Hold on, Hatch didnâ€™t claim he was talking about Berslin. He claimed he thought those facts, which actually applied to Berslin, applied to Lam.

Weâ€™ve got Hatch dead to rights on the important question here - he tried to offer and defense of firing Lam, and heâ€™s got nothing. Thereâ€™s nothing to be gained by turning this into an issue of whether Hatch is stupid or evil. That just lets the Republicans off the hook on the important question: Why were these firings carried out.

Hatchâ€™s â€œpointâ€ is that Bersin was an unqualified, â€œpolitically connectedâ€ appointee. In fact, Bersin was arguably well-qualified for the position:

â€“ Served as a Rhodes Scholar at Oxford University
â€“ Received his J.D. degree from Yale Law School
â€“ Served as a senior partner for 17 years at the Los Angeles law firm Munger, Tolles &amp; Olson, where he â€œspecialized in complex RICO, securities, commercial and insurance litigation before state and federal trial and appellate courtsâ€
â€“ Special Counsel to the Los Angeles Police Commission

Now, point by point, Hatch&#039;s comments not only fabricated Lam&#039;s history, but slimed Berlin&#039;s:

1.  Neither was ever a law professor;

2.  Lam has prosecutorial experience; Bersin â€œspecialized in complex RICO, securities, commercial and insurance litigation before state and federal trial and appellate courtsâ€

Perhaps you are unaware of RICO.  It&#039;s an acronym for the Racketeer Influenced and Corrupt Organizations Act.  It&#039;s a federal law that provides for extended penalties for criminal acts performed as part of an ongoing criminal organization.  To quote Wikipedia:

&quot;Under RICO, a person or group who commits any two of 35 crimesâ€”27 federal crimes and 8 state crimesâ€”within a 10-year period and, in the opinion of the United States Attorney bringing the case, has committed those crimes with similar purpose or results can be charged with racketeering. Those found guilty of racketeering can be fined up to $25,000 and/or sentenced to 20 years in prison. In addition, the racketeer must forfeit all ill-gotten gains and interest in any business gained through a pattern of &#039;racketeering activity.&#039;&quot;

Private citizens can file RICO charges although these charges implicate criminal activity.  The Act provides the right to private entities to perform the duties of prosecutors.  In essence, those bringing RICO charges act as citizen prosecutors.

SEC and insurance litigation also provide the opportunity for private citizens to prosecute criminal prosecutions in civil courts.  After 17 years as a senior partner specializing in RICO, SEC and insurance litigation, the guy&#039;s got the expertise to manage and litigate in any litigation department in the country, if not the world.  It&#039;s a joke to say he has no prosecutorial experience.

3.  Don&#039;t know whether Bersln was ever a campaign manager in Southern Cal, but Lam definitely wasn&#039;t.
