Tester calls on top Gonzales aide to resign.

“Montana’s senators angrily reacted to a report in today’s Washington Post that acting Associate Attorney General William Mercer worked to alter federal law so that he and a handful of other senior Justice officials could escape residency requirements that governed their assignments as U.S. attorneys.”

The change, approved by Congress in 2006, allowed Mercer to continue serving as U.S. attorney for Montana while working there just three days a month and spending the rest of his time as one of Gonzales’s top aides at Justice Department headquarters in Washington.

The legislation was added to the USA Patriot Act reauthorization — at Mercer’s request — on the same day that Gonzales told Montana’s chief federal judge that Mercer was not in violation of federal residency requirements.

“For months, I gave Bill Mercer the benefit of the doubt that he was shooting straight with me and with the people of Montana,” said Sen. Jon Tester (D-Mont.), who called on Mercer to resign his position as U.S. attorney. … “Mr. Mercer was operating outside federal law, so he had the law changed. That might work in Alberto Gonzales’ Justice Department, but it’s not how we do business in Montana.”

OT, but HuffPo refers us to the NYT which wrote that Bush, talking to an industry trade group, said: “As you know, my position is clear – I’m the commander guy.” in reference to his veto today. The Decider prefers to be called The Commander Guy, it seems.

The next scene: Mercer giving Tester the Bush trademark middle finger wave. And with a merry “ho ho ho” and a “Go Cheney Yourself” he rides into the sunset for his three day vacation in Montana, out of our pocket.

Yeah, they legally change the law, so their illegal acts can fall within the boundaries of what’s legal.

Are you really that stupid? Don’t you see the problem in changing the law to accommodate illegal actions -changes made at the law-breaker’s request after lying to a judge?

Jakeoff really hates the Constitution doesn’t he????

    Jakeoff……

You do realize that it is a CRIME against the Constitution to create a law that evades the law after you have committed a crime????

Section 9 – Limits on Congress

The Migration or Importation of such Persons as any of the States now existing shall think proper to admit, shall not be prohibited by the Congress prior to the Year one thousand eight hundred and eight, but a tax or duty may be imposed on such Importation, not exceeding ten dollars for each Person.

The privilege of the Writ of Habeas Corpus shall not be suspended, unless when in Cases of Rebellion or Invasion the public Safety may require it.

No Bill of Attainder or ex post facto Law shall be passed.

    “Ex post facto
ex post facto adj. Formulated, enacted, or operating retroactively. [Med Lat., from what is done afterwards] Source: AHD

In U.S. Constitutional Law, the definition of what is ex post facto is more limited. The first definition of what exactly constitutes an ex post facto law is found in Calder v Bull (3 US 386 [1798]), in the opinion of Justice Chase:

1st. Every law that makes an action done before the passing of the law, and which was innocent when done, criminal; and punishes such action. 2d. Every law that aggravates a crime, or makes it greater than it was, when committed. 3d. Every law that changes the punishment, and inflicts a greater punishment, than the law annexed to the crime, when committed. 4th. Every law that alters the legal rules of evidence, and receives less, or different, testimony, than the law required at the time of the commission of the offense, in order to convict the offender.”

I guess you haven’t made it to Third Grade yet mikey – they teach you about assertions in Third Grade: good ones, bad ones, ones with solid logic in support of them, one’s without….

I guess they never teach you about cowardice, so not running away from your assertions is something you have to learn for yourself – best of luck finding some moral fortitude mikey.

Don’t have to. I didn’t make the comment. Didn’t they teach you the basic debating skills in your 3rd grade class?

Must be why she pleaded the fifth huh? Didn’t want to be understood, eh? How big must her, and your, brain be to think the fifth amendment is hard to understand? It, sadly, is a copout, worse by an intelligent person.

Michael, describe your mental image of a liberal. (This oughtta be funny)

Look at this sentence structure. It is not as an educated person would express. Let’s delve into this genius.

I know it’s hard for people like you

What is hard michael? Are you writing porno?
Whats wrong with using the word difficult?

Didn’t you know? Little michael gets *hard*, by pretending he has a pair of b*lls – because he’s such a little coward. It’s all of the self loathing…

  135. Buck Fush says:

Oh man, just where does this all stop, this is just maddening. How did these criminals get away with this this long, I know, I know, the compliant media bowing to the Bush crime family, and the 28%ers that don’t have a brain (Jake the Fake), but really this is insane how far the corruption goes.

Hating the Repukian MAFIA daily, oh and you too Jake the Fake, you are still a liar and scum.

  136. green says:

I haven’t read all the posts here tonight – too much name calling and bullying with no real substance. The Progressives here should be ashamed to fall to the level of the bushites and cheneycraps. Let the trolls and the fascists hang themselves — don’t stoop to their level.

    Thank you.

  137. green says:

Again – I haven’t read all the posts tonight, but it appears to me that things are unraveling out of control. True progressives should not be name calling and bullying like the bushites and cheneycraps — it is unbecoming — and frankly just plain stupid. Get a grip! We are in the fight of a life time and our country is at stake. Stay focused and stop bullying. When the trolls come ‘atrollin, ignore them – they don’t deserve honest debate. But, please, do not stoop to their level — it is just plain ugly!

    Thank you………..

  138. Leathers120751 says:

When will you all just learn to ignore the Michael’s and Jakes? I’m new here and out of the 100 plus comments most are just meaningless arguments with conservative supporters who never actually offer anything of value or any real discussion, yet they manage to hi-jack every thread on here with the same talking points that you people insist on refuting over and over. You all KNOW they’re not going to accept any proof or change their minds so why bother? Just ignore them please!! I’m interested in hearing real opinions on the topics, not constant arguing with people who actually make Mr. Bush look intelligent.

  139. Spudge_Boy says:

    I love it.

A bunch of kids playing in a sandbox in their own backyard. Another kid, who doesn’t even live on the same block as the other kids, comes along and kicks sand in the face of the kids who were playing and they are just supposed to sit there and take it.

    Nice.

  140. JosephW says:

If anyone NOT on the Ignore List doesn’t understand the difference between the Nazis (and Jay Randall) BANNING other political parties and in a democracy, one party legally being elected to Congress, say, like the Democrats controlled the U.S. House from to 1931 to 1995, let me know.

    Comment by Jake — May 2, 2007 @ 11:45 pm

Just to correct your error, Jake, the Democrats did NOT control the US House for the entire period.
In fact, the Republicans would’ve controlled the House from 1931 to 1933 if a few members didn’t die (making it, I believe, the only time when the minority party became the majority). But, in 1947 the House went from a 243/190 Dem/Rep membership to a 188/246 Dem/Rep House (IOW, Republican Majority for 2 years). In 1953, the House went from 234/199 Dem/Rep membership to 213/221 Dem/Rep House (IOW, Republican Majority for 2 years.
But, if you want to talk about banning political parties, the Republicans are the only ones who’ve attempted to do that in this country’s history. (Perhaps I shouldn’t tar all Republicans with that brush–only Joe McCarthy. You might want to read up on the HUAC hearings and see how one man attempted to infringe on the First Amendment rights of American citizens.)

  141. david says:

I’m glad you caught that error, JosephW. I tried to post a correction last night by my ISP went down. Yes, Jake the Joke skipped the 80th and 83rd Congress.

Jake also made another factual error. He repeated above that Hitler banned all political parties in 1939. This is wrong. Hitler banned all political parties on 14 July 1933. And there were plenty of American Republicans who thought this was a great idea. Henry Ford thought Adolph was A O K.

Now the link to the thread is that Republicans seem to have a problem with names and dates and facts. When you’re doing something illegal, it doesn’t make it okay to answer NO on the day you’ve changed the law and pretend that that makes all the past wrongdoing right.

And also like to point out the hypocrisy here. So, this guy is okay with you and his fiddling of his residency requirements. But making illegal immigrants legal through a change of the law, an amnesty, or some inclusion program, that’s not okay. Eh? Very odd. It’s essentially the same principle.

I have found 90% of Jake’s proofs are factual errors or distortions. But then Republicans seem to have a problem coordinating mind and mouth. I hear science is working on a vaccine.

I just did! I know it’s hard for people like you with public school educations to understand the difference intelligence and nonsense.

I’ve already told you a number of times in the past two+ months, mikey, that my public high school produced a Nobel Prize laureate in Physics, a former Secretary of State, a Newbery Medalist, at least one Pulitzer Prize winner and asked you what luminaries went to your supposedly superior private high school. Is it so hard for you to answer?
Is it also too hard for you to use a period (.) rather than a question mark (?) in a sentence that isn’t a question? Or don’t they teach punctuation in the “superior” private schools you attended?

  143. Lora says:

According to wikipedia, Cheney is not from Montana:
“Cheney was born in Lincoln, Nebraska, to Richard Herbert Cheney and Marjorie Lorraine Dickey. He attended Calvert Elementary School[2][3] before his family moved to Casper, Wyoming,[4] where he attended Natrona County High School”

  144. Raven says:

‘michael’ can’t even compose complete sentences, and he belittles public education….

  145. Sharon says:

Thank You Lora, I left the site early last night and back here late this A.M..

cheney has a large home in Wyoming, never lived in Montana..Suspect he will move to DUBI soon……Blessings

  146. Bruce says:

Jake is so low he sees the underside of snake poop when peering up.

  147. Webster says:

Jake — The problem is not changing the law, per se. The problem is that the request to change the law shows that he knew he was in the wrong in the first place.

RemoveBush — Your own quotes show that “ex post facto” does not apply here. A law that makes something illegal, subject to greater penalty, or easier to prove after the fact is ex post facto. The change here was the opposite.

Shane — In this country, the accused enjoy a presumption of innocence, not guilt. Michael is therefore justified in asking for evidence of guilt, and you are out of line to ask for evidence of innocence, first.

Also: Gallileo’s main opponents were the university professors wedded to the pagan Greek cosmology of Ptolemy. He ran into trouble with the Church b/c he was arrogant, his success drew much envy from his colleagues, and b/c too many churchmen were convinced that Ptolemaic “science” was taught by the Bible (which it wasn’t, btw). Galileo himself was a strong believer in the Bible
