WH claims executive privilege over RNC emails.»

In a letter to the RNC, Emmet Flood, a special counsel to President Bush, “today again raised the possibility of an executive-privilege claim on e-mails and other documents from private e-mail accounts used by senior White House officials” but controlled by the RNC. Rep. John Conyers (D-MI) called the request “extreme and unnecessary” and said it was “a clear attempt, on the Administration’s part, to delay this process and keep the wheels of Justice turning slowly.”

    Of course they want to claim executive privilege over these emails.

The U.S. Supreme Court has upheld Executive Privilege, most recently regarding details of Vice President Dick Cheney’s meetings with energy executives.     If you don’t have one, you can get auto window paint (like the kind used by high school football teams) to display your sentiments as you drive around town. You can wash it off later or wait till it rains - or keep repainting it!

    Every action by this corrupt cabal gives additional reason to impeach them. It makes impeachment for lying about a blow job in the oval office look silly by comparison.

    Actually the Flood letter doesn’t claim executive “privilege” (which is a legal term) but executive “interest”. Which has no basis under precedent or law.

    Furthermore, if the White House is claiming “a clear and indisputable Executive Branch interest” in the emails, then that pretty much is a de facto admission of violation of the Hatch Act since if the RNC emails weren’t comprised of off-the-books policy transactions or political activity on White House time, then they wouldn’t be of any material official White House interest and hence covered by executive privilege.

    If it was political, and hence they had to RNC email because it would otherwise violate the Hatch Act, then it isn’t privileged executive communication. If it IS privileged because it was about official WHite House policy, etc. using RNC email means a violation of the Presidential Records Act.

    Furthermore, if it was RNC email to avoid the Hatch Act, then it is a tacit admission that the US Attorney’s were fired for political, not performance reasons.

    These communications were deliberately kept outside of the approved channels to circumvent the Presidential Records Act. If these communications don’t qualify to be recorded under the Presidential Records Act, they don’t qualify for the protection of Executive Privilege either.

    I think that it’s clear by now that Bush cares primarily about power and influence. He supports the needs of the people and corporations that support him. This, unfortunately, leaves out more than 90% of the population. He keeps power primarily through public relations (lies and spin) and the support of the under-10%.

    It becomes a vicious circle. The 10% can’t benefit at the expense of the 90% unless roughly half the adult population thinks what Bush/the Reupublican party have said and done make sense one day every four years. That can be done through either truth or public relations. The truth won’t work since only 10% are benefitting.

    That’s really the thing of it. They fucked up and broke the law in how they went about organizing the firing US Attorney’s, one way or another, then lied to congress about it.     #2, I seem to recall reading something somewhere that Bush refuses to use email. So there isn’t likely any emails at the RNC or the White House that were sent directly to King George.

    Regardless, if those emails are so frickn’ important, they shouldn’t have used their RNC accounts. Not that I believe in executive privilege but any remote claim they had they tossed out the window the moment those electrons left the White House network.

    Refusal to turn them over should lead to automatic impeachment.

    Have you taken your cues from Fox News and just assume you can spout lies and no one will call you out? Just to keep you informed since, as pew reported, Fox news is doing a really bad job of doing that for you:

    1. Cheney’s Energy conference, ignoring legality issues, never reached the Supreme Court because the Rubberstamp masquerading as congress never forced the issue.

    2. If they are claiming Executive privilege, that is an admission of guilt on the PRA.

    3. There is no evidence that Executive Privilige applies to RNC communication and has no basis in law.

    I haven’t read all the comments yet, so if this has been said please forgive me. But the WH has absolutely no legal claim to “Executive Privilege” to RNC-controlled emails. They WOULD have that claim to in-house emails, but because there 1) is a possibility of criminal intent involved and 2) there is no “national security” issues here, even internal emails can’t be excluded with that claim. The Nixon tapes set the precedent via the Supreme Court.

    15. The deliberative process privilege is highly qualified and it depends on a balancing test; it is far weaker than the presidential communications privilege. When “there is reason to believe that the documents may shed light on government misconduct, ‘the privilege is routinely denied.’”

    (emphasis added)

    As I pointed out earlier, in attempting to extend Executive Privilege over emails on a political party’s server, the argument must necessarily state that the emails were “official business.” This, in turn, brings up the question of why was official business conducted outside of the White House servers, and certainly gives the appearance of an attempt to bypass the Presidential Records Act. Bypassing the Presidential Records Act would be an act of misconduct.

    Hopefully, Congress will fast track this through the courts. (Remember how fast Congress acted in the Shiavo case?) I expect Bush will do everything possible to drag this out until he is no longer in office. (how long did it take Bush to finally file charges against Padilla? three years?)

    Executive “interest” is a nice word game, intended to suggest that it carries the same weight as executive “privilege”. It doesn’t. In fact, “interest” carries no legal weight at all.

    The RNC claims that it treated alll these WH e-mails as routine traffic. Hence, it was not acting as a govt IT services provider under a stringent written contract. It was just a recipient of e-mails. As a result, any executive privilege that might have attached to some of this correspondence has been lost. It’s gone. Zip. Nada. Gone with the Wind.

    There is no valid legal basis for the RNC to refuse to comply with a Congressional subpoena. We’re now where Dick Cheney likes it. He gets to slap his on the table and claim that it’s bigger. Let’s see if he uses the same size ruler as everybody else.

    which Fielding has suggested they most likely have, then that in
    and of itself, deserves the scrutiny of House and Senate oversight.

    - - So if the WH is attempting to preview all RNC emails for official
    Executive privileged communications, why should they be able to decide what is seen? Only the relevant investigatory committee, in this case the House Judiciary, should be able to make that distinction. If the WH objects, let a mutually agreed upon special counsel/prosecutor decide what is relevant and what should be protected.
