Gonzales Says He May ‘Find Out’ That Attorneys Were Purged For Political Reasons

In an interview tonight, NBC News’ Pete Williams asked Attorney General Alberto Gonzales a simple question: “Can you be certain that none of these U.S. Attorneys were put on that list [to be fired] for improper reasons?”

Gonzales wouldn’t give a straight answer, and in fact left open the possibility that attorneys were fired for partisan politics. “If I find out that, in fact, any of these decisions were motivated, the recommendations to me were motivated for improper reasons to interfere with the public corruption case, there will be swift and — there will be swift and decisive action. I can assure you that.”

Gonzales also suggested that other evidence of his personal involvement in the firings may come to light. “[T]here may have been other conversations [I had] about specifically about the performance of US attorneys” that I don’t remember, he said.

Gonzales bemoaned critics who are questioning his credibility. “Let me begin with the attacks on my credibility, which really have pained me and my family. You know, I have grown up — I grew up with nothing but my integrity.” This coming from a man whose early career as counsel to then-Gov. George W. Bush included helping to get Bush excused from jury duty, “a situation that could have required the governor to disclose his then-secret 1976 conviction for drunken driving in Maine.”

    In the same e-mail [a British Foreign Office official] later writes: "However, the survey methodology used here cannot be rubbished, it is a tried and tested way of measuring mortality in conflict zones."

    Asked how the government can accept the Lancet's methodology but reject its findings, the government has issued a written statement in which it said: "The methodology has been used in other conflict situations, notably the Democratic republic of Congo.

    Under Bush's Military Commissions Act, the only appeals allowed are to challenge procedural due process. No appeals are permissible regarding evidentiary rulings, including the admission of evidence elicited under torture. Presumably, if a guilty plea was obtained as a result of torture, that evidence would be barred from being heard on appeal.

    Welcome to America, the land of the free, where we can torture someone into pleading guilty, then sentence him or her to life in prison, or death.

    Actually, with bush as his client, he had a duty to protect him, and this could justifiably include protecting him from having to disclose the drunk driving conviction.

    From a lawyerly standpoint, he had a duty to his client, and arguably could be said to have low integrity if he *didn't* get bush out of jury duty.

    So, if you get an unsolicited contact from a military recruiter, just remember, don't ask, don't tell!

    These guys just never stop lowering the bar. The new talking point is "if someone tried to interfere with a public corruption case there will be action." Of course if someone just tried to, say, bring bogus charges against Democrats or purge minority voters or just let investigations against Republicans die on the vine, then hey no foul! There is only one crime that counts and its the one they didn't commit. (except for in Guam and elsewhere, but that doesn't count.) All other "crimes" are just politics as normal.

    From his talkng points, I think the next story in this scandal lies in who's getting the USA jobs, not who's losing them, and what they are supposed to deliver in 08.

    As the body of law grew in the land of our forebearers in law, England, there came to be recognized that there is more to justice than just the King's law. And there arose the Courts of Equity, to do that which is right, whether or not proscribed by the law...that is, to say what the law ought to be. And thus was born the Common Law.

    Strangely enough (actually not so strange, given Republican frothing nowadays about "supporting the troops" by getting them killed or wounded [if they're lucky enough to survive] only to be warehoused in mildewed, roach-infested dumps), the Federalist Society sports a profile on James Madison on their masthead. Madison would have been appalled at their hijinks. If anything, the FS is most closely aligned with the anti-Federalists that were fighting Madison during the constitutional conventions. And their most recent forbearers are the RW racist "states's rights!" folks like Strom Thurmond (who helped get Kenny Boy Starr apponted when the Republican Fiske had too much honour to do their dirty work). To these people, words and symbols are only tools; not to be honoured but to be used in any way possiblem even dishonestly.

    That's your Federalist Society. Orwell knew their type.

    A party can request a hearing (in federal or state court) to examine whether the party invoking the Fifth has done so properly. Goodling's attorney's letter does not provide a valid basis for invoking the Fifth. You can't invoke the Fifth to avoid perjury charges (or obstructing justice with the selfsame testimony). (I have the cases here, if you want them.) You can't invoke the Fifth because you think the Committee is on a witch hunt. Etc.
    They shouldn't let Goodling get away with this. She either is refusing to providing testimony because she may be testifying about some crime she has previously committed (which is a valid reason for taking the Fifth) or she isn't. If she is, and a Judge so determines, then fine (and goodbye to her attorney's ridiculous GOP talking points), and if she isn't, she should be compelled to testify under subpoena.

    The funny thing is she may be obstructing justice (protecting others) by refusing to testify under a bogus claim of needing to take the Fifth.

    Just watching this from the outside, it looks as though that is the bad act she's afraid to testify about or -- and somehow I find this more believeable -- she's afraid of indictment for perjury because she has to go up to Congress and testify under oath before the White House has decided what its story is. And yeah, I'd feel like I was in jeopardy then too.
