Snow on Bush involvement: ‘Anything’s possible.’»

Just out from the AP:

The White House on Friday backed off its earlier contention that then-White House Counsel Harriet Miers first raised the idea of firing U.S. attorneys — an act that led to a firestorm of criticism of Attorney General Alberto Gonzales.

“It has been described as her idea but … I don’t want to try to vouch for origination,” said White House press secretary Tony Snow, who previously had asserted Miers was the person who came up with the idea. “At this juncture, people have hazy memories.” […]

Asked if Bush himself might have suggested the firings, Snow said, “Anything’s possible … but I don’t think so.” He said Bush “certainly has no recollection of any such thing. I can’t speak for the attorney general. I want you to be clear here: don’t be dropping it at the president’s door,” Snow said.

    So why not just come out and admit that he fired them?

    Because nobody has done that mid-term before (nope, not Clinton, not Reagan, not even Poppy); and people will still want to know *why* they were fired, given that they had good performance reviews; and people will come to the conclusion that they were fired for political expediency; and people will have additional evidence that this administration does in fact value party and patronage over country.

    With that in mind, Bush could very well be the mastermind behind this mess. In fact, as badly botched as it was suggests that Bush had to have a direct role. Nothing gets this badly botched without Bush getting involved.

    Actually, no he can’t. He can nominate people, he can temporarily appoint them when the Senate is in recess, but in actual fact there is nothing in the constitution which gives him the power to fire anybody over anything.

    Section 2. The President shall be commander in chief of the Army and Navy of the United States, and of the militia of the several states, when called into the actual service of the United States; he may require the opinion, in writing, of the principal officer in each of the executive departments, upon any subject relating to the duties of their respective offices, and he shall have power to grant reprieves and pardons for offenses against the United States, except in cases of impeachment.

    He shall have power, by and with the advice and consent of the Senate, to make treaties, provided two thirds of the Senators present concur; and he shall nominate, and by and with the advice and consent of the Senate, shall appoint ambassadors, other public ministers and consuls, judges of the Supreme Court, and all other officers of the United States, whose appointments are not herein otherwise provided for, and which shall be established by law: but the Congress may by law vest the appointment of such inferior officers, as they think proper, in the President alone, in the courts of law, or in the heads of departments.

    The President shall have power to fill up all vacancies that may happen during the recess of the Senate, by granting commissions which shall expire at the end of their next session.

    As such, the next step down is civil and criminal law - which if it is anything like South African law would make for an interesting case should any of those he has fired bring forward a suit for unfair dismissal.

    Aren’t you curious what the administration’s reasoning was for firing eight Bush-appointed attorneys that had already received good performance reviews? Aren’t you just the LEAST bit curious what those eight were working on?

    Perhaps they were able to put their partisan views aside and were investigating Republican misconduct?

    Earlier Patrick or one of the other lower life forms stated emphatically that as “chief executive” Bush has the authority to fire “anyone” in the executive branch.

    Wrong.

    The executive branch includes every agency of the Federal government - what Patrick and the others complain about as the “bureaucracy.” Every civilian employee of the executive branch is covered by a multitude of federal personnel laws that protect us (I am a federal employee) against madmen like Bush firing us for less than good cause. Bush can fire any of the Schedule C folks because they are political appointees. As has been repeated so often in the lies trying to cover up the US Attorney purging, those political appointees “serve at the president’s pleasure” (and I wish one of them would pleasure the president so we could impeach the bastard).

    Bush cannot reach down into the ranks of GS-15s and lower civilian employees and fire us. We can be transferred to a oil storage tank field in Newark or to the Barrow Alaska Country Club for screwing up. But the “president” cannot fire me or any other civilian employee.

    Check the facts Patrick.

    I believe that most appointees in the current Administration and most other Administrations in recent history serve and served “at the will of the President” not because of any Constitutional right of the President to fire them but because they were all forced (extortion, coercion) to sign undated letters of resignation. There are also laws covering the unjust termination of an employee of which removal for political reasons is probably high on the list. All this aside, however, the primary malfeasance in this case is the involvement of lower level political hacks and the key to the issue as Tricky Dick found out: “It’s the cover-up Stupid.” Lying under oath, conspiracy, obstruction of justice are all impeachment offenses. Had King George the Dumb just said to the Attorneys “I accept your resignation” there is not a thing that could been done except the usual screaming, shouting and gnashing of teeth. However, KGtD lives up to his crown and will go down to Leavenworth.

    This was only 3-4 months ago, not 3-4 years ago. And it was clearly a priority political item.

    What kind of fool does Tony Snow take the American people to be? Besides, there was no claim of hazy memory just 2-3 days ago when people were being less than truthful in sworn testimony in an attempt at damage control. The lesson from the CIA leak case it that it works to throw up a fall guy, in this case Harriet Miers. But thanks to Josh Marshall and others it hasn’t worked this time.

    My hazy memory says at the time the details on this operation got started Bush was on the stump talking about how he earned political capital from the 2004 election and that he would be spending some of that capital soon. Now we know what he was talking about when he made that declaration.
