‘An intriguing question.’

Tony Snow explained that the standoff between the Executive Branch and Congress revolves around Bush’s right to “privileged communications with close staff members.” But he also stated that “the president has no recollection” of conversations about the attorney firings being raised with him. That means, as CNN’s Ed Henry noted, that the White House is now claiming executive privilege over conversations that never existed. Snow’s response to this dilemma? “That falls into the intriguing question category,” he said.

    The stock market is crashing, energy is more and more scarce, people are at odds and the issue is TRUST. If we replace this guy I hope we are luckier and his party means little if he is a liar.     Given George W’s pattern he just wants Congress to go away. If it isn’t by signing statements, so they can’t over ride a veto, it’s by sliding legislation into bills so he doesn’t have to deal with any oversight by Congress (but, they were never going to do that according to Gonzales).

    He had to know this entire issue was going to come up sooner rather than later. If it wasn’t this investigation, it would have been another.

    NEW YORK (AP) – Stocks took their worst beating in two weeks today on continued troubles for subprime lenders.

    The Dow industrials finished with a loss of more than 242 points, the Nasdaq composite index was down 51 and three-quarters and the S-and-P 500 dropped 28 points.

    This was after the 400 pointer and 500 pointer from last month. So the trend is to FALL and a liar in office will sink the whole thing in pretty short order.

    Among the many problems with the Democrats War Supplemental is the not so small fact that it endorses passage of the Iraqi Oil Law.

    “Democratic leadership is actively handing over Iraq’s oil to U.S. companies as some sort of war bounty,” said Antonia Juhasz, analyst with Oil Change International.

    Not so fast, say Dem Leaders and allies. Their “clever plan” is that Bush’s benchmarks will not be met in the next eight months, after which, the bill will require withdrawal. Its the best they can get right now, they say.
    Problem is, it’ll be game over and mission accomplished for Big Oil in Iraq in that time. The oil law is on a fast track for approval by the Iraqi Parliament within the next 2 months. Last week, Representative Dennis Kucinich authored a Dear Colleague letter to Representatives urging them to remove this benchmark from the law. Democratic leadership reportedly debated it behind closed doors, but ultimately has left the reference to the law in. Representative Kucinich has vowed to offer an amendment to strip the language, but Democratic leaders are likely to rule it out of order. Looks like the Dems are all bark and no bite when it comes to taking on what Big Oil wants most.

    It’s an abuse of power for the Executive Branch to use prosecutors in a political role – to prosecute their political opposition and avoid prosecuting criminals in their own party. This would be true no matter whether the President has a D or an R by his or her name.

    It’s also an abuse of power to claim that members of the Executive Branch, whose salaries are paid by US taxpayers, cannot be held accountable for their words and actions by our elected representatives.

    The AG sat right there in front of a Congressional committee and said that the prosecutors were not fired for political reasons. Then later, evidence becomes available showing that indeed they were. The AG does not have a right to lie to Congress and avoid accountability. Congress has a duty to investigate the inconsistencies in the stories coming from the Executive Branch. They are all accountable to US.

    I think there is a chance (good chance) that some of these USA were fired to prevent further investigation of Republican officeholders.

    If that is the case, we are talking about the crime of obstruction of justice.

    In 1974 the Supreme Court held that executive privilege is not intended to shield administration officials from criminal investigation.

    Unless the current US Supreme Court has left planet earth, they should come down on the side of Congress.

    But all this will take time to play out. And during this time, Gonzo will be the AG and they will slow play it.

    Its going to be a long, tough fight. But at the end of all this, I would sure hate to be a Republican running for re-election. Or, a Republican running for President.

    If the next Democratic President’s Attorney General ordered a group of prosecutors to be fired because they had investigated and prosecuted too many Democrats and not enough Republicans (in his view), and then the AG tells Congress that they weren’t fired for political reasons when there is evidence they had, and Congress wants to investigate, …

    It would be totally OK with you for that Democratic President to claim executive privelege and not allow staff to be questioned under oath.

    Absent a claim of need to protect military, diplomatic, or sensitive national security secrets,

    Now tell me are the firings military? No

    Even if Bush lied and talked about it with Rove or Meyers, it still does not meet the criteria set forth by the Supreme Court for a claim of Executive Privilige.

    Please cite any court ruling in your rebuttal for verification.

    This is exactly the point that was made byGreenwald in his Update II. So that we can keep focus on the backstory, I’m extracting it below:

    Clearly, the U.S. attorneys probe is not the only investigation the White House fears — and almost certainly is not the one they fear the most. For that reason, it is important to them to establish principles which will prevent (or at least substantially delay) any meaningful investigations by Congress into the White House’s conduct over the last six years, and creating a privileged buffer around key administration officials and White House documents serves that purpose quite well. For that exact reason, it is absolutely imperative that Congress not acquiesce here, because genuine investigations — that which the country urgently needs — will, at some point, require this confrontation.

    It appears that Jake is confirming all this with his seemingly “prescient” attempts at defending the administration. Recall that Jake had already identified the “differences” between Nixon and Bush yesterday afternoon, long before Tony Snow refused to discuss them this morning. It looks like we have a mole, not a troll.

    Wayne, what the Jakes are claiming is actually quite subtle. They want to establish a differentiation between information requested for a criminal investigation (assuming that a Special Prosecutor has been appointed, I suppose) versus that requested for a congressional investigation. The difference arises because the Congress has no independent means of prosecuting a charge of contempt, but must rely on the Executive Branch to provide such service. It appears ingenious on the surface, but in the end it is simply a question of process, meaning where in the chain of events does it become privileged versus non-privileged information. I don’t think they have a ghost of a chance of winning that kind of specious argument. It’s so complicated and tedious, even Tony Snow refused to make comment this morning.

    Repubs spent over $100 million investigating this 20-year old land deal. They spent most of the taxpayer money AFTER their own Resolution Trust Corp. ruled that the Clintons had done nothing wrong.
