Senate conservatives feeling “scandal fatigue.”

Bad news for Gonzales:

Goodling’s announcement, some senior Republicans felt, strengthened the Democrats’ charge that the Justice Department had something to hide.

All of which added up to scandal fatigue inside the caucus, the senators said.

Specter’s appeal to the caucus [to downplay Goodling's announcement] received “a lot of head shaking, a lot of eye-rolling,” said one senator who attended and spoke on condition of anonymity because the session was private.

Asked Tuesday if Gonzales had lost their confidence, many Senate Republicans demurred.

    Mcgrain v. Daugherty

A landmark decision of the Supreme Court, McGrain v. Daugherty, 273 U.S. 135, 47 S.Ct. 319, 71 L.Ed. 580 (1927), recognized the implicit power of either House of Congress to hold a witness in a congressional investigation in contempt for a refusal to honor its summons or to respond to its questions.

During the mid-1920s, there were numerous allegations that the Federal Department of Justice was being mismanaged by its administrator, Harry Daugherty, the attorney general of the United States. In response to the charges, the Senate passed a resolution that empowered an investigatory committee to hear evidence as to whether Daugherty failed to prosecute various violations of the antitrust laws. Mally S. Daugherty, who was a bank president as well as the brother of the attorney general, refused to respond to a subpoena that was issued by the committee on two occasions ordering him to appear and to bring designated bank ledgers. The president pro tempore of the Senate issued a warrant to his sergeant at arms that Mally Daugherty be taken into custody. [...]

  5. Tony Gerard says:

The press and even the blogosphere have not focused sufficiently on the Republican talking point supposedly “explaining” Goodling’s decision not to testify. The White House, Goodling’s lawyer, Arlen Spector, and other Republicans have cited the hostile atmosphere in the hearing room, created by the Democrats’ prejudgement of this case, as a reason for Goodling to take the Fifth. This charge is silly on its face. It is also pernicious because it undermines the assumption that Congress has the right to scrutinize the Executive by calling on citizens to testify. The Bushies do not care how much damage they do to the structures of government.

I blogged about this at it is my privilege to announce. The notion that Monica Goodling or anyone can avoid tesifying before Congress by claiming that someone can falsely accuse them of perjury for statements which are true has been repudiated by the courts. A notable example is the case against Susan McDougal who refused to testify in the Ken Starr-chamber investigation into the Whitewater non-scandal.

Quoting James Madison via Digby via The Editors:

…let us consider the restraints he will feel after he [the president]is placed in that elevated station. It is to be remarked that the power in this case will not consist so much in continuing a bad man in office, as in the danger of displacing a good one. Perhaps the great danger, as has been observed, of abuse in the executive power, lies in the improper continuance of bad men in office. But the power we contend for will not enable him to do this; for if an unworthy man be continued in office by an unworthy president, the house of representatives can at any time impeach him, and the senate can remove him, whether the president chuses or not. The danger then consists merely in this: the president can displace from office a man whose merits require that he should be continued in it. What will be the motives which the president can feel for such abuse of his power, and the restraints that operate to prevent it? In the first place, he will be im-peachable by this house, before the senate, for such an act of mal-administration; for I contend that the wanton removal of meritorious officers would subject him to impeachment and removal from his own high trust.

    And there you have it.

And with that, it should be clear to even the dimmest of partisan hacks that this practice of dumping qualified public servants for partisan gain was seen as impeachable from the start.

  108. Zep Tepi says:

The universe has been around forever

But even it must exist inside something right?

  109. JPark says:

#105 Actually, I don’t think that nutcase gets deleted. It is that “fairness doctrine”, you know.

  110. Zep Tepi says:

    “fairness doctrine”

Yeh I don’t unnerstan the filter fairy’s fairness doctrine either. I have stuff get deleted for no obvious reason as well yet Seixon, MA, Flaco and the rest don’t seem to have problems. I think TP just likes to see trolls get beat down. Sadistic bastids!

  111. JPark says:

#106 That is the thing Zep. It can’t logically exist inside anything. Logically, there can be no limit to the universe but that makes no sense. It is beyond comprehension that something goes on forever. But it must…otherwise, what is beyond it?

  112. Vance says:

I know Tony Snow has cancer, I’m wondering if Bush has gannon or haggard yet? And of course Cheney has Lynn which is most certainly terminal.

  113. JPark says:

#108 I hope that is the reason because I like to see the nasty ones get beat down too. I hope it isn’t fear that causes the curious difference in deletions.

  114. JPark says:

To be fair I usually know why I get deleted :)

  115. Zep Tepi says:

hat is the thing Zep. It can’t logically exist inside anything. Logically, there can be no limit to the universe but that makes no sense. It is beyond comprehension that something goes on forever. But it must…otherwise, what is beyond it? Comment by JPark

Current physics state it is expanding.

Okay, Imagine this, inside our skull actually looks like a planetarium, if we were real small and in there looking up at it we would see the stars above =)

  116. Zep Tepi says:

welp I’m off to bed and to stare off into my inner planetarium!

    GN!

  117. JPark says:

I know that is the theory but how can the universe expand? What is it taking the place of? Nothing? It is too much for the human brain to take in.

  120. Ben Dover says:

We can only hope these bastards continue to be fatigued by their scandals. The beginning of the end for the Republic Party was their high-handed attempts to get in the way of Terry Schiavo’s husbands decision-making. Since that sad and sordid affair it seems the media have grown a small spine and the American public has finally removed its rose-colored glasses. Its my most sincere hope that for the next 664 days a new scandal comes to the public’s attention each and every day. Really big stuff like Jack Abramoff or the US Attorney firings or god/allah/vishnu knows what. Anything and everything that results in the Republic Party having even more egg on their collective smug faces.

When you choose to take the 5th you are kinda saying you did something and you don’t want to talk about it.Or you may have done something the people who question you may not like. So I’m not sure why someone would have to take the 5th in case they were in a hostile setting and may be misunderstood, arrested and immediately placed in jail unless they did. But,there has been so much inbreeding at all levels with every combination the mental stability of the entire gop subculture may feel they have done worse than the worst and know they deserve punishment.Like Ant Culture if she were left in a prison for sexual deviants a few days until she found she liked it allot. Then had severe quilt and just wouldn’t want to tak about it.At least not in a hostile setting.Or who knows. She might.Never mind.

    Trueblue, that’s like in Guantanamo!

Jake, look the Bush administration has managed to get the US on the same level as the witch hunters of the middle ages. Well done, Mr Bush.

It’s sad for the Right. If they’d succeeded in hacking the 2006 vote (which they tried to do), our wounded soldiers would still be lying around in their own urine–but we wouldn’t know about it.

Congress would still be buggering pages at will; they’d still work from Tuesday to Thursday.

And they’d be focusing on the really important issues: destroying internet neutrality, screwing up Social Security, giving more powers to The Worst President Everâ„¢, preparing to nuke Iran, gaming the 2008 elections, and instituting the draft–the really cool stuff.

  126. Com-n-sense says:

Well, boo-hoo … I am having a real hard time feeling sorry for a bunch of so-called law-makers that are now being held accountbale for breaking any law that would get in the way of their own self interests.

How does impeachment work for non-elected officials?

    Comment by Jake — March 27, 2007 @ 10:59 pm

Jake knows because he was Jesus’ attorney. Some days he’s an attorney, some days he’s a doctor. Some days he’s Catholic some days Baptist. Which ever way the wind blows.

  129. MrBlueSky says:

    Com-n-sense (#124) is correct.

I recall a quote from the X-files around the same time as the Clinton impeachment mess:

You can’t conjure up the devil and then expect him to behave.

    - Fox Mulder

The Republicans have sowed the wind and are now starting to reap the whirlwind… they sacrificed their long term viability, credibility and majorities in Congress for their paramount desire, the zenith of their power, the war in Iraq.

This is what they wanted since before 1994. So, in my view, they should not “demur” when it comes back to bite them.

This is the true mystery to me.

    I am a left-leaning independent… I don’t care much for either party.
But, whatever party does… they need to take responsibility for it.

(I really feel bad for the good Republicans, like both Senators from Maine… their reputations will be tarnished – even though these particular Republicans did nothing wrong. Just ask Lincoln Chafee!)

[...] Republicans are said to be suffering from “scandal fatigue” all I can say to them is imagine how awful we Dems feel. The fact that Libby was found [...]

  131. Cynicon Implant says:

This whole thing reminds me of the “witch” scene from Monty Python’s Holy Grail…

Repubs: “What eveidence do you have that this woman is a witch?”

US Attorney; “She turned me into a newt!”

Repubs: “You don’t look like a newt”

    US Attorney: “I got better”

    Dems: “Burn her anyway!”

  132. MrBlueSky says:

    I just LOVE Trolls!

    * sigh *

  133. Not Canadian says:

    Just wait Repukes.

Scandal Fatigue is a precursor to Impeachment Hearings and caused by Professional Corruption.

  134. Pete Bogs says:

maybe you guys wouldn’t be so worn out if your party weren’t so damned crooked!

  135. Carl Gordon says:

So the question seems to be: To fund or to pout. Listen, youse guys that elected (sort of) him to office are now responsible for enabling his bratty behavior and propping up the opiated decaying rotting hulk of his reality. It’s just so unbelievable how this country got to the point where this doofus is running the show. Not only is he delusional, but if you could only read his (limited) thoughts…….

(Dreamy music slowly fades in as the screen first blurs then sharpens to crystal clarity)

It was the soft, dull hollow thud that turned his head to the street as DICK saw ‘lil Georgie fly through the air like a mad-capped tard trapeze artist or even an wayward angel with a busted wing and poor communication skills. The foam head of his beer and the president went flat, and DICK saw stars twinkle in the late afternoon sky, like a song sung by squeaky voiced castratti. All chaos and confusion ensued as he viewed the flayed arms and legs, in a kind of twisted swastika. Some of the dipshits that elected him hummed hymns, while DICK absently threw some change into the small, white porcelain dish. A young girl brushed passed him in a fleeting memory of love long lost, there among the elderberries and lilies, from a time when all smelled of fresh pie and clean laundry.

    (Fade back to reality)

That’s where we all are right now. Laying about with no direction. Sucking up the beer. Focused on how to make it through one day at a time. Looking at a sundial that casts no shadow. And we’re all caught in that shadowy equinox that sticks in your craw.
