Hatch ‘Corrects’ Lam Error By Disparaging Another U.S. Attorney — Will Russert Repeat It?

hatch.jpgLast week on Meet the Press, Sen. Orrin Hatch (R-UT) tried to disparage the record of U.S. Attorney Carol Lam:

HATCH: She was a former law professor, no prosecutorial experience, and the former campaign manager in Southern California for Clinton, and they’re trying to say that this administration appoints people politically? Of course they do. That’s what these positions are.

In fact, as Rachel Maddow found, Lam had more than 14 years experience as a prosecutor, and was neither a law professor nor a former campaign manager.

In response, Hatch sent a letter to Meet the Press host Tim Russert asking him to correct the record. Hatch said that his attack was meant not for Lam but her predecessor, Clinton-appointed U.S. Attorney Alan Bersin.

I would appreciate your help in correcting a mistake I made on your show last Sunday, April 1, 2007.

My comments about Carol Lam’s record as a U.S. Attorney were accurate, but I misspoke when making the point of discussing politically connected U.S. Attorneys. I accidentally used her name, instead of her predecessor, Alan Bersin, who was appointed by President Bill Clinton.

Hatch’s “point” is that Bersin was an unqualified, “politically connected” appointee. In fact, Bersin was arguably well-qualified for the position:

– Graduated magna cum laude from Harvard University
– Served as a Rhodes Scholar at Oxford University
– Received his J.D. degree from Yale Law School
– Served as a senior partner for 17 years at the Los Angeles law firm Munger, Tolles & Olson, where he “specialized in complex RICO, securities, commercial and insurance litigation before state and federal trial and appellate courts”
– Special Counsel to the Los Angeles Police Commission

After stepping down as U.S. Attorney, Bersin served as Superintendent of Public Education in San Diego City Schools, the nation’s eighth largest urban school district, and was named California’s Secretary of Education in 2005.

Now, the question is: this Sunday, will Tim Russert simply read Hatch’s statement disparaging Bersin’s qualifications? Or will he state the full facts about Bersin’s record? You can email Meet the Press HERE to encourage them.

    We’ve got Hatch dead to rights on the important question here – he tried to offer and defense of firing Lam, and he’s got nothing. There’s nothing to be gained by turning this into an issue of whether Hatch is stupid or evil. That just lets the Republicans off the hook on the important question: Why were these firings carried out.

    If such is the will of the Citizens of the United States the following is a proposed plan to initiate the impeachment of President Bush and Vice President Cheney and negate the positions of all Bush appointees. The plan is contingent upon only one thing: the desire of the majority of registered voters in this Country. Short of having an election across the Country this plan is based on the same concept as the Electoral College but without the possibility for corruption that has been demonstrated in the last two Presidential elections.

    GIVEN:

    1. For the purposes of elections this Country is divided into Precincts, by County (local terms may vary for either or both), and by State. The Precinct being the prime component of the collection and compilation of the votes.

    2. The number of potential voters in each Precinct is calculated to give each individual the opportunity of “one man, one vote.” Since it is assumed that all eligible voters will register, the terms will be used synonymously regardless of actual practice.

    3. The voters are registered with Party Preference.

    4. The individual receiving the most popular votes in the appropriate election in each Precinct becomes the US Representative from that Precinct and State in the House of Representatives.

    5. The individual receiving the most votes in the appropriate election from all the Precincts within a State becomes a Senator from that State.

    6. The Representatives (one per Precinct) from each Precinct and Senators from each State (2) are morally, if not legally, required to reflect the desire of their constituents. Note: The term “Constituents” encompasses only the Registered Voters in the applicable district (Precinct or State) and DOES NOT include non-voting entities (PAC’s, Corporations, Special Interest Groups, lobbyists, and Briberies, etc.)

    PROCESS:

    1. The House and Senate appoint a bipartisan committee to determine, through the following process, the will of the Registered Voters of the United States of America concerning the answers to the four (4) questions (Only “Yes” or “No” responses accepted):

    A. Should President George W. Bush be impeached and removed from office?

    B. Should Vice President Richard Cheney be impeached and removed from office?

    C. Should the political appointees of President Bush be submitted, or resubmitted as the case may be, to Congress for review and approval?

    D. If the Representative or Senator from my Precinct or State does not vote as the majority indicates their preference, should said Representative or Senator be removed from office?

    2 The Committee shall establish a staff competent and qualified to perform the following:

    A. Obtain an accurate, up to date, list of Registered Voters of each Precinct in the Country (the list must conform to the list of Representatives.

    B. Develop a Sample Size for each Precinct by Party Registration that will assure at least a 95% accuracy of representing the Precinct as a poll when polled.

    C. Randomly select, by Party Registration, the registered Voters of each Precinct to be polled.

    D. Prohibit any individual or entity from contacting any of the selected voters for the purpose of influencing their vote or attempting to determine their vote prior to the prescribed date.

    E. Conduct the survey using methods that will guarantee, to the greatest possible degree, the accuracy of the survey. Collect and compile the data and review the results for any statistical abnormality. Correct abnormal results to assure an accurate survey.

    F. Provide the responses to the above questions to the Committee.

    3. The Committee shall provide the results of all Precincts to the Speaker of the House of Representatives and to each Representative the results of her/his Precinct only. The Speaker of the House will determine if the survey indicates sufficient support to warrant the introduction of a Bill of Impeachment against the President and/or Vice President. If such a determination is made the Speaker of the House will immediately introduce such a Bill and call for a voice vote and before each Representative records her/his vote the Speaker will reveal the results of the poll.

    4. Should the resulting vote be that the Bill of Impeachment fails the subject is dropped and returned to the voters. If the Bill of Impeachment passes it shall be sent to the Senate for the appropriate action.

    5. At the time the Bill of Impeachment is passed to the Senate the Committee will provide the results of the survey (compiled by State) to the Majority Leader (Total) and each Senator (State results only). The Senate shall call for a vote on removal from Office and the Majority Leader shall read into the record the result of the survey for each State before the Senators from that State cast their vote.

    6. The results of the voting will be acted upon accordingly. If appropriate, Congress shall act upon the results of Questions C and D in the applicable manner.

    Technically, he’s supposed to take away his temple recommend.

    There are several specific requirments for holding a temple recommend, and I won’t go into all of them here. But one of the KEY ones, is that the bearer be “honest in his dealings with all men”.

    It does not sound to me like Mr Hatch is meeting that requirement.

    After attending a family reunion last week, all of which were republican, I am convinced these people DO fully understand what is going on, but do not want to ruin their ‘beautiful minds’ talking about it or being bothered by it.     As we have found out through research by radio personality Rachel Maddow, Sen. Hatch was incorrect in his statements last week on your show regarding fired U.S. Atty. Lam.

    While he should appear himself and correct his record, it seems Senator Hatch is leaving that up to you by sending a letter in his stead. Unfortunately, he takes the opportunity to slander the U.S. Attorney server prior to Lam, Alan Bersin.

    Below are Mr. Bersin’s qualifications, and if this doesn’t make him qualified to be a U.S. Attorney, then by using their logic, 90% of this current administration is woefully, and unequivocally, not qualified to be in the position they are in — including the president himself.

    I’ve written sooo many letters to sooo many congressmen, newspapers, websites, and magazines. I sent the most scathing letter to Time magazine. I’d been a subscribor for nearly 20 years and I just ended it. I wasn’t going to renew this time, anyway (Time SUCKS now), but the Stengel comments and proud refusal to report on the AG scandal were the last nails in the coffin. Then I got the one with the “Case for teaching the Bible in Public Schools” on the cover. I’m not reading *&$#@ Time anymore. I could understand if they made the case for teaching religion and/or theological history in schools, but to tell such a diverse population that only one religious view is worthy of teaching our children is disrespectful, irresponsible, and downright un-American.

    Sorry, went off point – I’m so mad. What I was going to say is I feel that all my writing has done little in the way of making change. I don’t think anyone even reads them – all I ever get back are form letters. I wish I didn’t feel so helpless. I’m just watching this country get flushed, the Constitution being treated with complete disregard, and our leaders lying like it’s some kind of great sport. It’s like a nightmare from which I can’t wake. Sometimes I wish I was one of the ignorant goons out there who believes all the lies (or pretends to to justify – hell I don’t even know what). My patriotism runs deep, though, and I can’t stand the thought of evil, greedy people at the helm of such a beautiful ship. I want the truth, even when it hurts, even when it totally gives me the blues, like tonight.

    Thanks, Marie. When I feel this frustrated, I just have to remember that the American people are very resilient and our democracy has come through some really dark times and prevailed. There were many frustrated Americans in our history who got bewildered, got disgusted, got mad, and made a difference – they pulled together and shifted things in a different direction to find the right path. The bloggers are a good example of that. We’ve lost the mainstream media. It is bought, thanks to government deregulation, which lead to giant media conglomerates taking control – a few people controlling all the news. (”If they own the information, they can bend it all they want,” John Mayer.) However, as in the past, there are crafty, resourceful, resilient Americans who refused to accept nothing less than the absolute truth, so they found a different way to find it and put it out there. I think things would be much worse if it weren’t for them. When I feel like I do today, I can read some of the threads and see that I’m not alone. What gives me hope is that all of our little voices can get really loud together.

    Isn’t Henry Waxman great? I think HE is the toilet cleaner, John. Just quietly digging, purging, and shining the light under the rug, in the basement, and in the dark corners of their house. I LOVE that guy. If impeachment is to be put on the table, it will be Waxman who serves it on a silver platter. I know if Samjax could clean out this toilet, I’d flush both the prez and vice prez – impeach them both! It’s going to take more than 2000 flushes, though. We are going to have to get the plunger and the snake and the Drano and the plumber. There’s a lot of crap…

    The feeling is there but I suspect it is more of an uprising against the government than a Civil War. To Compare: Our Revolutionary War was not a Civil War in that the Colonists banded together to fight an outside Government, if you will. Our Civil War set State against State, a fully “In-house” conflict. The growing concern today is not so divisive as was the conflict in the 1850’s. Now we have the thinking citizens rebelling against a Government that has one goal: the proliferation of wealth among the selected at the cost of the proletariat. What that means is that the bushco corporate greed will take your wallet.     Basically they other mothers I met because of my daughter. And I really like them except when politics comes up. Basically they are uninformed and just following the party line they were raised on.

    One of them I get some conservative cutesy email from but I really think it’s her husband sending things to people in her address book. Because I went postal one time and really chewed her out and never heard another thing about it.

    I tended bar for 15 years and could really find people to have serious political discussions with. But since I had my daughter the pickings have been slim. One of my bar customers was an IRA member moved here from Belfast. I’d love to talk to him now.

    My part is to read these blogs (and the links that back them up), I print the stories and bring them to work for my co-workers to read, and I cannot believe how many people ask questions about what is going on in the govt these days, I make it a point to let people know that the information is all over the internet for all to see and make there own decision as to what they should be doing about the dumbing down of the average citizen.

    The deceptive information that we receive is being called out on a daily basis by people like Waxman, Conyers, Levin, and others that still know what the word “moral” means, and are making our govt accountable on all levels whether they like it or not.

    As for Orin Hatch and MTP last week, it will be interesting to see what Tim has to say about this, if anything.

    If Tim has no comment, or Orin has no public retraction (on MTP) no letter is acceptable, then I will spend my time doing something else on Sunday morning, this does not sound like much, but Mr. Russert, I have watched your program for over 15 yrs, and you are one day away from losing a faithful viewer, hope you do the honest thing.

Truly they do, and they are disproportionality imbued with power and might and certainly the will to use it.

    There is no answer but revolution, because the police state is so all encompassing and because technology affords this segment of our government the opportunity to so thoroughly surveil the population that individual movements against the autocracy result in the loss of liberty in isolation. Nobody will know when the next revolutionary will be secreted away and stifled.

    This is the new reality and we will live under this blight or turn against it, and if we do turn against it in a meaningful way it will be unimaginably ugly.

    Perhaps you are unaware of RICO. It’s an acronym for the Racketeer Influenced and Corrupt Organizations Act. It’s a federal law that provides for extended penalties for criminal acts performed as part of an ongoing criminal organization. To quote Wikipedia:

    “Under RICO, a person or group who commits any two of 35 crimes—27 federal crimes and 8 state crimes—within a 10-year period and, in the opinion of the United States Attorney bringing the case, has committed those crimes with similar purpose or results can be charged with racketeering. Those found guilty of racketeering can be fined up to $25,000 and/or sentenced to 20 years in prison. In addition, the racketeer must forfeit all ill-gotten gains and interest in any business gained through a pattern of ‘racketeering activity.’”

    Private citizens can file RICO charges although these charges implicate criminal activity. The Act provides the right to private entities to perform the duties of prosecutors. In essence, those bringing RICO charges act as citizen prosecutors.

    SEC and insurance litigation also provide the opportunity for private citizens to prosecute criminal prosecutions in civil courts. After 17 years as a senior partner specializing in RICO, SEC and insurance litigation, the guy’s got the expertise to manage and litigate in any litigation department in the country, if not the world. It’s a joke to say he has no prosecutorial experience.

    3. Don’t know whether Bersln was ever a campaign manager in Southern Cal, but Lam definitely wasn’t.

    Not sure of your angle, but your facts and analysis are misleading.
