Bush lashes out.

At a press conference moments ago:

“We will not go along with a partisan fishing expedition aimed at honorable public servants. The initial response by Democrats unfortunately shows some appear more interested in scoring political points than in learning the facts. It will be regrettable if they choose to head down the partisan road of issuing subpoenas and demanding show trials. And I have agreed to make key White House officials and documents available. I proposed a reasonable way to avoid an impasse, and I hope they don’t choose confrontation. I will oppose any attempts to subpoena White House officials.”

UPDATE: Sen. Patrick Leahy (D-VT) said, “I don’t accept [the White House's] offer. It is not constructive and it is not helpful to be telling the Senate how to do our investigation, or to prejudge its outcome. … Testimony should be on the record, and under oath. That’s the formula for true accountability.”

    The Constitutional crisis is looming. We thought it would come over his plans to illegally invade Iran.

    But Bush is planning to bring this to a head now. He’s going to challenge the COngress. We’ll see if the COngress is made up of patriots or sniveling corrupted sychophants. They will either call Bush’s bluff and demand subpoenas be honored, and if the subpoenas are not, go to the Supreme COurt and then — to the streets.

    Just got back from watching the President’s speech…the only word that adequately fits Chimpy’s demeanor was ‘pugnacious’…it looked like he was going to start swinging any second.

    The principle argument that Chimpy put forth for not allowing Rove and Miers to testify under oath was that he was concerned that establishing such a precedent would keep presidential advisors from speaking candidly, harming the ability of the President to receive sound advice.

    What a crock. Chimpy sees the constitutional crisis up ahead, and responds by jamming the throttle wide open. It’s obvious that this sociopath would rather destroy this country than hand it over. He and his band of murderous thugs need to be removed from power.

    “After telling a bunch of different stories about why they fired the U.S. Attorneys, the Bush Administration is not entitled to the benefit of the doubt,” Reid said. “Congress and the American people deserve a straight answer. If Karl Rove plans to tell the truth, he has nothing to fear from being under oath like any other witness.”

    And therein lies the problem. It seems like real democracy is too much for the right to imagine. As long as ‘deal leader’ didn’t actually ‘break any laws’ – even to the point of making a mockery of the traditional process – then all is well.     Wacko Bush is scared and knows this is the big one. The Justice System requires all to testify under oath or take the 5th. Now Gonzales will be charged with lying under oath because he did lie.     Some crimes that a special prosecutor might one day look at:

    1. Misrepresentations to Congress. The relevant provision, 18 U.S.C. § 1505, is very broad. It is illegal to lie to Congress, and also to “impede” it in getting information. Deputy Attorney General Paul McNulty indicated to Congress that the White House’s involvement in firing the United States attorneys was minimal, something that Justice Department e-mail messages suggest to be untrue.

    2. Calling the Prosecutors. As part of the Sarbanes-Oxley reforms, Congress passed an extremely broad obstruction of justice provision, 18 U.S.C. § 1512 (c), which applies to anyone who corruptly “obstructs, influences, or impedes any official proceeding, or attempts to do so,” including U.S. attorney investigations.

    3. Witness Tampering. 18 U.S.C. § 1512 (b) makes it illegal to intimidate Congressional witnesses. Michael Elston, Mr. McNulty’s chief of staff, contacted one of the fired attorneys, H. E. Cummins, and suggested, according to Mr. Cummins, that if he kept speaking out, there would be retaliation.

    Actually, that’s just the start. On on impeachment, and conviction by the Senate, the President is removed from office. Best solution would be a trip to some country that has no extradition treaty with the U.S. … and then ask for asylum.

    For gasoline to be at $1.15, the price of oil would need to be below $20 a barrel…..
    I hope for your sake, you are not budgeting your ARM mortgage payments with your gasoline savings.

    No one is above the law. The president can either be removed from office by the Congress and then prosecuted in a court of law or he can be prosecuted when he leaves office.

    Thanks for the clarification, but I’m still a bit dubious. If a president was visiting an American city, got drunk and accidentally shot someone, are you saying local police would not have the authority to arrest him? I don’t think there is anything in the constitution which would prevent that arrest.

    The OLC memorandum further explained that if the text of the Impeachment Judgment Clause barred the criminal prosecution of a sitting President, then the same text would necessarily bar the prosecution of all other “civil officers” during their tenure in office. The constitutional practice since the Founding, however, has been to prosecute and even imprison civil officers other than the President while they were still in office and prior to their impeachment. See, e.g., id. at 4-7 (cataloguing cases). In addition, the conclusion that the Impeachment Judgment Clause constituted a textual bar to the prosecution of a civil officer prior to the termination of impeachment proceedings “would create serious practical difficulties in the administration of the criminal law.” Id. at 7. Under such an interpretation, a prosecution of a government official could not proceed until a court had resolved a variety of complicated threshold constitutional questions.

    These include, first, whether the suspect is or was an officer of the United States within the meaning of Article II, section 4 of the Constitution, and second, whether the offense is one for which he could be impeached. Third, there would arise troublesome corollary issues and questions in the field of conspiracies and with respect to the limitations of criminal proceedings.

    Id. The memorandum concluded that “[a]n interpretation of the Constitution which injects such complications into criminal proceedings is not likely to be a correct one.” Id. As a result, the Impeachment Judgment Clause could not itself be said to be the basis for a presidential immunity from indictment or criminal trial.

Yessiree, if Congress abdicates their power and derelects their duty to bring about impeachment due to failure to comply with the subpoena power of the Senate, then it will be the onus of responsibility of the people to enforce this Article. After all, the Constitution belongs to THE PEOPLE. This president serves “at the pleasure OF THE PEOPLE” who, incidentally, happen to pay his salary. It’s time that WE, THE PEOPLE stand up and be counted and not allow the Congress which purports to represent us back down one iota.     I am still waiting for the Dems to prove this isn’t a political show trial meant simply for political gain. To prove this is simple. They need to back up what they say and investigate and demand everyone that interfered with ongoing investigations step down. They need to start with Schumer. This man is on record interfering with a justice department investigation. Furthermore, he is on record making demands for information and is also on record telling the justice department when he wants things investigated and even how he wants them investigated. The things he did were at a minimum on level with the things he is accusing the administration of doing. Currently, he has no hard proof that Bush or Cheney were actually involved.

    On the flip side, we have written proof from Schumer himself that he interfered with an ongoing investigation. While that may sound bad, it gets much much worse for him. He not only interfered, but went on to make timeframe demands and even told the justice department exactly how he wanted them to do the investigation. He even told them in advance the specific information he wished to learn from their investigation. He applied political pressure.

    So, I truly hope TP doesn’t prove to be a hypocrit here. TP and the Dem party have asked that anyone doing these acts be removed from Government. They have also demanded that these folks be investigated and forced to be interviewed under oath publicly. So when is TP demanding the Dems investigate and interview Schumer publicly under oath for all these completely inappropriate acts. When you do this, I will then believe your being serious. I will believe your actually doing this stuff with the best interests of we the people in mind. You will prove your not simple poltical hacks putting on a show trial attempting to gain political points. ANYTIME TP.

    Yes.

    Because the Military Commissions Act prevents criminal prosecution for war crimes under domestic law, the international community may exert jurisdiction as soon as Bush is removed from office.

    It would be nice if they had an extradition request served at that moment, to prevent Bush from flying off to Paraguay.

    What does a FEDERAL Court have to do with CONGRESS????? They are not one in the same!!!!

    I say let him disregard the subpeanas……. Then Conyers can whip out that long list of articles of impeachment, where BUSH will have NO CHOICE but to appear before congress…… Then the Congress WILL NOT have to ask only questions related to the impeachment. They could then ask ANY question they want!!!!

    If Bush wouldn’t give Congress a reason to look into questionable activities of his administration, like, oh, finding a “problem” with Carol Lam a day after she announces she’s going after former CIA official Kyle “Dusty” Foggo and then-House Appropriations Committee Chairman Jerry Lewis (R-CA), no doubt Bush’s buddies, then we wouldn’t have sitting Presidents crying like a baby and whining about setting precedents.

    Oh, and there is precedent for this, as you have obviously not read because of your distaste for facts, 31 of Clinton’s top aides testified to Congress on 47 different occasions, and Clinton didn’t mind.

    And speaking of Clinton’s aides testifying, where are your comments under the FACT CHECK: There Is No Precedent Barring White House Aides From Testifying To Congress thread, Roger? I searched for your name and couldn’t find even one post!

    And…when Clinton did a wholesale replacement of U.S. attorneys at the beginning of his first term, which you claim he had a right to do, the Republicans in Congress went nuts and charges of corruption went flying. The difference is, I don’t think any of the U.S. attorneys at that time were investigating any of his friends or any questionable dealings regarding Clinton’s administration. Deal with it, assh*le.

    OMG, a come-hither? [perk]

    To tell the truth, dear Zooey, over the the last few weeks, I’ve been traveling through the weirdest space of my entire life, caught between a deep study of the WTC demolition on one hand, and a really bizarre sleeping disorder on the other. Nonetheless, I’ve been keeping an eye on a “few of my favorite things.”

    Hope you are well and starting to see a bit of green. :)

But only have one thing to add: Refusing to let certain of his closest people testify is by default cause for suspicion…the first indication of somebody lying is defensiveness. This ploy is actually going to backfire and cause some double-takes on both sides of the aisle. It’s another one of the worst things he could have done for his image. If I had nothing to hide I would encourage testimonies under oath. Just to prove people wrong. BUT there you have it…Mr. Bush is digging a deep hole…

    The Congress represents the people. The president is just an employee. The will of the people must override any attempts to cover up illegal activities by the law breaker in chief.

    The internal conversations of the people involved show that republicans that were willing to follow the law against republicans and democrats alike were fired.     Given that Rove and Gonzales and a host of others, including of course Mr. Bush, do not meet the definition of honorable public servants there appears to be no conflict to the subpoenas being issued by Congress at this point.
