Senate Judiciary Committee Chairman Patrick Leahy (D-VT) subpoenaed Alberto Gonzales today to turn over all e-mails to or from Karl Rove in connection U.S. attorney scandal. “Not accepting the White House’s explanation that some of the Rove-related e-mails may have been lost, Leahy subpoenaed any in the custody of the Justice Department.”

UPDATE: Paul Kiel notes: “Since the subpoena is to the Justice Department and not to the White House, it sidesteps any executive privilege concerns.”

    What if Gonzalez says they can’t find any and then the investigators looking for them find them or have already found them. Quite the sticky wicket. Go ahead Gonzo, make my day. Tell Leahy you can’t find any.

    The stinking criminals have had plenty of time to cover their tracks. He should have done this months ago, and had the servers at RNC examined too.
    KKKarl Rove is a slippery fat pig, greased up and running wild.

    Can someone with a legal background tell me what happens next if Gonzalez blows off the subpoena? Does Gonzo get arrested? Can he appeal to the Washington US Attorney? I think sparks are going to fly on this one, and Gonzo and Sh*t-4-brains are going to fight this with everything they’ve got.

    It would be nice to see this whole “executive privilege” concept settled once and for all by the Supremes. They have ruled that it is not absolute (Nixon tapes), and they acknowledge that all presidents since Washington have claimed it, but there is absolutely nothing in the constitution that gives the president (an employee of the people) the right to keep from the public non-classified advice he gets regarding public policy. We, especially the president, should all keep in mind that the president is not doing his job for his own benefit or the benefit of his friends, but for thebenefit of the American people. And if we want to know who suggested his energy policy (or any other), then we damn well have the right to know that.

    Nice to be able to visit again while I get my car fixed. I missed you guys.

    Don’t count on it. Gonzales is the titular head, but there are many disgruntled Justice employees who might leak what they know to congressional investigators. Such as the location of said e-mails.

    A very clever move by Leahy. As a current Senator and former prosecutor, Leahy understands the legal system and the game by the Chimpster. He knows that if he subpoenas the White House then the White House can turn around and claim executive privilege. By going around the White House and subpoena the Justice Department, executive privilege isn’t protected for the Justice Department. We shall see what happens.

    with all due respect to the estimable paul kiel,
    i don’t think that is accurate. the administration
    will assert that the DoJ is part of the executive branch.

    it is — of course — horsesh!t, but they will assert it.

    in any event, what is most interesting, about
    the subpoena and attachement A, easy view image

    , is that it reaches all the way back
    to the patrick fitzgerald subpoena of karl
    rove’s e-mail in — that’s RIGHT! — the plame
    outing/scooter libby investigation!

    he is gonna’ get tangled in his underwear,
    big time, on this one. . . just my $0.02. . .

    Why stop at Rove? There are plenty of people in the administration who have not been doing their jobs for the good of the American people as a whole. To think, as former UN Ambassador (shudder) John Bolton does, that the president is there to carry out the wishes of only the people that voted for him (he really said that!) is not merely naive, it’s just plain evil and stupid!

    Besides, I believe it’s Article II, Section 3 (I don’t have my pocket constitution on me) that says that the president must “take care that the laws be faithfully executed.” Can anyone with an IQ in the three-digit range honestly believe that he has done that? It’s time we all do our best to convince Speaker Pelosi that impeachment must be on the table. She can recuse herself if she wants to avoid making it look like she’s trying to get the president’s job, but she should let the rest of the House impeach if they want to. Besides, it’s supposed to be our House, not hers.

    Dang “things”, Marie, we’re each getting one (otherwise we’d be arguing over the one all of the time!)

    It’s still going to be a few weeks because we’re having some renovations done that have to come first, unfortunately. But we’re both really looking forward to spending more time on the “internets.” And Wayne has his own blog to get back to, too.
