The AP reports that Alberto Gonzales’ ex-chief of staff Kyle Sampson plans to invoke the Fifth Amendment and refuse some Senate questions when he appears at a Judiciary Committee hearing on Thursday.
UPDATE: It’s Goodling, not Sampson. “Monica Goodling, a counsel to U.S. Attorney General Alberto Gonzales who helped coordinate the dismissals of eight U.S. attorneys, will invoke her constitutional right not to answer Senate questions about the firings, her lawyer said. … ‘The hostile and questionable environment in the present congressional proceedings is at best ambiguous; more accurately the environment can be described as legally perilous for Ms. Goodling,’ [her lawyer John Dowd] said.”
UPDATE II: For his part, Sampson will stay loyal to Bush and Gonzales in his testimony: “‘Kyle is very much a supporter of the president and the attorney general,’ one friend tells CNN. ‘His main interest is in telling the truth.’ The friend says Sampson would ‘never do anything to hurt any of them’ and doesn’t believe his version of events will do that. Friends say Sampson believes innocent bungling was more to blame for the firestorm over the firings than anything malicious.”

It’s not good, apparently her lawyer is trying to suggest they’re building a perjury trap for people in the Justice Department. But the truth is, Wolf, Congress – its Judiciary Committees – they have oversight over the Justice Department. It is inexcusable for people in the Justice Department to take the 5th amendment to avoid testifying in Congress. People there must go testify. There’s no question about it.

Both statements are correct, although my understanding is that the 5th is guaranteed to all citizens, period. They are definitely entitled to not answer questions, but it is something of a non-admission admission of wrongdoing, especially in this environment that the Bush Crime Family has created.

Maybe I missed that explanation before, but I think we might have some common ground here, spiritually speaking anyway. Obviously we disagree from a political perspective, since I think Bush is trying to make himself a king. As a conservative Christian myself (Southern Baptist) I find this regime are no kind of conservatives (I see them as fascists), they hide behind the Lord but (my opinion only) blasphemize His teachings. You just reminded me of our pastor’s message yesterday, he talked about life not being ‘fair’ and the first thing that came to my mind was Bush, that with all the (I believe) harm he is doing to our country as a believer he will spend eternity where you and I will too, if it’s really ‘fair’. Believe it or not, it is perfectly legal to be both a screenwriter and a member of the Communist Party. However, if you helped Karl Rove wantonly ignore most of the Constitution, that makes you a member of a criminal conspiracy and hence provides a good reason to want to avoid telling the truth, on the record and under oath. BNF – I almost ALWAYS agree with your comments, but not this one. Though I certainly understand the anger (and therefore, temptation) to have that happen. Remember…what is allowed to happen to ONE can be allowed to happen to ALL. It’s bad enough that this is being applied under the Military Commissions Act. To even imply one’s support for allowing this same kind of reprehensible legal immorality to apply to one’s political opponents is just beyond the pale. Let’s not go there.

March 26th, 2007 at 7:05 pmActually I think the White House should be more concerned with Goodling’s lawyer saying she would plead the 5th Amendment on her testimony to Congress (the Senate) than Congress. She is posturing for immunity. If you don’t remember, it was John Dean getting limited immunity that really got the ball rolling with the resignation of Richard (I am not a crook) Nixon. I would think that some sort of deal is in the works. The one caveat in all of this is that if there are federal laws that have been broken (or suspected of being broken) the deal has to be run by a USA. Good luck.
