Libby wants probation (and maybe community service).

Lawyers for Scooter Libby urged a federal judge today to “spare him from prison on his felony conviction for his role in a C.I.A. leak investigation,” recommending Libby “be given probation, possibly with community service, when he is sentenced on Tuesday.” Their court filing describing Libby begins, “Distinguished public servant. Generous mentor. Selfless friend.” Emptywheel has additional analysis.

    for comparision’s sake:

    Martha Stewart went to trial and was convicted in March 2004 on four counts of lying to investigators and obstruction of justice.

    She was sentenced to 5 months in prison. The underlying investigation was an insider trading charge which netted Ms. Stewart all of about $45,000.

    Here, Scooter Libby played a part in outing a CIA operative who was involved in tracking WMD’s. Her brass-plate front company, Brewster Jennings, was outed as well. The net loss to taxpayers for losing this operation is easily in the millions of dollars. And we will never know how many people (contacts and/or agents) were subsequently murdered because of this orchestrated disclosure of our under cover agent and operation.

    It will be interesting to see how the balance of Justice will weigh the relative merits of these two cases. One the one hand, a relatively small amount, for insider trading. On the other, the destruction of our ability to track international trafficking in weapons of mass destruction, at a time when such tracking was of utmost importance in the lead-up to war based, in large part, on allegations of weapons of mass destruction.

    Libby played a part in causing a war that cost hundreds of thousands of human lives. That, some people believe, defines him as a “Distinguished public servant.”

    Oh well, Hitler handed out numerous awards, too.

    I think the Judge will go along with Fitz recommendations, and I also think bail will be granted pending appeal. Scooter ain’t seeing the inside of a prison for a long time.

    quatrain #8 features the word “nay” but again it is not a clear usage. “Nay” signifies a reformulation of a thought in stronger or more accurate words.

    For example:
    I feel good, nay, great when the sun shines.

    In your poem you describe jail, but you do not reformulate any less accurate or weaker thought with your “nay”.

    Isn’t the sentancing phase after the conviction (Like a different day)? I don’t think it is uncommon for anyone to be called guilty and then return 2 months later for a sentence (Happened to Paris I believe). It wouldn’t be bail but it also wouldn’t be waiting in jail.

    Looks like it’s up to the judge rather to take away bail after verdict and put you in custody or not. Based on how they feel the sentence will be.

Judge Walton is up for a cushy government job (I believe it is on the FISA court) and if he gives Libby jail time, I’m fairly sure they will withdraw their offer. Actually, I think that Judge Walton should recurse himself from the sentencing due to the fact that he now has a conflict of interest with this government job waiting for him.

    Actually Libby is a TRAITOR pure and simple. We executed the Rosenbergs back in the communist scare days, and I believe that execution is the appropriate punishment for being a traitor to your country.

    I was actually referring to Afghanistan and the killing of a shitload of al Qaeda members since.

    But now you mention it, while Iraq had nothing to do with 9/11, the INVASION of Iraq certainly did, which is pretty much all that matters at this point. Anyone with an IQ should have figured that out by now also.

    There’s a reason that people were citing a lack of targets in Afghanistan as a reason that the shock and awe campaign would have to move to Iraq. And that reporters were embedded with troops and surrounded by 24/7 war-porn news coverage when they got there.

    You and your dissatisfaction with the level of “revenge for 9/11″ is that reason, whether you want to admit it or not.

    But you seem to realise that there is something a political party could do that would disqualify its members from holding office ever again…. in the followup to your post calling for Democrats to negotiate with al Qaeda… where apparently you think this would amount to “avenging 9/11″.

    Mr Libby obstructed justice, and by doing so assisted those who did out Plame. So he wasn’t linked directly, big deal. He still got charged with a crime. He is no better than Abramoff.

    Paulson you sir are wrong. Now apologize. It is Bush that is reaching out to the insurgenst, not Reid and nor Pelosi.

    I would have to say that 3 years in it’s disappointing that you cannot yet distinguish between nationalist insurgents in Iraq and al Qaeda.
