Rep. Nick Rahall (D-WV), who traveled last week with Speaker Nancy Pelosi (D-CA) as part of her delegation to the Middle East, said this morning on C-Span that Pelosi told Bush of the trip to Syria a day before they left, and Bush did not object.
Rahall said, “The Speaker had met with President Bush in the halls of the U.S. Capitol just the day before we left and mentioned to him that we were going to Syria. No response at all from the President.”

Despite the White House’s public rhetoric that the trip was a “bad idea,” President Bush “did not tell her not to go, nor did the State Department tell us not to go,” Rahall said. “The State Department was certainly aware of our traveling to Syria and our full itinerary. And there were State Department officials in every meeting that we had on this codel. So that is all hogwash as far as I’m concerned.”

CALLER: I am a Republican. And I thought under the Logan Act that Ms. Pelosi has committed a felony because under our Constitution, section 2 of the Constitution, that the president is the one who conducts — sends the people off, to conduct our foreign affairs. Now he told her he didn’t want her to go. That is a violation of the Logan Act. She should be hauled off in jail because if i was to commit a felony, i’d be hauled off and gone to jail.
RAHALL: First of all, that’s baloney. We were in violation of no u.s. laws. Second of all, the President did not tell her not to go, nor did the State Department tell us not to go. There were three Republican members of Congress in Damascus a few days before our trip. There was a Republican member of Congress in Damascus meeting with the President after our trip.

Not so fast.
The Logan Act specifically prohibits private citizens from negotiating wit foreign governments. Members of Congress are not private citizens: They are part of the government.
Also, Pelosi did not travel to negotiate with Assad, but to talk with him; the same goes for the Republican delegation that preceded Pelosi’s visit, and the one that followed it. Not to mention the Republicans accompanying Pelosi in her delegation. Your talking point would mean that all delegations violated the Logan Act.
I would mention Congressional delegations that have traveled abroad to engage foreign governments in previous administration, but I think my point is clear.
As for recent applications of the Logan Act, in 1975 two US senators were accused of violating the Act for traveling to Cuba, of all places. This is what the DoS said at the time:
The clear intent of this provision [Logan Act] is to prohibit unauthorized persons from intervening in disputes between the United States and foreign governments. Nothing in section 953 [Logan Act], however, would appear to restrict members of the Congress from engaging in discussions with foreign officials in pursuance of their legislative duties under the Constitution.

What you are saying in essence, is that members of Congress should sit tight behind their desks, waiting for the president to fund tis or that foreign policy initiative, without becoming involved in what they are funding. Regarding the Fairness Doctrine. I think a new Fairness Doctrine is long overdue. The main difference is that it SHOULD allow opinion shows, opinion channels, opinion websites, and opinion newspapers, but there should requirements that, say, two to four times per hour or visible on the top-half of the front page (etc), they have a announcement saying “This is an opinion program/website and does not necessarily equally present all sides of an issue” or something like that. Then Rush and O’reilly, as well as favs of mine like Thom Hartmann and Stephanie Miller can stay on the air and it won’t impede their business, as it will only make sure that listeners KNOW they aren’t hearing balanced news. I garauntee you that the only ones against it would be the Limbaugh types.

I sent a letter to my good friend Nancy and suggested she do just such a thing. I like to think my little letter might have had some impact. That makes me very proud. I just hate they took this long to decide which story to tell! It would have been better if they had a story set up before they got back to the States, but this is still good and pretty believable.
