Al Qaeda qualifies for individual protections guaranteed by law, rather then the protections granted as POWs. As such, an Al Qaeda operative may be charged with murder for killing a “enemy” soldier.

However, that same operative is still guaranteed protections under American law, and article IV of the geneva conventions (as per the Celebici Judgment which holds that there is no gap through which someone can fall and find themselves without any rights.)

Of course, under American law, where habeas corpus has been eliminated and anybody anywhere can be arrested and held indefinitely, tortured, and denied the right to appeal until a Combatant Status Review Tribunal has heard their case (Which can be staved off indefinitely as there is no time limit on just when the tribunal has to be called) this is all irrelevant – as anybody can be declared a potential enemy combatant and thus stripped of all of their rights.

So lets take a look at the Iraq war. Has Iraq signed the Geneva conventions?

Yes. In 1956.

Has Al Qaeada’s nation of origin, Saudi Arabia, signed the accords?

Yes, in 1963.

Have Iran or Syria signed the accords?

Yep, both in 1949.

If you want to list countries now, I can keep on giving you years in which they signed.

Al Qaeada as a NGO is protected via the fact that its members are nationals of signatory states. That as a militia it is not a signatory to the accords is irrelevant, as this would translate into every militia in the world having to have signed.

Al qaeda has not signed the GV conventions, and therefore are not eligible for POW status. Since the other party has not signed the deal, we are not bound by it. They do not fight under any nation or any flag, and cannot be considered soldiers.

You might have your ideal about how these foreigners should be treated, but it doesn’t mesh with the American people, and didn’t mesh with the last Congress.

Do we have to take this as simply another “mistake” or are there criminal or procedural actions we can take to force the administration to take responsibility for their negligence? You wouldn’t let a child lie to you time after time without some sort of response, what can our’s be?
