Today, Karl Rove came out in front of the AEI in a garter belt, high heels and a whip and claimed that Bush claimed executive privilege over lady justice. The nazis at the AEI all clapped while secretly wearing pink lace under their Brooks Brothers suits.

-The House Judc. Cmte. is investigating whether the WH used RNC
email addresses to circumvent WH retention of communications,
which the WH was legally required to retain, concerning whether they have been used as cover in the investigation regarding the US Atty firings, and, more importantly, whether they used as an intentional attempt at a circumvention of the Hatch Act.

If they possibly used RNC emails for official Executive business,
which Fielding has suggested they most likely have, then that in
and of itself, deserves the scrutiny of House and Senate oversight.

- – So if the WH is attempting to preview all RNC emails for official
Executive privileged communications, why should they be able to decide what is seen? Only the relevant investigatory committee, in this case the House Judiciary, should be able to make that distinction. If the WH objects, let a mutually agreed upon special counsel/prosecutor decide what is relevant and what should be protected.

Executive “interest” is a nice word game, intended to suggest that it carries the same weight as executive “privilege”. It doesn’t. In fact, “interest” carries no legal weight at all.

The RNC claims that it treated alll these WH e-mails as routine traffic. Hence, it was not acting as a govt IT services provider under a stringent written contract. It was just a recipient of e-mails. As a result, any executive privilege that might have attached to some of this correspondence has been lost. It’s gone. Zip. Nada. Gone with the Wind.

There is no valid legal basis for the RNC to refuse to comply with a Congressional subpoena. We’re now where Dick Cheney likes it. He gets to slap his on the table and claim that it’s bigger. Let’s see if he uses the same size ruler as everybody else.

I direct your attention to point 15 in the above linked article:

15. The deliberative process privilege is highly qualified and it depends on a balancing test; it is far weaker than the presidential communications privilege. When â€œthere is reason to believe that the documents may shed light on government misconduct, â€˜the privilege is routinely denied.â€™â€

(emphasis added)

As I pointed out earlier, in attempting to extend Executive Privilege over emails on a political party’s server, the argument must necessarily state that the emails were “official business.” This, in turn, brings up the question of why was official business conducted outside of the White House servers, and certainly gives the appearance of an attempt to bypass the Presidential Records Act. Bypassing the Presidential Records Act would be an act of misconduct.

Hopefully, Congress will fast track this through the courts. (Remember how fast Congress acted in the Shiavo case?) I expect Bush will do everything possible to drag this out until he is no longer in office. (how long did it take Bush to finally file charges against Padilla? three years?)

If the constitution and bill of rights is put back in place as it was ,I’ll think seriously of speaking out on behalf of the democratic party .If these laws are still in place in 19 months I will be lending my support to Ralph Nader (or another 3rd party candidate),who has it right when he says that ours is a democracy by of and for the coporations !
Time for a real change in The American political landscape !
