‘When The President Does It, That Means That It Is Not Illegal’»

Thirty years ago today:

Q: So what in a sense you’re saying is that there are certain situations…where the president can decide that it’s in the best interests of the nation or something, and do something illegal.

NIXON: Well, when the president does it, that means that it is not illegal.

Q: By definition.

NIXON: Exactly, exactly.

Watch it:

The echoes of President Nixon’s radical interpretation of American democracy are still heard frequently today, most notoriously in relation to President Bush’s warrantless domestic spying program.

In Dec. 2005, it was revealed that Bush had “signed a secret order in 2002 authorizing the National Security Agency to eavesdrop on U.S. citizens and foreign nationals in the United States, despite previous legal prohibitions against such domestic spying.”

A few months later, on Feb. 6, 2006, Attorney General Alberto Gonzales came before Congress and was asked to explain why President Bush didn’t simply work with Congress to develop a system that was legal:

KENNEDY: Now, we were facing the issue of electronic surveillance at another time, in 1976, when we had the attorney general, Ed Levi, and President Ford. And they followed a much different course than you have followed. Ed Levi came and consulted with us. … [T]hey dealt with the Congress, and they got FISA. … And the question that I have for you is, why didn’t you follow that kind of pathway, which was so successful at a different time? … Why didn’t you follow that pattern?

GONZALES: Sir, the short answer is that we didn’t think we needed to, quite frankly.

Two Nixon era White House interns: Cheney & Rumsfeld. Picked up some nasty habits from a master.

Nixon was an authoritarian, paranoid pain in the butt. He was also about 400 times the president that GWB is. As much as I hated the s.o.b. while he was in office, in retrospect his administration looks pretty damn good. Take a look at the “major initiatives” in the Wikipedia entry on Nixon and compare that to the “accomplishments” of this administration.

  3. Jim Says:

So why exactly did he accept a presidential pardon? Oh that’s right, he was gonna end up in federal prison for taking part in a conspiracy to obstruct justice. Must be a flaw in his reasoning there somewhere.

  4. Angry One Says:

Gonzales and the President don’t have the courage to just come and make the claim that FISA is unconstitutional.

They know they would lose in both the court of law and the court of public opinion.

And we keep letting them get away with it. By we, I mean our elected “Representatives”.

Have you heard what he’s doing to Michael Moore? Why? Because the last six years of his regime, he’s be enable to get away with more and more to the point that he is now at the same point Hitler was he started his book burnings, and targetting the intelligensia who were turning German culture more thought-based.

If Impeachment doesn’t get on the table soon, I shutter to think of what’s next.

    Then there’s this:

Navy lawyer convicted of leaking Guantanamo names

But in an hourlong interview after the opening day of his trial Monday, Diaz said he believes the Bush administration’s prosecution of the war on terror is illegal. He accused officials of violating international law, such as the Geneva Conventions on the humane treatment of war prisoners, and the U.S. Constitution’s guarantee of due process.

“I made a stupid decision, I know, but I felt it was the right decision, the moral decision, the decision that was required by international law,” Diaz told the Dallas newspaper. “No matter how the conflict was identified, we were to treat them in accordance with Geneva, and it just wasn’t being done.”

The Defense Department strenuously rejects such comments.

Bush administration officials have characterized the Guantanamo population overall as “the worst of the worst.” Diaz said that is one of two incorrect or false statements.

“The other statement was ‘We do not torture,’ ” said Diaz, whose jobs included tracking and investigating abuse allegations.

“I think a good case could be made for allegations of war crimes, policies that were war crimes,” he said. “There was a way to do this properly, and we’re not doing it properly.”

  8. Kate Henry Says:

Our country is looking more and more like Hitler’s Germany every day. We have a dictator rather than a President and men who think they are above the law. Do the Republics really want to go where they are heading? They need to think about the precedent they are setting because it will apply to a Democratic administration too. Do they really want to have a Democratic President who has dictatorial powers? I just can’t imagine what the Republics would be saying today if it was a Democratic administration that was trampling on our constitution and turning our country into a fascist state. But, since the Republic’s plan is to make themselves a permanent majority, there is no need for them to think that way.

But if they were smart, they would be following the will of the people. Because, like it or not, we are still a democratic government with the right of the people to determine who leads us. The Republics can’t depend on stealing another election. Ohio now has a Democratic Governor and Secretary of State and Florida has a Governor who seems to be an ethical fellow. And the Democrats have a majority that can pass election reform laws (which Bush will Veto, but that will only help the Democrats further).

2008 - a Democratic cakewalk and a Republic bloodbath. It can’t come soon enough.

You don’t think Rove has had enough time to repair the “faulty” electronic voting/tabulation machines that somehow malfunctioned last election, allowing Democrats to win?

I truly believe the only solution out of this is a 3 (or 4) party system. But, the way things are now, it’s the Big Guys : Dems and Repubs.
There are only a handful of people in Washington that I like : Kucinich, Feingold, Ron Paul.

I love my country but fear my government. I pray that there is a backlash against the Criminal Bush Years (of course, it is a Crime Family : The Bushies).

Can you imagine the Social Unrest if we went into Iran. I just pray everyday that this doesn’t happen.

Iran is 6 X as big as Iran : we f****d up in Afghanistan and Iraq. Of course, we went over there for OIL, Hegemony, Control. All the War Profiteers, The OIL CEO’s are raking in the big bucks. Why do you think Haliburton is moving to Dubai?

I agree with Kate that it will be a GOP blood bath. Karl lost his grip in 2006 when his plan failed to retain Congress for the GOP. His ability to effectively maneuver outside the law will be diminished going forward. Also, many of his dirty tricks just don’t work anymore with anyone but the koolaid drinkers. The GOP has lost the independent voters in a big way, and is going to pay dearly for it.

  16. Jo-Ann Says:

Cheney’s using that atrified logic in his defense in the Plame Leak case. “so what if I leaked that name? I have immunity because I’m the VP.” The President and VP have just flushed the constitution down the crapper. That darn constitution….something about no person being “above” the law.

I know what your going to say, there aren’t enough vote’s, bla, bla, bla..Enough already…The Dem’s are playing the same game the repukes are right now, hedging their bet’s and playing for vote’s…Instead of taking care of our constitution, country and the people they are working with word’s to try a take over in 2008…I and hundred’s of thousand’s of other peace activests are here and every where to say not good enough….Atleast broadcast that impeachment is back on the table and start investigation’s…So far, they (the dem’s) behavior is lacking at best and lately enabeling….Bush vetoed, they should of shouted from the roof top’s and said fine, end of funding bring the troop’s home……Blessings

In the timeline below, replace ‘Hitler’ with ‘Bush’, ‘Reichstag’ with ‘World Trade Towers’, ‘Enabling Act’ with ‘Patriot Act’, and so on to see how much time we should expect the take-over to take:

January 30, 1933 - Hitler was named Chancellor of Germany.

February 27, 1933 - The Reichstag building burned.
March 23, 1933 - The Enabling Act granted Hitler dictatorial powers.

May 10, 1933 - Nazis and college students burned books.

    August 2, 1934 - Hitler became Führer.

September 15, 1935 - The Nuremberg Laws against Jews were proclaimed.
March 7, 1936 - German troops reoccupied the demilitarized Rhineland.
December 1936 - The Hitler Youth Law made membership compulsory for youths aged 10 to 18.

    March 13, 1938 - Hitler annexed Austria.

March 1939 - Hitler annexed Czechoslovakia.

March 25, 1939 - A new tougher law concerning compulsory Hitler Youth membership conscripted all German boys aged 10 into the Hitler Youth.

September 1, 1939 - Germany invaded Poland, beginning World War II.

October 7, 1939 - Nazis began forcing Polish farmers off their land.

April 9, 1940 - Germany invaded Denmark and Norway.
May 10, 1940 - Germany invaded Belgium, the Netherlands, and Luxembourg.
June 14, 1940 - Paris occupied by Nazis.

Fall 1940 - The National Youth Directorate required target practice and terrain maneuvers for boys 10 and older.
June 22, 1941 - Germany invaded the Soviet Union.

GALLUP: In Shocking Plunge, Only 1 in 4 Now Satisfied With State of USA

    Published: May 16, 2007 1:25 PM ET

NEW YORK What’s going on? Gallup reports today a sudden plunge in its regular “satisfaction” index. Only 25% of Americans now say they satisfied with the state of their country — down 8% in just one month — and one of the lowest ever measured.

“The current 25% satisfaction level is very low by historical standards,” Gallup explained. “Since Gallup first asked this question in 1979, the average percentage of Americans saying they are satisfied with conditions in the country is 43%.”

The latest poll finds 45% of Republicans saying they are satisfied, compared with only 12% of Democrats. Over the past month, satisfaction fell more among Democrats, suggesting that some of them may be souring on their party’s actions or inactions in Congress.

The disconcerting part is the fact that 25% feel satisfied with the current state of affairs, yet 25% of the country is not the uberrich who are benefiting from Bush’s policies. Most of the 25% are simply living in a delusion.

  41. doro Says:

    #10 Kate

Our country is looking more and more like Hitler’s Germany every day.

There are similarities and there are very important distinctions. What is quite similar is the analogy between the burning of the Parliament in Berlin and 9/11 and the subsequent loss of civil rights. However, the Berlin Parliament was burned down by the Nazis in order to manufacture a reason for disbanding the parliamentary rule (and there is some doubt among scholars if it wasn’t just an opportunity given to them). There are theories who hint at such a background for 9/11, but I don’t believe in those theories. Albeit the attacks were used for the neo-con political agenda, and while I think they weren’t staged, I am inclined to believe the attacks were wilfully not impeded. Some people waited for such a thing to happen and did nothing to stop it.

In Germany of 1933 civil rights were disbanded altogether the very next day and it took only four more years to establish an absolute rule of power by the Nazis, with the majority of the Germans in favour of their rule.

And there is where the big difference lies. There are only 27 % of Americans behind this president. There is a remaining parliamentary structure and you all have proven beyond any doubt, that you are not endorsing your current administration by voting as you did last year.

There still are blogs like TP, unthinkable in a Germany of, let’s say 1935, even life threatening. You are still able to have your say and there are committees looking into the wrongdoings of administration officials. Your Democracy is alive, ours wasn’t. We never really tried to protect ourselves from dictatorship, let alone others from the brutal consequences. Individuals, whom I admire more than any “decider” and “leader” in this world, resisted and tried to change things. They almost collectively paid the ultimate price for that.

No, your country is right now not resembling Nazi Germany, but it will be your responsibility to keep it from going there. It won’t be for a lack of trying by some politicians.

    Used in Hitler’s psychological profile

The phrase was also used in a report prepared during the war by the United States Office of Strategic Services in describing Hitler’s psychological profile:[2]

His primary rules were: never allow the public to cool off; never admit a fault or wrong; never concede that there may be some good in your enemy; never leave room for alternatives; never accept blame; concentrate on one enemy at a time and blame him for everything that goes wrong; people will believe a big lie sooner than a little one; and if you repeat it frequently enough people will sooner or later believe it.[3]

In Tokyo, I became friends with Miss S, who, though blond and attractive with a good personality, had the worst luck with men. One time she told me that when she was a toddler in a Rocky Mountain state, her GOP mother and other Repulbican ladies went to meet then VP Nixon at the local airport. Nixon apparently gravitated to S’s attractive mother and kissed the babe (little S) in her arms. In other words, the first man, other than a relative to kiss S, was Nixon. I recall telling “No wonder you’ve been cursed with men! Maybe you’d better get kissed by someone on the other side like Castro or Gorbachev to break the spell.”

Ah-ha-ha-ha-ha-ha-ha, are you hypocrites even going to mention Bill “Executive Privilege” Clinton! Worst President Ever!

    ROTFL

Hey spouted that line more times than any president thinking he could get away with anything. You people think President Bush’s wire tapping was bad but this guy had personal files sitting on coffee tables.

    ROTFL.

And you #1 want to make a joke relating it to sex? If a Republican stuck a cigar into an underlings vagina at work you would call it sexual harassments, perversion and abuse of power. You would call for impeachment and jail. But when Billy does it you say it is his personal life.

    ROTFL, Executive Privilege ROTFL

  60. Lora Says:

So what’s your point, Crappy Guy? As you should know, Clinton was punished for his transgression. But has Bush or anyone else in his White House explained the many nocturnal visits by gay hooker Jeff Gannon/James Guckert? How about an explanation when you finish ROTFL?

  61. SINGH Says:

WAY TO GO, SHARON… HUMBLY,I DO NOT AGREE CMPLETELY, THOUGH…WE WILL BE HANDING PUGS AND NEOCONS’ THE KEYS TO CITY’ ONCE AGAIN. THEY DISCOUNT OUR ABILITY TO STAY FOCUSED AND FOCUS IS WHAT WE NEED, MUST HAVE. I KNOW HOW YOU FEEL, I FELT THE SAME WAY BUT WHAT I FOUND WAS THAT THE DEMS, WHILE NOT PERFECT, ARE A WHOLE LOT BETTER. PLEASE, LETS CONTINUE TO LET OUR SENATORS AND REPS. KNOW HOW WE FEEL…WE CAN CONTINUE TO ENLIGHTEN AS WE TAKE MAJORITY CONTROL OF THE SENATE, HOUSE AND WHITE HOUSE IN ‘08. WE CANNOT ASSUME 1 VOTE! WE WILL HAVE TO REGAIN, THROUGH CONTINUED INVOLVMENT AND DIALOUGE, THE TRUST OF OUR NIEGHBORS AND COMMUNITY MEMBERS. TO ME, IT WILL AMOUNT TO 1 PERSON SPEAKING DIRECTLY TO THE HEART OF ANOTHER PERSON…1 PERSON AT A TIME, 1 PERSON AT A TIME, ONE PERSON AT A TIME UNTIL WE ACHIEVE WHAT IS RIGHT. I FEEL YOUR PAIN
