“We will not go along with a partisan fishing expedition aimed at honorable public servants. The initial response by Democrats unfortunately shows some appear more interested in scoring political points than in learning the facts. It will be regrettable if they choose to head down the partisan road of issuing subpoenas and demanding show trials. And I have agreed to make key White House officials and documents available. I proposed a reasonable way to avoid an impasse, and I hope they don’t choose confrontation. I will oppose any attempts to subpoena White House officials.”
UPDATE: Sen. Patrick Leahy (D-VT) said, “I don’t accept [the White House's] offer. It is not constructive and it is not helpful to be telling the Senate how to do our investigation, or to prejudge its outcome. … Testimony should be on the record, and under oath. That’s the formula for true accountability.”

Deputy Attorney General Paul McNulty indicated to Congress that the White House’s involvement in firing the United States attorneys was minimal, something that Justice Department e-mail messages suggest to be untrue.
2. Calling the Prosecutors. As part of the Sarbanes-Oxley reforms, Congress passed an extremely broad obstruction of justice provision, 18 U.S.C. § 1512 (c), which applies to anyone who corruptly “obstructs, influences, or impedes any official proceeding, or attempts to do so,†including U.S. attorney investigations.
3. Witness Tampering. 18 U.S.C. § 1512 (b) makes it illegal to intimidate Congressional witnesses. Michael Elston, Mr. McNulty’s chief of staff, contacted one of the fired attorneys, H. E. Cummins, and suggested, according to Mr. Cummins, that if he kept speaking out, there would be retaliation.
4. Firing the Attorneys. United States attorneys can be fired whenever a president wants, but not, as § 1512 (c) puts it, to corruptly obstruct, influence, or impede an official proceeding.

Actually, that’s just the start. On on impeachment, and conviction by the Senate, the President is removed from office. Once removed, he’s just a private citizen, and then subject to arrest and prosecution for any crimes committed. And once removed from office, he is no longer head of anything (including the DoJ and the military). He’s on his own then. Best solution would be a trip to some country that has no extradition treaty with the U.S. … and then ask for asylum.

If the court says yes, I don’t think that the administration can ignore the subpoenas. Were Bush to personally defy a subpoena, the remedy would be impeachment, but the rest of the gang can simply be arrested.

In 2006 and 2007, the WTI crude oil spot price is projected to average around $70 per barrel (West Texas Intermediate Crude Oil Price). Retail regular gasoline prices are projected to average about $2.65 per gallon in both 2006 and 2007 ( Gasoline and Crude Oil Prices).
For gasoline to be at $1.15, the price of oil would need to be below $20 a barrel…..
I hope for your sake, you are not budgeting your ARM mortgage payments with your gasoline savings.

Thanks for the clarification, but I’m still a bit dubious. If a president was visiting an American city, got drunk and accidentally shot someone, are you saying local police would not have the authority to arrest him? I don’t think there is anything in the constitution which would prevent that arrest.

Yessiree, if Congress abdicates their power and derelects their duty to bring about impeachment due to failure to comply with the subpoena power of the Senate, then it will be the onus of responsibility of the people to enforce this Article. After all, the Constitution belongs to THE PEOPLE. This president serves “at the pleasure OF THE PEOPLE” who, incidentally, happen to pay his salary. It’s time that WE, THE PEOPLE stand up and be counted and not allow the Congress which purports to represent us back down one iota. If they do, they, too, will become complicit in the eyes of the true patriots in this country and, also, will be removed and/or not re-elected to their positions of representation.

They need to back up what they say and investigate and demand everyone that interfered with ongoing investigations step down. They need to start with Schumer. This man is on record interfering with a justice department investigation. Furthermore, he is on record making demands for information and is also on record telling the justice department when he wants things investigated and even how he wants them investigated. The things he did were at a minimum on level with the things he is accusing the administration of doing. Currently, he has no hard proof that Bush or Cheney were actually involved.
On the flip side, we have written proof from Schumer himself that he interfered with an ongoing investigation. While that may sound bad, it gets much much worse for him. He not only interfered, but went on to make timeframe demands and even told the justice department exactly how he wanted them to do the investigation. He even told them in advance the specific information he wished to learn from their investigation. He applied political pressure.
So, I truly hope TP doesn’t prove to be a hypocrit here. TP and the Dem party have asked that anyone doing these acts be removed from Government. They have also demanded that these folks be investigated and forced to be interviewed under oath publicly. So when is TP demanding the Dems investigate and interview Schumer publicly under oath for all these completely inappropriate acts. When you do this, I will then believe your being serious. I will believe your actually doing this stuff with the best interests of we the people in mind. You will prove your not simple poltical hacks putting on a show trial attempting to gain political points. ANYTIME TP.

The United States Congress generally brings this action for refusing to testify before a Congressional committee, or failing to provide a committee with requested documents. There have also been contempt cases based on bribing a United States Senator or United States Representative.

And…when Clinton did a wholesale replacement of U.S. attorneys at the beginning of his first term, which you claim he had a right to do, the Republicans in Congress went nuts and charges of corruption went flying. Or, the International Community could establish a special tribunal, like the ones for Rwanda and the former Republic of Yugoslavia.

Most Americans at this point know he lied to us about Iraq, and the evidence is all there. The only problem was getting that evidence, the witness, etc, all introced in testimony before congress, but now with a Democratic Congress, (as opposed to a ReichStag Congress), the hearings will take place.

If Bush refuses to testify under oath then we have a constitutional crisis. This could lead to impeachment. We have 20 republican senators and all of the House running for re election in ‘08. How many are going to risk their job and vote to not impeach the obvious criminals?

bit paranoid here, but…Is this the trigger for bush to get on the horn, maybe call his buds in SaudiA (or his direct line to Osama) and give the orders to let loose with another attack on our shores? Seems that is his only option now, create real fear again. That’s the only way he could really invoke all the provisions of the PA and try to regain control. Am I being totally paranoid?
