New Documents Confirm Gonzales Lied To Senator About Plan To Install Rove Protege As U.S. Attorney»

gonzpoint.jpg On Dec. 15, Attorney General Alberto Gonzales and Sen. Mark Pryor (D-AR) had their second phone conversation regarding the appointment of Karl Rove-protege Tim Griffin as the new U.S. attorney in Arkansas. In April 19 testimony to the Senate Judiciary Committee, Gonzales said that when Pryor objected to Griffin’s appointment, Gonzales promised to find a different candidate:

But I had told Senator Pryor: I wanted Mr. Griffin in for a period of time. Let’s see how he does.

And then in subsequent conversation with Mr. Pryor, I asked him: Can you support Mr. Griffin as the nominee?

And you know, he made it clear to me that he would not support him, by not giving me a yes answer, and so I said: Well, then I cannot recommend him to the White House, because if you don’t support him, I know he will not be confirmed. We’ll look for someone else, and give me names that we ought to consider.

Yet a newly released Feb. 8 e-mail by Assistant Attorney General William Moschella shows that Gonzales made the decision to appoint Griffin “on or about December 15, 2006, after the second of the Attorney General’s telephone conversations with Sen. Pryor”:

Therefore, despite assuring Pryor that he would “look for someone else,” Gonzales went ahead and appointed Griffin anyway. Additionally, four days after the meeting between Gonzales and Pryor, Sampson sent out an e-mail recommending that they “gum this [Griffin’s nomination] to death.” Sampson told the Senate Judiciary Committee that Gonzales did not object to this plan at the time.

Griffin continues to serve indefinitely as an “interim” U.S. attorney, even though the traditional 120-day term limit for interim prosecutors expired on April 20.

UPDATE: Emtywheel at The Next Hurrah points out that Gonzales signed Griffin’s appointment “on December 18 … but it was dated December 15,” the same day as his second conversation with Pryor.

    Gonzales can sit there and smirk, content in knowing that Bush will never get rid of him and that, as far as he can tell, there’s nothing the Democrats can do to touch him. But, the point is this. He has lied. He continues to lie. And there’s no reason to think he won’t keep lying. He’s a liar. Whenever he comes in to testify under oath about anything, Congress can’t assume that he means what he says or that he has any intention of keeping the promises he makes. What they can assume is that they’ll get half truths, at best, if not bald-faced lies. They can also assume that when he’s confronted on what appears to be false testimony, he’ll claim he forgot something or meant something different.

    You simply cannot have the Attorney General of the United States utterly lacking in credibility to the extent that all of his future communications with Congress and with the U.S. attorneys’ offices around the country are deemed meaningless and generally ignored.

    Get. Rid. Of. Him. Now.

    Congress must impeach.

Griffin is still in office, despite the fact that the 120-day time limit for interim appointees has expired, despite the fact that Griffin withheld his name for consideration for confirmation, and despite assurances from Gonzo that the administration did not plan to use the PATRIOT Act provision to appoint attorneys for an indefinite period of time while bypassing Senate approval.

    Am I reading this right? Gonzo talks Pryor and on 12/15 and on or about he appoints the Rove’s BFF Griffin to the position. So either the decision was already made and Gonzo lied through his teeth, or within hours he made the decision blowing off Pryor’s concerns. Where did Gonzo look, under his own desk? “Oh, no one qualified under here, let’s go with Griffin”.

    Here’s the part you’re struggling with:

    If he knew “he will not be confirmed”, he would not have appointed him anyway, IF he had any intention of looking for another candidate or waiting for Pryor to offer one. He appointed him anyway so that it could be, as Sampson put it, ‘gummed to death’.

    I’m not going to argue that Kerry should have won. He was a lousy candidate who ran a lousy campaign. However, there were serious discrepancies between exit poll numbers and offical count numbers. In some cases, these discrepanices exceeded those seen in the Ukraine in an election that the United Nations declared void. To ignore these, regardless of whether they affected the ultimate result of the election is very dangerous.

    No, the Supreme court is not supposed to intervene in state matters during an election. Technically speaking though, this is not what they did although they effectively ended the recount and hence gave the election to Bush.

    Note: In all of the recount scenarios that Gore was pushing for, Bush still would have won. However, in all thorough (meaning counting votes where the intent of the voter was clear statewide) recount scenarios Gore won.

What is “caging” and how was it used to deny eligible African American residents serving in the military overseas the right to vote?
