Leahy Blasts Gonzales Over ‘Highly Troubling’ New Secret Memo»

Murray Waas revealed in the National Journal today that Alberto Gonzales “signed a highly confidential order in March 2006 delegating to two of his top aides” — chief of staff Kyle Sampson and counsel Monica Goodling, who have both since resigned — “extraordinary authority over the hiring and firing of most non-civil-service employees of the Justice Department.”

Waas says the memo “suggests that a broad effort was under way by the White House to place politically and ideologically loyal appointees throughout the Justice Department, not just at the U.S.-attorney level”:

A senior executive branch official familiar with the delegation of authority said in an interview that — as was the case with the firings of the U.S. attorneys and the selection of their replacements — the two aides intended to work closely with White House political aides and the White House counsel’s office in deciding which senior Justice Department officials to dismiss and whom to appoint to their posts. “It was an attempt to make the department more responsive to the political side of the White House and to do it in such a way that people would not know it was going on,” the official said. […]

A senior Justice Department official, who did not know of Gonzales’s delegation of authority until contacted by National Journal, said that it posed a serious threat to the integrity of the criminal-justice system because it gave Sampson, Goodling, and the White House control over the hiring of senior officials in the Justice Department’s Criminal Division, which oversees all politically sensitive public corruption cases, at the same time that they held authority to hire and fire U.S. attorneys.

In a new statement, Senate Judiciary Chairman Patrick Leahy (D-VT) said the secret order “would seem to be evidence of an effort to hardwire control over law enforcement by White House political operatives,” and demanded that it be turned over to congressional investigators immediately:

This memorandum should have been turned over to Senate and House committees as part of requests made in ongoing investigations. I expect the Department of Justice to immediately provide Congress with full information about this troubling decision as well as any other related documents they have failed to turn over to date.

“It is disturbing to learn that the Attorney General was granting extraordinary and sweeping authority to the same political operatives who were plotting with the White House to dilute our system of checks and balances in the confirmation of U.S. Attorneys.

“This development is highly troubling in what it seems to reveal about White House politicization of key appointees in the Department of Justice. The mass firing of U.S. attorneys appeared to be part of a systematic scheme to inject political influence into the hiring and firing decisions of key justice employees. This secret order would seem to be evidence of an effort to hardwire control over law enforcement by White House political operatives.

“This memorandum should have been turned over to Senate and House committees as part of requests made in ongoing investigations. I expect the Department of Justice to immediately provide Congress with full information about this troubling decision as well as any other related documents they have failed to turn over to date.”

    Many are forgetting what I believe is the most disgusting part of this scandal: Sneaking the key provision into the Patriot Act without (allegedly) a single elected member of the House or Senate knowing about it. Spector denies he knew, although his aide put it in. Is Spector lying; if so, that’s horrible. Is Spector telling the truth; if so, that’s horrible.

    How can a law be passed if nobody even knows s/he is voting on it?

    This memo is highly troubling. Both Sampson and Gonzales had ample opportunities to mention the darned thing during testimony, requests for documentation aside. I’ve read the Waas article, and wondered if anyone knows if the instruction not to file it with the Federal Registry has any significance? Anyone know?

    This fits with the message statement of Regent University that said “God should be in all branches of the government. By putting on these goofballs into jobs that they are absolutely not qualified for is just stunning–they are absolutely destroying this country.

    Congress should step in and impose a total freeze on all new hires, transfers from one agency or branch to another until this can get straightened out. Then they should go in and go through every individual hired in the last 6 years and document them so that they can be canned in the event Bush and Cheney are impeached or when a new administration comes in. This is beyond revolting–it is sabotaging the government for their own personal gain.

    There better be a special place in hell for these asshats.

    This administration has been systematically preparing for a Coup d’état the entire time they’ve been in office, it seems. The Patriot Act was signed swiftly after 9/11, in late Oct, 2001. Remember, Dept of Justice staffer James Baker testified before Congress at the time that the Patriot Act revisions completely met the needs of the Administration for clandestine information-gathering. And yet we learned later that at that same time, President Bush was authorizing the “Terrorist Surveillance Program” which spied on American citizens in the US without warrant or court order.

    Remember also the change in the Insurrection Act which makes it possible for the President to press the National Guard into national service without the authorization or consent of the govenors of the States. () Under the revised law, the President may declare martial law if a condition exists that “opposes or obstructs the execution of the laws of the United States or impedes the course of justice under those laws.”

    With the Justice Department packed, the power to declare martial law, and unlimited access to information about the citizenry, the administration is still in a very powerful position in spite of the loss of Congress in Nov last year. i have wondered whether a hot war with Iran would provide dubya enough excuse to declare martial law and suspend the 2008 presidential elections.

    They politicized the DOJ so they could trump up charges of “Democrat voter fraud” in order to put up a smokescreen for the actual voter fraud and execute the theft of the election in ‘04 and continue the steamroll on to ‘08. Rove even announced what he was up to at his speech to a Republican Lawyers’ powow. (Rove miscalculated the wave of opposition in ‘06 but had no intention of making the same mistake in ‘08.) Karl actually said that because of the “voter fraud” perpetrated by Democrats, elections got down to who stuffed the ballot box the best. He didn’t hone his skills with Jeb Magruder (1st to plead guilty in Watergate) in the re-elect Nixon campaign to be chopped liver.
    He’s the best, baby.

    I’m sure there is a good explanation for this. He doesn’t remember when he delegated this authority to them but he remembers he had a proper reason for delegating it. And of course, that’s why he takes responsibility for the decision as evidenced by the fact that Sampson and Goodling are now gone while he remains in his position. He delegated both the decision-making AND responsibility to Sampson and Goodling.

    This administration is being run just like the well-oiled corporation the CEO-in-Chief envisioned.

    Kurds To Oppose Draft Oil Law

    In a surprise move, Kurdish lawmakers have announced that they plan to oppose Iraq’s controversial US-backed oil law.

    Back in February, the Kurds had agreed to support the draft law, which has been heavily criticised as giving too much control to foreign oil companies.

    Oil Minister Hussain al-Shahristani had predicted the draft law would be approved by parliament in April, but it has yet to be debated.

    Kurds hold 58 of the 275 parliament seats _ not enough to defeat the measure on their own. But Kurdish objections could delay passage of the bill, whose ratification has been strongly urged by the White House.

    But Kurdish spokesman Khalid Saleh has said: “We are not going to support” the provisions in the bill. Some Sunni legislators have also raised now objections, saying the oil law would give foreign oil companies too much power.

    So the draft oil law could be in for a tough time before it becomes law. They will be sweating in Houston.

    Hey con10tious- I agree that the President has this authority but apparently according to Jesus Walker Bush he had nothing to do with the firings. AG Gonzales also has that right but he apparently secretly delegated that authority to several Bush toadies and then “forgot” to mention this at his hearing. For the ultimate judicial appointee to be so deceitful/forgetful coupled w/ Roves “missing” e-mails, Goodling’s taking the 5th and the White House’s stonewalling on documentation you would have to be mentaly challenged not to be bowled over by the stench of corruption emanating from the White House.
    If you read post # 75 you may begin to understand that there is a severe and growing distrust in everything this President and his corrupt group of power hungry friends touches.

    THIS IS NOT AN IMPEACHABLE OFFENSE!

    Let’s assume it’s not (it is, but let’s just assume it isn’t). Not being a legal scholar I am still qualified to point out that it is possible to impeach someone even if the majority of their offenses are not impeachable.

    So let’s say the president has breakfast - this is not impeachable, an offense for certain to waste good food, but certainly not impeachable. Then over brunch he tells his aides to ensure Halliburton, or some other company he has close ties to gets sole-source contracting to profiteer from a war he started against international law after misusing, misenterpreting, and falsifying intelligence to the congress and the American people. This one is impeachable.

    He then has lunch and tells his aides to fire any US attorneys who may be probing the sole-sourcing of said contract. He is obviously firing them to avoid investigations into his own behavior or that of close allies, but since they serve at the pleasure of the president let’s just say it’s not impeachable.

    He could theoretically go an entire week only comitting offenses that were not impeachable, but still, due to our wacky legal system, he can be impeached and convicted for the one offense that was impeachable.

    So let’s not worry so much about which offenses were impeachable. Today you can fill a library with books written on the subject of impeachable offenses this administration has committed, and essentially none of the facts in the books are even in dispute.

    If we fail to end our military Kineseyanism and global imperialism program and root out the deep corruption in our government, the US will face financial collapse in the very near future. Republicans often claim to be fiscal conservatives, ironic that they would follow an obviously twisted and evil administration straight over the financial cliff in the name of world domination - oops I mean the war on terror.

    Well, if Bill Clinton had fired all the US attorneys, investigators, and Ken Starr during the goose chase that was Whitewater and Lewinsky, would you have been so sanguine? Would you have supported his actions and reaffirmed his right to fire all the people who “serve at his pleasure”??? Bet not.

    Apparently nobody understands that impeachment is a political process to remove a person from office - whether or not that person has actually committed a crime is not necessarily relevant. The closest analogy I can think of wold be to compare impeachment to the Scottish legal system’s use of “Not Proven” in court cases; where “Not Proven” is used to indicate a belief in the person’s guilt, but acknowledges that there isn’t enough evidence to say “Guilty”. The necessity of concrete proof of illegal action is not needed under impeachment just because it is a political action.
    At present Bush could be impeached and convicted under the aegis of “High Crimes and Misdemeanors” in relation to: the misuse of intelligence prior to the Iraq invasion, the Katrina fiasco, permitting 9/11 to occur after having been warned, and finally, the obstruction/perversion of justice in relation to the FDA’s.
