fighting over here that on our own soil – as if somehow some small terrorist group is going to wage a full-scale attack on our country. It’s bogus and it’s shamefull to keep using what happened on 9-11 as a justification to remain engaged indefinately in a civil war.
March 29th, 2007 at 2:08 pmI’m watching the Senate hearings with Kyle Sampson. Poor Kyle has turned into “Scooter” Libby #2.
What’s most interesting is that the most confrontational questioning of Mr. Sampson is from Republican Senator Arlen Spector. As I said in my previous post, the smoking gun in this whole issue is the fact that the Justice Department knowingly and deliberately took advantage of that little known clause in the Patriot Act which allows the president to replace US Attorneys WITHOUT Senate confirmation.
On an unrelated point, and to add insult to injury, now the King of Saudi Arabia has condemed GWB’s war in Iraq as the “illegitimate foreign occupation” of Iraq. It’s looking bad for the Bush crowd when the Saudi’s, long time friends of the Bush family, are now condeming the U.S. occupation of Iraq.
Bush just needs to conceed and agree that he’s made some VERY BAD decisions. He’d save face with U.S. citizens and citizens of the entire world if he’d just come clean with the fact that he’s made some bad decisions.
It’s sad when a Democrat like me, actually misses the days of Reagan and GHW Bush. Unlike others, I don’t actually see our current president as “evil”. I think he TRULY believes in what he does and what he says. For that, I respect him. Unfortunately, I think he’s surrounded himself with a bunch of unscrupulous corporate/political cronies, the likes of Karl Rove, Dick Cheney and John Ashcroft (to name just a few). Cheney & Rove seem to be the REAL source of all of the secrecy and corruption in the White House.
Thank GOD that the American people got fed up in this past election and put Democrats in office to finally put this out-of-control Executive Administration in check. I’m not saying that Democrats aren’t corrupt themselves, nor do they pander to their own agendas and special interests – but still, at LEAST there are now some checks-&-balances in place in Washington to keep the ideological agendas of the likes of Dick Cheney and Karl Rove under scrutiny.
Again – I predict there WILL be impeachment proceedings against BOTH President Bush and Vice President Cheney. I don’t believe it’s a “stretch†for me to make this prediction since now we’ve got Republican Senators and the mayor of Salt Lake City, Utah invoking the “I†word.
March 29th, 2007 at 5:20 pmBush Treason Against America
In fact, the Constitution is far more than ‘outmoded,’ according to President Bush who rebuffed GOP leader’s request to soft pedal some parts of the ‘Patriot Act’ by saying: “I don’t give a goddamn . . . I’m the President and the Commander-in-Chief. Do it my way.” Then, responding to an aid who stated: “There is a valid case that the provisions in this law undermine the Constitution.” Bush screamed back: “Stop throwing the constitution in my face . . . It’s just a goddamned piece of paper!”
