Comey’s Revelations Suggest Either Gonzales Is Lying Or More Spying Programs Exist»

Attorney General Alberto Gonzales faces new legal problems after yesterday’s testimony of former Deputy Attorney General James Comey.

In a 2006 hearing, when Sen. Chuck Schumer asked him about Comey’s objections to the NSA wiretapping program, Gonzales denied there was any “serious disagreement about the program“:

GONZALES: Senator, here is a response that I feel that I can give with respect to recent speculation or stories about disagreements. There has not been any serious disagreement, including — and I think this is accurate — there has not been any serious disagreement about the program that the president has confirmed. There have been disagreements about other matters regarding operations, which I cannot get into. I will also say –

SCHUMER: But there was some — I am sorry to cut you off, but there was some dissent within the administration, and Jim Comey did express at some point — that is all I asked you — some reservations.

GONZALES: The point I want to make is that, to my knowledge, none of the reservations dealt with the program that we are talking about today.

Gonzales’ answer suggests two possibilities.

1) Comey’s objections apply to the NSA warrantless wiretapping program that Gonzales was discussing. If so, then Gonzales quite likely made serious mis-statements under oath. And Gonzales was deeply and personally involved in the meeting at Ashcroft’s hospital bed, so he won’t be able to claim “I forgot.”

2) Perhaps Comey’s objections applied to a different domestic spying program. That has a big advantage for Gonzales — he wasn’t lying under oath. But then we would have senior Justice officials confirming that other “programs” exist for domestic spying, something the Administration has never previously stated.

During an interview I gave to PBS’s Frontline for a new documentary entitled Spying On the Home Front, I said, “there could be lots of room after you read [Gonzales’] testimony for other programs to be doing really unprecedented things.” Watch it:

    anyhoo, what comey had to say is some of the most disturbing stuff i’ve heard in quite a while, not because it’s all that suprising, but because it demos just how aware the bush cabal was and is about acting illegally and how ruthlessly they were going about it…

    i have zero doubt that there is a TON more yet to be uncovered, most of which will make comey’s disclosures pale by comparison…

Your careful scrutiny of Gonzales’ testimony was by far the most devastating in a series of increasingly troubling revelations. I hope other viewers also took note, and that your remarks will be the catalyst for some serious changes at the Justice department.

    That show last night made me really paranoid especially the segment on the NSA guy who built a room at AT&T that only the NSA guy could go in and when someone caught glimpse of his hardware setup they thought “ohhhhh… so he’s spying on our entire stream of data…”

    The Electronic Frontier Foundation (EFF) filed a class-action lawsuit against AT&T on January 31, 2006, accusing the telecom giant of violating the law and the privacy of its customers by collaborating with the National Security Agency (NSA) in its massive, illegal program to wiretap and data-mine Americans’ communications. On July 20, 2006, a federal judge denied the government’s and AT&T’s motions to dismiss the case, allowing the lawsuit to go forward.

    The EFF lawsuit arose from news reports in December 2005, which first revealed that the NSA has been intercepting Americans’ phone calls and Internet communications without any court oversight and in violation of the privacy safeguards established by Congress and the U.S. Constitution. This surveillance program, purportedly authorized by the President at least as early as 2001, apparently intercepts and analyzes the phone and Internet communications of millions of ordinary Americans.

    Internal AT&T Documents Had Been Temporarily Held Back Due To Government’s Concerns

    San Francisco - The Electronic Frontier Foundation (EFF) on Wednesday filed the legal briefs and evidence supporting its motion for a preliminary injunction in its class-action lawsuit against AT&T. After asking EFF to hold back the documents so that it could review them, the Department of Justice consented to EFF’s filing them under seal — a well-established procedure that prohibits public access and permits only the judge and the litigants to see the evidence. While not a party to the case, the government was concerned that even this procedure would not provide sufficient security and has represented to the Court that it is “presently considering whether and, if so, how it will participate in this case.”

    “The evidence that we are filing supports our claim that AT&T is diverting Internet traffic into the hands of the NSA wholesale, in violation of federal wiretapping laws and the Fourth Amendment,” said EFF Staff Attorney Kevin Bankston. “More than just threatening individuals’ privacy, AT&T’s apparent choice to give the government secret, direct access to millions of ordinary Americans’ Internet communications is a threat to the Constitution itself. We are asking the Court to put a stop to it now.”

    EFF’s evidence regarding AT&T’s dragnet surveillance of its networks includes a declaration by Mark Klein, a retired AT&T telecommunications technician, and several internal AT&T documents. This evidence was bolstered and explained by the expert opinion of J. Scott Marcus, who served as Senior Advisor for Internet Technology to the Federal Communications Commission from July 2001 until July 2005.

    The internal AT&T documents and portions of the supporting declarations have been submitted to the Court under a tentative seal, a procedure that allows AT&T five court days to explain to the Court why the information should be kept from the public.

    “The public deserves to know about AT&T’s illegal program,” said EFF Legal Director Cindy Cohn. “In an abundance of caution, we are providing AT&T with an opportunity to explain itself before this material goes on the public docket, but we believe that justice will ultimately require full disclosure.”

However, the program was modified, according to Comey so the program NOW is different from the program then!

    The devil’s in the details and, in this case, the timing. Comey et al object to the program, race to the hospital, DOJ refuses to bless the program, program operates clearly extra-legally without DOJ approval for three-or-so weeks, threatened resignations, program is then “fixed”, and DOJ then signs on — all in 2004. Thus, “the program that we are talking about today” in 2006 was clearly, in Gonzo’s mind, the post-dust-up, everybody agrees with “fixed” program that resulted.

    Now, don’t get me wrong, I believe Gonzo’s a lying sack of poo who could improve the state of our government only by leaving it, but I don’t think this one’s got even a hint of traction. He may do a shockingly compelling an impersonation of a room temperature IQ, but Gonzo’s no dummie.

Of course there’s more spying going on….everything is tracked by frequent flyer programs, affinity cards and those preferred buyer cards for every store know to Americans. I don’t doubt I’m on a terrorist watch group because I always ask for an aisle seat when I’m flying, order vegetarian pizza, and buy political books at Border’s. During the election they called it “micro-targetting” but the implications go far beyond who I might vote for.

    It is interesting isn’t it. THat the poll numbers seem to match up all over. 70% of Americans want the war ended, and neither the Republicans in Congress, nor the one in the oval office will end it. So their poll numbers almost match. Wierd.

    I wonder what would happen to those numbers if the Republicans would actually get on board with the will of the American people on this issue. There’s a novel idea.

Gonzales, that fat weasel, is saying that there was no serious disagreement about the program “we are talking about today” in its current incarnation.     Don’t mean to be rude or flippant [here it comes], but this issue of “other programs” has been well discussed since Gonzalez gave his Feb 2006 testimony before the Senate Judiciary. I’m grateful you’re talking about the “other programs,” but this isn’t news.

    It would be helpful if you summarized the information — from the Gonzalez hearing in 2006 before the Senate — indicating that there were multiple “programs”; and how these “other things” have or have not undermined the Constitution; and whether the Congress has any plans to protect the Constitution.

    Again, if Congress is going to do nothing, I would like to hear some discussion from you and others: What are the lawful options of the states to enforce the Constrution; and can Members of Congress be prosecuted for failing to use impeachment to enforce the Supreme Law, prevent war crimes?

    War crimes issues in re NSA surveillance: How illegallly captured information was used to abuse prisoners of war. Comey’s revelations suggest that the WHite House counsel well knew of the illegalities; but have pretended taht rendition and prisoner abuse is “not discussable.” Comey indicates that there are DOJ Memoranda contradicting statemetns by formely assigned White House counsel; and that formely assigned White House and legal counsel appear to have made inconsistent statements — first arguing that the activity was illegal in memoranda; then pubicly asserting outside court that the activity could not be discussed; then asserting that the program is lawful. These statements, their inconsitencies, and their attachment to the issues COmey said are well documented raise issues of attorney professionalism, ethics, and disbarment.

    Please consider reviewing the Comey revelations in light of inconstent statements by formely assigned counsel; and whether counsel assigned to the White House and DOJ have engaged in conduct that amounts to illegalities, misleading statements, or ethics violations of the attorney standards of conduct. Things do not appear to be adding up. If there have been misprepresntations by formely assigned White House counsel, then the issue turns to: Who has a legal duty to report that misconduct to their attorney disciplianry board? Answer: Legal counsel who are aware of the details. How convenient they appare to have had a meeting after 2001 to pretend there is a gag order on the supposed “things we can’t talk about” — the very things Comey well discussed.

Had they been signing of on approvals previously? Certainly had not been threatening to resign over it previously. So what changed?

    The CNN story I read said that Comey said Bush directed the DOJ to modify the program after their objections were raised, a couple days (IIRC) after it was approved. If that happened, then it seems to me Gonzales could be talking about the program as modified — which he sees different enough to consider a different program — which, as Comey seems to agree, did not have any serious objections.

    Of course it could be both. It’s not really an either-or choice. Gonzales was lying under oath AND there have been, and are now, an indeterminate number of nominally “different” domestic spying programs started since 9/11.

    Also, what counts as a separate or distinct “program” anyway? What would that word mean, from one minute to the next, to Gonzales?

    And, it should go without saying, Gonzales most certainly can claim “I forgot!” whenever he feels like it. Who cares whether anyone believes him? Who cares whether he’s under oath again when he says it? It’s never failed him so far, has it?

    I’m recalling the scene in The Princess Bride:

    Why would the FBI Director threaten to resign over a program _outside_ the FBI?

    Would he even know of a prgroam at NSA?

    That’s isn’t addressed by the notion that once the NSA program was changed, it was then a “different” — impliedly separate — program.

    I think we’re seeing the tip of the iceberg. Hats off to everyone doing the brutal work of trying to uncover the rest of the illegal activity. My hunch is that there’s a lot of it.

    The Bush Administration’s ability to keep things secret, destroy files, and move ethical people out of positions of authority and replace them with people who have no ethics, is all that’s keeping them afloat.

    The hand of Rove is everywhere, one step away from being caught at any given time.

    The problem is scerecy. We need to scale back what is allowed to be classified. We need to prosecute people for destroying evidence in cases where it is mysteriously “lost”.

    These people get off the hook regularly with word craft.”I didn’t EXACTLY say that” is the defense of the day.
