“A Saudi detainee at the U.S. military detention facility at Guantanamo Bay, Cuba, was found dead in his cell from an apparent suicide yesterday,” the fourth detainee to take his own life at the facility in the past year. The Center for Constitutional Rights released a statement noting that in recent months, “conditions at Guantanamo have become even more bleak: the military has increasingly held people in solitary confinement and continued to refuse to allow independent psychological evaluations.”

UPDATE: Digby reminds us that to some U.S. officials, detainee suicides are an act of war:

Rear Admiral Harris is adamant that the people in his care are well looked after and are enemies of the United States.

He told me they use any weapon they can - including their own urine and faeces - to continue to wage war on the United States.

The suicide of three detainees, he reaffirmed to me, amounted to “asymmetrical warfare.”

CENTER FOR CONSTITUTIONAL RIGHTS CONDEMNS DEATH OF FOURTH GUANTANAMO PRISONER

New York, NY, May 30, 2007 - The Center for Constitutional Rights (CCR) today condemned the death of a fourth prisoner held without charge or trial at Guantánamo Bay, Cuba. The detainee is Saudi but has not yet been identified by the Department of Defense.

“In the last year, the conditions at Guantanamo have become even more bleak: the military has increasingly held people in solitary confinement and continued to refuse to allow independent psychological evaluations. The United States government is responsible for this man’s death and must be held accountable,” said Wells Dixon, Staff Attorney for the CCR Guantanamo Global Justice Initiative. “By refusing to hear the men’s cases or exercise any oversight of their conditions, the judiciary contributed further to the desperation of the detainees, and Congress, in failing to restore the fundamental right of habeas corpus, dealt the final blow.”

This death comes nearly one year after the deaths of three men at Guantánamo on June 10, 2006. The Government has still provided extremely limited information to the families and lawyers of the deceased, and challenged an attempt to preserve evidence related to the deaths.

“The legal black hole of Guantanamo is an unconscionable mistake,” said Michael Ratner, President of CCR. “Nearly three years ago, the Supreme Court in Rasul held that Guantanamo detainees have the right to challenge their detention. The right of habeas corpus must be restored and Guantanamo must be closed. No one else should have to die because of this tragic mistake.”

CCR has requested the identification of the deceased from the Department of Justice, and has demanded that the military preserve all evidence related to the deaths and the deceased. CCR has received no response yet from the Department of Justice.

    Both of these statements beg the question. On the one hand, we do not know if this person was actually a terrorist. On the other, we do not know he was innocent just because he was held without charge or trial.

    Accordingly, nothing meaningful can be said at this time regarding his guilt or innocence.

They were not under suspicion by coalition forces. They were turned in by someone who needed the money and probably didn’t care for them. This is one of the many reasons why expedient trials for the detainees are so important.

    I can’t imagine anything more frustrating than being imprisoned indefinitely for something that I had not done…might drive anyone to drastic measures.

    Robert (posting #148) is correct. According to the international law of war, nations who capture enemy combatants on the battlefield are permitted to detain the combatant for the duration of the conflict. There is no requirement for a trial or determination of “guilt or innocence” since the detainment is not for punitive purposes.

    Erock, however, raises a valid point. If he was not captured on the battlefield and was rather “turned in” by tribesmen, there should be some type of hearing to determine if he is an enemy combatant.

    The people held at Gitmo have been subjected to a series of violations of the Geneva Conventions. They’ve been arbitrarily removed from the place of capture, denied access to lawyers and the Red Cross, held in solitary, tortured, and denied due process of law.

    The tribunals they are only now beginning to face are also contrary to international law. And it’s taken this long to set them up because all earlier versions were so obviously kangaroo courts. Sadly, journalists see these too as inadequate.

    The Republican trolls on this thread seem to demand all rights when poor Scooter or Gonzo go before the courts, but they chuck everything into the trashbin when the religion, skin color, and nationality doesn’t meet their standard.

    Gitmo is NOT a POW camp. It’s a concentration camp. And torture happens there. The terms the WH uses to keep these men prisoners are deceitful. Lawful or unlawful combatants do have rights and these prisoners are denied all rights.

    What is most offensive are the comments by the trolls wanting to exact vengence on these men for crimes committed since they were arrested by other people in other countries. By this logic, I should arrest and torture any Calfornian simply because a guy got mugged in LA. Where did this kind of bizarre thinking come from? And you wonder why the world hates the USA.

    Agreed.

    The international law that Exley cites as justification for holding these people prisoner does not in any way apply to the “War on Terror.” Terror will never sign a treaty and thus the conflict will never be over. So to apply your international law in this case, Exley, is to condemn these men to death with no trial. If you would prefer to label them as “unlawful combatants,” which arguably may be more apt, then under the Geneva convention they are entitled to trials to prove their guilt or innocence of actions that made them an “unlawful combatant.” This was the case in the Luanda Trial regarding mercenaries fighting in Angola.

    Now, that said, how can we expect to be a beacon of democracy for the budding nations of Afghanistan and Iraq to emulate if we don’t lead by example. This is expecially true when it comes to the treatment of THEIR citizens.
