That is something I posted over at TMP Muckraker earlier this week. Claiming that they were being cautious about violating the Hatch Act is a tacit admission they were fired for political, not performance reasons.

The RNC accounts were set up to separate official business from political work. The firings of the prosecutors were discussed using the political accounts, not the official business accounts!

The implication is that the firings were political, which lends credence to the theory they were fired to obstruct justice.

Another implication is that the White House aids were conducting business on political accounts in order to evade the Presidential Records Act requirements.

Finally, since these emails were on the political accounts, to put forward the claim that they constituted official business in order to shield them from Congressional subpoenas gives further credence to the implication that the Presidential Records Act was violated.
