Snow Flashback: ‘I’m Not Going To Tell Congress What They Can And Can’t Do’»

White House Press Secretary Tony Snow appeared on the morning talk shows on all the major networks and repeated his talking point that Congress “has no oversight responsibility over the White House.” A sampling of his statements:

There’s another principle, which is Congress doesn’t have the legislative — I mean oversight authority over the White House. [CNN, 3/22/07]

First, the White House is under no compulsion to do anything. The legislative branch doesn’t have oversight. [MSNBC, 3/22/07]

Congress doesn’t have any legitimate oversight and responsibilities to the White House. [Fox, 3/22/07]

But back when he was asked whether the conservative-led 109th Congress should be investigating members of the Executive Branch, he was singing a different tune:

QUESTION: What is the president’s opinion of a request by Republican leaders in the House to launch an investigation of Sandy Berger’s involvement in the removal of classified documents from the National Archives?

SNOW: There were questions last week, about investigations involving Republican members. Members of Congress have their own oversight obligations. They may proceed as they wish. They’re a separate and co-equal branch of government and I’m not going to tell them what they can and can’t do. [Briefing, 10/16/06]

    Who cares what Snow says or believes. The real and only question is what is the law. In this case, the administration has the right to fire any attorney they want anytime they want. Furthermore, the administration has the right to deny the congress in this matter. While I feel the adminstration is not correct, they are still completely legal. Congress should stop with the show trial crap that costs us tons of money and use their time to change the laws that allow Bush to do this in the first place. That I approve of 100%.

I have to admit he has been tasked with the tough job of convincing Amerca that Bush aides don’t need to testify under oath, in public, and with transcripts. Everyone else does, but they don’t.

    Wait, was Berger an advisor to the current President? Executive Privilege applies to the office of President. Also, while Congress has oversight over executive agencies, it has no oversight over the President other than the specific checks and balances in the Constitution. What is so hard to understand about that?

    Congressional action is the specific and only remedy to a criminal presidency. Got it?

    If a District court can supoena Clinton and force him to testify, Congress can as well.

    Clinton’s advisors had to testify before Congress 47 times. Executive Privilige did not apply because the issues were not Military, diplomatic or National security secrets that were involved.

    Under President Clinton there were about 1,000 subpoenas issued to his people. His aides testified before congress 47 times. There were 140 hours of testimony on Clinton’s Christmas card list.

    We got eight solid years of Whitewater (in which the Clinton’s lost a few thousand dollars in a condo deal two and a half decades before he was president).

    There was Travelgate, Filegate, and Nannygate (his appointee for AG did not pay social security taxes on her nanny two or three decades in the past).

    We got three or four investigations into Vince Foster’s death—each one carried out by Clinton’s enemies and each one saying what the previous one said.

    There was the Lincoln Bedroom Scandal. Now, all of a sudden, there is Separation of Powers. I cannot stand this much hypocricy.

    The issue isn’t the legality of firing the attorney generals–though it is relevant to point out that the politicizing the executive branch is unconstitutional.

    The point is demonstrating that this administration once again: (1) failed to act appropriately (firing AG’s because they are investigating Republican officials, even if not illegal, is poor judgment) (2) lied about it, and (3) another example of this administration acting against the overriding interests of U.S. citizens

    It seems more and more like Bush and his cohorts believe that the rule of law does not apply to them. This administration will surely be remembered as the worst in the entire history of the United States. I’m sure that as death-bed confessions and declassified documents become available over the next 20 years that this fact will become more and more clear. Bush will be compared to Nero and our grandchildren will know that he ushered in an unprecedented era of corruption and corporate pandering. Over the last 8 years the executive branch has become more of a ministry of truth, and the president has become more of a dictator. Even the legitimacy of his claim to the position is dubious at best, given the recent convictions of members on the Ohio elections board.

    Bottom line is that Bush is little more than a privileged frat-boy who never got his come-up-ins, but we all know that you reap what you sew. His time will come.

    I think that the general objective here is to restore more accountability from the Executive branch. The Patriot Act removed some of that accountability and has resulted in the abuses seen here (derailing ongoing investigations that could adversely affect the Republican party while appointing political allies without having to go through Senate approval while also ). This was perfectly legal at the time, but unseemly, which is why Gonzalez probably lied to Congress about the circumstances of the firings.

    I’m in favor of further investigation because (a) the accountability of the presidency, both to Congress, but especially to the people, must be reestablished, regardless of the party in power. Practices such as private, unrecorded and non-binding testimony should be recognized for the deceptions that they are. (b) Abuse of the powers provided by the Patriot Act should serve to bring about a review of that document for the loopholes that it seems to have been drafted to provide.
